Anderson, Assistant City Manager Subject: Modification to Agreement 8524 (CCS) with Gershman, Brickner and Bratton, Inc. for Operations, Financial and Rate Review of Solid Waste Services to Assist in Negotiations and Advising on Developing a Public/Private Partnership for Solid Waste Transfer Services Recommended Action Staff recommends that the City Council authorize the City Manager to negotiate and execute a Sixth Modification to Agreement 8524 (CCS) with Gershman, Brickner and Bratton, Inc. (GBB) in the amount not to exceed $50,000, for a total agreement amount of $553,000. Executive Summary On October 10, 2007, Council discussed in study session. the results of a RFP process that was intended to provide Council with information on how the market would respond to providing commercial waste collection and transfer services in the city, Council considered recommendations from the Evaluation Committee directing staff to return with additional information related to commercial collection and to begin negotiations to create apublic/private partnerships for the provision of transfer services. Staff indicated that it would identify negotiation points within ninety (90) days and provide Council with an update in forty five (45) days. In order to complete this work, staff is proposing an additional modification to this agreement to continue to engage GBB during the negotiations for the Transfer Services. With this modification, the multi- yeartotal for GBB's agreement will not exceed $553,000. GBB, having worked with the City since 2005 is very familiar with the evolution of Council direction and the local solid waste market. To assist with the negations, staff will also commence an appraisal of the property that one of the private companies suggested could be considered as a swap with current City property in the area the current solid waste facility and City yards. The cost of such an appraisal will not .require Council action. The appraisal can be authorized within staffs contracting authority. 1 Discussion GBB has been engaged with the City since October 2005 for amulti-phased review of solid waste operations; including operations and financial analysis, identification of potential efficiency and the development of Request for Proposals (RFPs) for alternative service delivery options. To date, GBB has completed Phase. I of their engagement, which included the development of a comprehensive report on the operational and financial review which was presented to Council at the March 14 Study Session: The study session resulted in GBB presenting a variety of recommendations to improve operational efficiencies and a detailed financial analysis. At that time, GBB recommended implementation a plan to build an operating reserve. Phase I involved additional analysis, conference calls and in-person meetings than originally anticipated in the 2005 proposal. GBB has also provided assistance and analysis related to the review of the Request for Proposals (RFP) responses to test alternative service delivery methods of commercial and transfer operations. - GBB's proposed additional scope includes funds in the amount of $50,000 to assist with identifying public/private partnership opportunities for Transfer Services, assist with analyzing land swap opportunities and to participate in negotiations with the City, Southern California Disposal, Athens Services and Allan Company. Financial Impacts and Budget Actions Funds in the amount of $50,000 are available in account 01202.555060 for additional services related to the development and analysis of the RFPs.
