SR-120407-1C~~ c;cYar City Council Report Santa Monica City Council Meeting: December 4, 2007 Agenda Item: ~=~ To: Mayor and City Council From: Craig Perkins, Director -Environmental and Public Works Management Subject: Adopt a Resolution Authorizing the City Council to Recognize the Los Angeles County Department of Public Health as the Local Enforcement Agency. Recommended Action Staff recommends that the City Council adopt the attached resolution designating the Los Angeles County Department of Public Health as the Local Enforcement Agency (LEA) responsible for enforcing all laws and regulations relating to the management of solid waste in the City of Santa Monica. Executive Summary The Los Angeles County Department of Health Services has served as the LEA for the City of Santa Monica since 1977. The Los Angeles County Department of Health Services has formed the Department of Public Health as the LEA for solid waste management. The Public Resources Code Section 43203(a) provides that the Los Angeles Board of Supervisors may designate an LEA to carry out provisions of the California Integrated Waste Management Act of 1989 with the approval of the majority of the cities within the County that contain a majority of the population in the incorporated areas of the County. The Board of Supervisors has designated the Los Angeles Department of Public Health as the designated LEA to carry out the provisions of the Act in the County of Los Angeles. Discussion The Los Angeles County Department of Public Health, acting as the LEA, will have responsibility for enforcing all laws and regulations relating to the management of solid waste. 1 Reasons to designate the County of Los Angeles Department of Public Health as the City of Santa Monica's LEA are as follows: 1. The Department of Public Health has the technical expertise, training, and experience required to meet the State regulations. 2. Any new designation of an existing LEA, or the City as the LEA, will require new California Integrated Waste Management Board certifications and approvals. 3. Staff believes it is in the City's best short and long term interest to continue to utilize the expertise and staff of the Department of Public Health of the County of Los Angeles as its designated LEA to avoid incurring increased expenditures and to avoid new certifications or approvals. Previous Council Actions Resolution No. 4895 (CCS), dated July 12, 1977, designated the Los Angeles County Department of Health Services as the enforcement agency for the City of Santa Monica.
