Th~s staff report recomxnends appraval of the attached Santa Manica Redevelopment Agency's Annual Report for Fiscal Year 1994-91, which includes an indepandent financial audit, pursuant to Health and Safety Cade Section 33080. ANNUAL REPORT CONTENTS As required by Iaw, the Agency's Annual R~paxt includes: 1) A specif~c description of the agency's activities affecting housing and displacement; 2) An independently prapared financa.al audit report conduct~d in accardance with generally ~ecepted auditing standards; 3) A fiscal statement that provides information on the outstanding ind~~tedness of and the amaunt of tax increment revenue generated by the agency and by each pra~ect; 4) Any other infarmation which the ag~ncy believes useful to explain its pragrams and aetzvities. ~ ~ ~ ''f• • - l~~ - 1 - For the audit portion of the Annual Report, the Agency contracted with the accounting firm of KPMG Peat Marwick for an ind~p~nd~nt financial audit of the fiscal year commencing on July 1, 1990 and ending on June 30, 1991. The audit was per~ormed to comply ~dith standards set out in Sectian 33080.1 of the Health and Safety Code. KPMG Peat Marwick found that the Agency's records fairly present the fYnancial pasition of the various funds and account groups of the Redevelapment Agency as of June 30, 1991, and found no negativ2 audit findings. The Annual Report also: 1) Reviews the ob~ectives and activit~es of the Redevelopm~nt Agency in FY 1990-9~, 2) Previews the Agency's object~v~s and work plan for FY 1991-92, 3) Provides recommendations ~or needed legislatian to ea~ry on a program of housing and commun~ty development, and 4) Makes certain findings as to the Agency's appropriatidn af funds for lot~t and moderate incame housing projects. AGENCY TAX INCREMENT REVENUE FOR HOUSING Far each redevelopment praject, The Redevelopment Agency is required to set aside at least 20P of the tax increr~ent it receives each year for low and moderate income h~using projects and activities. A redeve~opment agency may defer the housing obligation of a redevelopment pro7ect that ~:as started pr~or ta 1977 if existing programs and obligations prevent the agency from setting aside the full 20% of the tax increment revenue. _ 2 -- In FY 1990-91, Agency funds were aliocated fo~ loti and moderate housing as follows: ~cean Park Project la (19%) and Ocean Fark Project 1b (59.2~) and Down~own Praject (21.0~). Whzle only 19% of the tax increment was available to set aside from the Ocaan Park Pro~ect 1a for low and moderate income housing, ~he other two aZlocations exceeded the 20% minimum. The additional percent needed for Ocean Park la ($15,fl30) ~ai11 be added to the Project~s Statement of Indebtedness and will be paid in future fiscal years for housing wh~n sufficient revenue is avai~able. DESCRIPTION OF REDEVELOPMENT PROJECTS The Santa Monica Redevelopment Agency ~,ras establ~shed on August 13, 1957, and has three redevelapment project areas: 1) Ocean Park Redevelopment Pro~ect (1a} 2) Ocean Park Redevelopment Project (lb) 3y Dawntawn Redevelopment Project Ocean Park Redevelopment Prajeat The Ocean Park Redevelop~nent Praject t,ras the f~rst project undertaken by the Santa Monica Redeve~opment Agency. It ttiTas designated for study as a potEntial redevelopment proj~ct in Apr~l 1958 when an application was made to the Fedaral go~rernment for survey and planning funds. tidith these funds, the Agency ~- 1 - cammenced preparation o~ formal plans far the area encompassing thirty-three acres of ~and in the sauthwest corner of the City adjacent to the Venice community of the City of Los Ange~es. In October 1959, as a result af a reduction in the ava~labili~y of Federal funds for the praject, the proposed thirty-three acre Ocean Fark project was divided into two separate projects so that at least ane pra~ect could go forward with the funds available to the Agency at the time. Ocean Park Redevelop~ent Project ~a Ocean Park Redevelopment Praject la encompasses th~ northern 25 acres of the originally proposed 33 acre pro~ect. The Redevelopment Plan for Project 1a was approved by the City Cauncil on June 30, 196D, following requisite stud~es and hearings by the Planning Commission, Redevelop~ent Agency, and the City Council. The Redevelopment P~an caas amended on Navember Z4, 1957, principally to change ~he permitted land uses in th~ project area. Ocean Park Redevelopment Pro~ect 1a is bounded by Ocean Park Boulevard on the north~ Neilson Way an the east, Qcean ~ark Project No. 1b on the south, and the State beach parking lots and beach an the w~st. Pro~ect la is zoned R4 High Density Multlple Fami~y Residentia~ which permits the highest residential d~nsity in the Ci~y. Ocean Park Redevelop~ent Project la ~ras completed in May 1987. The praject contains two 17-story high rise apartment buildings which were completed in 1967. Each tower contains 250 rental apartment units. On both sides of the apartment complex is located the Sea Calany condominium groject. Sea Colany contains 340 condominium units which were constructed in t~ao phases, Phase 1 of the de~elopment was completed in 1980 and Phase 2 was completed in May 1987. Ocean View Park is ~acated in the cent~r of Project Area la facing the beach. This public park contains six tennis courts, two paddle ball courts, one basketball court, walkways, and landscaping. The park o~fers a r~st area ~~~~th a panoramic view of the Pacific Ocean. Ocean Park Redevelopment Project lb Ocean Park Redevelopment Project lb encampasses the southern 8 acres of the originally proposed 33 acre project. The Redevelopment Plan for Project lb was approved by the City Council on January 24, 1961, following requisite studies and hearings by the Planning Commissi~n, Redevelop~ent Agency, and the City Counci~. The Redevelopment Plan was amended on January 26, 1965, and again on September 12, 1972, principally to change the permitted land uses in thE project area. Ocean Park Redevelopment Project No. 1b is bounded by Ocean Park Redevelapment Praject la on the ~arth, Neilson ~~ay on the east, the City limit on the south (adjacent ta ~he Venice community of the City ot Los Angeles), and the S~ate beach parking lots and _ 2 _ beach an the w~st. Project 1b is zoned C3 General Co~mercial which permits commercia~ and residential uses. Ocean Park Redevelopment Project No. ~b was completed in 1983. The project contains two senior citizen residentia~ apartment co~plexes and a fo~mer utility building. Neilson Villas contains 100 rental apartment units and was completed in 1977. Barnard Park Villas contains 61 units and was completed in 1983. The utility building contained te~ephone switching equipment and 4ras replaced in 1986 by a facility outside the projec~ area containing more modern switching equipment. The former utility building was adapted in 1987 to hous~ offices and art starage for the Eli Broad Fami~y Art Foundation. Downtawn Redevelopment Project The Downtown Redevelopment Project encompasses about 9.9 acres of praper~y located at the southern end af the C~ty's Third Street Promenade in the downtown core of Santa Manica. The Redevelopment Plan for the Downtown Project was approved by the City Council in January 197&. The Dawntown Redevelopment Project is bounded by Broadway on the north, 4th Street on the east, Colarado Avenue on the south, and 2nd Street on the ~aest. The project is zoned C3 General Commereial wh~ch permits commexcial uses. The Downtown Redevelopment Project was completed ~n 19SD. It consists of Santa Monica Place and adjoining parking structure~. The retail portion of th~ project contains appraximat~ly 570,000 square feet o~ floor area and ~ncludes t~~o major department store anchors and 160 specialty retail shops and food establishment5, all of which are linked by a three level enclased pedes~rian space that ext~nds diagonally across t~ro City blocks. The project also includes twa Agency-owned parking structures containing 2,02a parking spaces. Off-Site Projec~s Both the Ocean Park Redevelapm~nt Projects and the Downtown Redevelopment Project include certain off-site improvements that were found to be '~of-benefit" to each project. In addit~.on to various housing and other related projects for lo~r and mvderate income individuals and families either funded in ~ahole or in part by each project, major off-site improvements znclude: Ocean Park Projects' Off-Si~e Improvements 1) Renavation and enhancement of the b~ach parking lot and surrounding streets that consist of a landscaped central park adjacen~ ~.o the beach at the end of acean Park Boulevard, a linear park alang Barnard Way from th~ southern City limit to Bicknell Avenue, landscaping and restriping of the beach parking lot, reconstruction of the pedestrian promenade and bikepath, and constructian of new concession and restroom facilities. -- 3 - 2) Rehabilitation and expansion of the Ocean Park Branch Library. 3) Rehabilitation of 22 apartment units for very lota incame senior and family households at 175 Ocean Park Boulevard. 4) Construction of 12 units of rental apartments and 43 units of coaperative housi~g for locT and moderate ~ncome families located on several sites in the Ocean Park neighborhood of the City. Dawntown Praject Off-Site Improvements 1) Various improvements to the City's Third Street (NTall} Promenade and downtown (Bayside) distric~ adjacent to the Downtown Redeve~opment Prpject ~rere found to be "of-benefit" to the Downtown Pro~ect. Lti~hile primary funding for these improvements has been provided by other sourc~s, the Downtown Project nay provide funds that are needed for future improvements in the area. AGENCY O$JECTIVES AND ACTIVITIES FOR FISCAL Y~AR I990-91 In Fiscal Year 1990-91, the Santa ~Zonica Redevelopment Agency accomp~.ished its objectives fax' the Fiscal Y~ar and conducted the follawing actzvities: ~cean Park Prajects la and ib Ob~ecti~e: Camplete construction of the Ocean Park REdevelapment Project off-sita housing and monitor implementation of off-site hausing improve~ents. Funds from the Ocean Park Redevelopment Project Lo~r and Moderate Tncome Housing Trust Fund, combzned with the Downtotim Project Hausing Trust Fund, were used to assist in the development of the follawing project which was completed in FY 1990-91: 0 32 units af rehabilitated housing for low and moderate income hauseholds (Cloverfield project). In addition. the Ocean Park Housing Trust Fund was used to assist in the development of the following pro~ects that w~r~ in the prede~elopment stage in FY ].990-91: 0 44 new Single Room Occupancy units (SRO) for very low income households (2nd Street Center project). 0 17 new and rehabilitated units for low and moderate income households (V~rginia/Frank project). - 4 - Finally, the Ocean Park Housing Trust Fund was used to assist in the development of the following project that was in construction in FY 199U-91: 0 72 units of new housing for very law income seniors (3rd Street north of Wilshire project), The Ocean Park Housing Trust Fund also was used to subsidize 22 ~nits Qf hausing for very low income senior and family households through the lease payment made by the Agency on behalf of the 175 Ocean Park Baulevard public housing development. Dowuto~m Proj ect Ob~ective: Complete construction of public improvements on the Third Street Promenade and in the Bayside (downtown) District. Monitor the housing activities resulting fram the Downtown Project. During Fisca~ Year 1990-91, the Agency coordinated with the City additional i~provements on the Third Street Promenade and in the Bayside District of the downtown area. (Construction of initial improvements were completed in September 1989.) The Agency also coordinated with the City on the analysis of the addition af 340 parking spaces to the top of Parking Structure No. 6 in the 1400 black of 2nd 5treet and on the constructian of retail space along the graund floor street frontage of tha Parking Structure. (Constructian is anticipated ta begin in 1992.) Funds from the Downtown Redevelopment Project Low and Moderate Income Housing Trust Fund, combined with the Ocean Park Praject Housing Trust Fund, were used to assist in the development of the following project which was completed in FY 1990-91: 0 32 units of a rehabiiitated housing for low and maderate income households (Cloverfield project}. The Housinq Trust Fund was also used to assist in the development of the following projects that were in the predevelopment stage in FY 199Q-91: a 44 new Single Room OccupancX units (SRO) far very low income households (2nd Street mixed use project}. a~7 new and rehabila.tated units for low and moderate income households (Virginia/Frank project). - 5 - The Agency also appropriated its Vitale Gilp~n housing funds to assist in the housing pro~ects described above. The Vitale Gilpin Fund is a legal settlement requiring the Agency to se~ aside a portion of the tax increment revenue generated by th~ Downtown Redevelopm~nt Project to fund programs that provide housing for low and very low income persans and families. AGENGY OBJECTIVES FOR FISCAL YEAR 1991-92 The Agency has the following objective for the upcoming Fiscal Year 1991~92: Ocean ParK Redevelapment Projects Objective: MonitQr implementation of off-sit~ hQUSing impravements resulting fro~ the Ocean Park Project~. Downtown Redevelopment Project Objective: Monitor implementation of off-site housing improvements resulting from the Do~rnto~•in Project. Help coardinate additianal pub~ic improvements in the Baysid~ (Downtown) District and begin construction of the expansian and improvement of a downtown Parking Structure. AGENCY ACTIVITIES AFFECTING HOUSING AND DISPLACEM~NT The Santa Monica RedevElopment Agency contr~but~d funds to assist in financing the construction ar rehabili~ation of 165 units af very law, low and moderate income housing that ~~ere in various stages of development in FY 1990-91: 133 units predevelopment or development phase 32 units completed 165 units TOTAL In additian, the Agency contributed funds to lease the property at 175 Ocean Park Boulevard on which 22 units of housing far very low income households are located. Specific Housing Ac~ivities Government Code Section 33080.4 requires that the Annual Report include the fallowing informatian concerning displacement af res~dents, demolition af units, and provision af housing resulting fram activities of redevelopment projects during the fiscal year. Information concerning the provision o~ housing is to include any agency-assisted housing regardless of the agency's - 6 - funding source and is to include only that housing available for occupancy in the f iscal year. No re~ocation, demolition, or displacement activity occurred within any of the project areas in FY 1990-9Z and na such activity will occur in FY 1991-92. The Agency also did not conduct relocation, demolition, or displacement activiti~s outside of tha project areas in FY ~990-91 and no such activity will occuY in FY 1991-92. As the chart indicates below, there were 54 un~ts of Agency assisted-housing acquired, rehabilitated, or subsidized for occupancy to low and moderate income households in FY 1990-91. Thirty-two af these units were acquired and rehabilitated and 22 units were subsidi2ed for occupancy by househo~ds t•rith 1ow and moderate incomes. Status and Use of th~ Low and Moderate Income Housing Fund Of the 54 units that were can~tructed, acquired, rehabilitated, or subsidzzed in FY 1990-91, 40 units v~ere occupied by very lotiv income households and 4 units were occupied by lo~•r income hauseholds, and la units were occupied by rioderate income households. The total 187 units of housing the Agency's Law and Moderate Income Hausing Trust Fund assisted to pred~velop, canstruct, acquire, rehabilitate, or subsidize in FY 199fl-91 ~r~re occupied or planned for occupancy by the following types of househalds: 173 un~ts very iaw income hauseholds 4 units low income households 10 units moderate incame households 187 units TOTAL RECOMMENDATIONS CQNCERNING NEEDED LEGISLATION Pursuant ta Health and Safety Cade Sectian 33080, this repart should transmit any recommendations concerning needed legislatzon for redevelopment agencies. At this time, there are no bills before the State Legislature which could havc an impact on the Agency's ability to carry on a program of redevelopment given the status of both project areas. Therefare, na recommendations regarding needed legislation are provided. The Agency will cantinue ta monitor legisZative information on items concern~ng redevel~pment. FINDINGS RELATED TO AGENCY'S HOUSING TRUST FUND As required in Section 33334.6 af the Health and Safety Code, the Santa Monica Redeve~opment Agency must make a findir~g in each fiscal year in which the Agency was unable to appropriate a minimum of 200 of the tax increment revenue it rece3ved that year to provide housing for low and moderate income hauseholds. State law permits the Santa Manica Redevelopment Agency ~o appropriate less than the full 20~ of tax increment revenue because each project was established prior to January 1, 1977, and because the Aqency adapted a Statement of Existing Obligations and a Statement of Existzng Programs prior to September 1, 1986. Ocean Park Redevelopment Proj~ct 1a In Fisca~ Year 1990-91, the Ocean Pa~k Redevelopment Project 1a received $1,554,557 in tax increment revenue. The total amaunt required to be apprapriated for law and moderate incame houszng - 8 - projects for ~cean Park Projec~ 1a was at least $310,911 ~ahich is 20$ of the tax increment revenue received in FY 1990-91. In FY 1990-91, th2 full amount of tax incr~ment revenue required far housing was not appropriated for hausing projects. In FY 1990-91, $295,881 or 19~ of tax increment revenue required for housing was appropriated for housing project5. Oceaa Park Redeve~opment Project ib In Fiscal Year 1990-91, the Ocean Park Redevelopment Project lb received and accounted as receivable $184,811 in tax increment revenue. The total amount required to be appropriat~d for low and moderate income housing pXOjects for ~cean Park Project 1b was $36,962 which is 20~ of the tax increment revenue rece~ved in FY 1990-91. ~n Fisca~ Year 1990-91, morE than the full amount of tax incxement revenue required for housing was appropriated for housing prajects. Tn FY 199Q-91, $149,385 or 59% of the tax increment revenue received was appropriate for ~~w and moderate income housing projects. Do~ntown Redevelopmen~ Project In Fiscal Year 1990-9I, the Downtown Redevelop~ent Praject received ar accounted as receivable $1,026,575 in tax increment revenue. The tatal amount requir~d to be appropriated for law and moderate inco~e hausinq pro~ects for po~antown Project was $205,315 which is 20~ of the tax increment revenue received in FY 1990-91. In FY 1990-91, $215,343 or 210 of the tax increment revenue received was appropriated for low and moderate income housing projects.
