INTRODUCTION The purpose of thls report lS to recommend that an Eroergency Or- dinance be prepared to amend the tlme Ilmltatlons as set forth ln Seetlon 9612.1 (SMMC) for exercise of a Certlflcate of Approprl- ateness. ThlS recommendatlon lS as a result of recent actlvlty with the Rapp Saloon property. BACKGROUND On June 15, 1985, ln accordance Wl th the provlslons of Sectlon 9611DI. a (SHl>-1C) a Certlflcate of Approprlateness was lssued by operatlon of law for the removal or demoll tlon of the Rapp Saloon, a deslgnated Clty Landmark located at 1438 Second Street. The lssuance of thlS Certlf1cate of Approprlateness 1S subJect to the followlng condltlon: The rlghts granted hereln shall be effectlve only when com- menced wlthln a period of 180 days from the effective date of approval (June 15) and shall explre and become null and void lf such work lS suspended or abandoned for a 180 day tlme perlod after being commenced in conformance with Section 9612. ThlS condltlon lmposes a slgnlfi- cant tlme constralnt upon the landmark parcel, in that lt often requlres more than SlK months to obtaln necessary Clty approvals for a replacement proJect. ThlS lS particularly true in thlS case, Slnce ln order to demollsh the Rapp Saloon, a replacement proJect would have to approved by the Plannlng Corrmusslon, Ar- chltectural ReVlew Board and the Coastal CommlSSlon. In addltlon to the prOCeS&lng constralnts lmposed by thlS tlme Ilmitatlon, the current owners of the Rapp Saloon have entered lnto an agreement to sell the property and escrow has opened. ThlS purchase agreement lncludes the prOVl.S10n that the Rapp Saloon be retained on s1te. Escrow lS not expected to close un- tll after January, 1986. In that the Landmarks Commission, the Santa Monlca Hlstorlcal Soclety and nembers of the community have expressed their concern for the bUllding's future and desire to malntaln the bUl.ldlng on l.ts orlglnal slte, lt would seem appro- prlate to prepare an Emergency Ord1nance to amend the Certlfl.cate of Approprlateness tlme llffiltatlon of 180 days In order to ex- haust all efforts of preservlng the bUl.ldlng on ltS orlglnal site. The current owners of the property as well as the poten- tlal buyers are 1n support of thlS ordlnance. - 2 - \ ", 41ft BUDGET/FINANCIAL IMPACT The recommendatlon contalned In thl S report does not have a budget/flnanclal lmpact on the Clty. RECOMMENDATION It lS recommended that Counell dlrect the Clty Attorney to pre- pare an Emergency Qrdlnance grantlng the Cl ty Councll, after recelvlng the recommendatlon of the Landmarks Commlsslon the au- thorlty to adopt a resolution extendlng the tlme perlod for exer- clslng a Certiflcate of Approprlateness for an addi tlonal tlme perlod not to exceed 180 days on such terms and condltlons as the Clty Cauncll deems dppraprlate.
