B-B MAY - 9 1989 CA:RMM:jld155/hpc City Council Meeting 5-9-89 Santa Monica, California STAFF REPORT TO: Mayor and city Council FROM: City Attorney SUBJECT: Ordinance Adding section 3347c to the Santa Monica Municipal Code and Amending Municipal Code Section 3612 to Permit Vehicular Traffic on the Third Street Promenade Traveling at a Rate of 15 Miles Per Hour or Less The city is required by Vehicle Code Section 22358.3 to s~t by ordinance a lower speed limit in the event that a street is designed for a safe speed limit of less than twenty-five miles per hour. The Third street Promenade will be 20 feet in width and will have curb radii designed for a 15 mile per hour speed limit. Accordingly, the accompanying ordinance establishes a fifteen mile per hour speed limit on the Third street Promenade. In addition, in order to permit vehicular traffic on the Third street Promenade, Municipal Code Section 3612 must be amended. Currently, this section prohibits all vehicular traffic on the Third street Promenade. As amended, the proposed Section permits vehicular traffic on the Mall, subj ect to such restrictions as the Parking and Traffic Engineer may establish, but retains the prohibition against vehicles with a gross loaded weight in excess of 10,000 pounds. Section 3347C is added to the Santa Monica Municipal Code to read as follows: SECTION 3347C. Speed Restricted on Third street Promenade. No person shall drive or operate any vehicle over or upon the Third Street Promenade at a greater rate of speed than fifteen (15) miles per hour. SECTION 2. Santa Monica Municipal Code Section 3612 is amended to read as follows: SECTION 3612. Vehicles Permitted on Third street Promenade. subj ect to such restrictions as may be established by the parking and Traffic Engineer, vehicles wi th a gross loaded weight of less than - 1 - . . 10,000 pounds may be permitted on the Third street Promenade. SECTION 3. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordinance. SECTION 4. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. - 2 - . . SECTION 5. The Mayor shall sign and the city Clerk shall attest to the passage of this Ordinance. The city Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective after 30 days from its adoption.
