SR-111307-1G~_~ City Council Report cty or Santa Monica" City Council Meeting: November 13, 2007 Agenda Item: t To: Mayor and City Council From: Craig Perkins, Director- Environmental and Public Works Management Subject: Award of Professional Services Agreement with Roesling Nakamura Terada Architects for Design of the Beach Public Restroom Facility Replacement Project Recommended Action Staff recommends that the City Council authorize the City Manager to negotiate and execute a professional services agreement with Roesling Nakamura Terada Architects for design services for the development of beach restroom facilities in the amount of $263,196 plus a 10% contingency for a total amount not to exceed $289,516. Executive Summary In accordance with a California Department of Parks and Recreation (State Parks) Consent Decree, the City of Santa Monica has committed to upgrading and bringing Santa .Monica State Beach public restroom facilities into compliance with the Americans with Disabilities Act (ADA) by June of 2010. In order to comply with ADA, the construction of new beach restroom facilities is recommended. The City plans to replace eight non-compliant facilities utilizing design concepts that consider successful recent park restroom prototypes that have been constructed by the City, durability, accessibility, sustainability and ease of maintenance. In order to minimize impacts on 1 the public, staff proposes atwo-phase construction schedule with four facilities under construction during the non-peak use period from October 2008 to April 2009 and the last four constructed during October 2009 to April 2010. The total budget impact for this agreement is $289,516. This project will be funded by Community Development Block Grant and City Beach funds Discussion Background In December 2005, the City received notification from the California Department of Parks and Recreation (State Parks) that it had been defending a class action lawsuit filed under ADA by plaintiffs representing- park users with mobility, vision and hearing disabilities. The claims in the lawsuit were that the State Parks, including those park units operated by local agencies such as the City of Santa Monica, did not provide legally sufficient access for persons with disabilities. The parties to this litigation reached a comprehensive class-wide settlement. State Parks determined that the Consent Decree was in the best interest of the State as it provided an orderly, deliberate process for ensuring programmatic access for park users with disabilities. It also provided a release and protection against future litigation for the term of the Consent Decree (which lasts until at least 2016). On March 23. 2006, City Council members received an Information Item providing background on the City's participation in a Consent Decree. Based on review of the Consent Decree and an assessment of the costs and benefits, the City Attorney 2 recommended that the City participate in the Decree. Subsequently, the City Manager signed and forwarded a letter to State Parks acknowledging that the City would participate in the Decree. The City considered the option of participating in the Consent Decree or opting out. Since the City has along-standing commitment to accessibility, the City chose to participate in the Consent Decree and the City will also receive the protection against future litigation. Based on the accessibility assessment of Santa Monica State Beach facilities and discussions with the State's Accessibility Program staff, the City identified eight beach restroom buildings that require replacement in order to comply with the Consent Decree (see attached map). The restroom facilities are located at: • 810 Palisades Beach Road ^ 1100 Palisades Beach Road 1200 Palisades Beach Road 2000 Ocean Front Walk 2400 Ocean Front Walk ^ 2500 Ocean Front Walk • 2600 Ocean Front Walk • 2800 Ocean Front Walk Funding for design is currently appropriated in the Capital Improvement Program (CIP) budget. Funding for construction is programmed in the FY2009-2010 CIP Budget. 3 In order to complete construction within the timeline set forth in the consent decree and also minimize impacts on the public due to the loss of restrooms during construction, a two phase construction process is recommended where only four restroom locations are under construction at any given time (during the non-peak beach season of October through April in the coming two years). This requires a streamlined design and review process during the coming months in order to be ready for the first phase construction period beginning in October 2008.. Consultant Selection A Request for Proposals was issued for design services for the development of a beach restroom facilities and a feasibility study on expanded beach lifeguard facilities. The feasibility study was removed from the scope of work due to lack of funding to fully implement lifeguard facility improvements. The Request for Proposals was sent to 25 firms and was advertised on the Civil Engineering and Architecture Division's website. Five proposals were received. A selection committee comprised of representatives from Environmental and Public Works Management- Architectural Services, Community and Cultural Services, and Community Maintenance reviewed the five proposals. Selection criteria included direct experience on similar projects, staffing efficiency, cost of services, technical competence, understanding of the project's scope, approach to the work, qualification of proposed staff, and the ability to meet required time frames. Interviews were conducted followed by a site visit to the built work of the recommended consultant. 4 Roesling Nakamura Terada Architects has extensive experience in the development of public restrooms. Relevant project experience includes: development of restrooms, lifeguard station, and the community building at Bolsa Chica State Beach Park for the State of California; La Jolla Shore Lifeguard Facility for the City of San Diego; Palm Canyon Comfort Stations for the State of California; and the Los Caballos Campground Comfort Station for the State of California. Roesling Nakamura Terada Architects' proposal was competitive with other proposers. References were contacted and all respondents reported the firm's work was completed in a timely and professional manner while maintaining consistent high quality. In addition, the proposed project personnel are experienced in projects of similar scope. Public Outreach The public outreach and project review schedule has been developed in consideration of two significant factors: (1) the need to be in compliance with the consent decree in 2010, and (2) the need to minimize the impact on the beach-going public during the peak season of May through September: In light of these factors, staff recommends the following process for public and Council review of the design direction for the project. Following finalization of negotiations and execution of the contract, the design team will dedicate approximately one month developing several conceptual approaches to the project based on successful prototypes for public restrooms that have been constructed at various park sites in recent years (i.e., Douglas, Palisades and Virginia Avenue Parks) as well as consideration of any site-specific requirements. A public open house will provide an opportunity for community members to comment on initial concepts, 5 followed by review and formulation of comments by the Recreation and Parks Commission. After this input, the design team will refine the design approach for City Council review as Client. Discretionary reviews by the Architectural Review Board and Coastal Commission will follow the schematic design review by the City Council as Client..
