ThlS report transffilts lnformatlon about the publlC
hearlng on "Annexatlon No.7".
Background
On November 24, 1978, Councll adopted a resolutlon
lnltlatlng proceedlngs for thlS boundary reorganlzatlon.
The resolutlon followed the approval of the proposal by the
Los Angeles County Local Agency ForMatlon Commlsslon (LAFCO)
and the deslgnatlon of the Clty of Santa Monlca as the
conductlng authorlty of the reorganlzatlon proceedlng.
The Staff Report of November 20, 1978, at pages 3
and 4, sets out the steps that the Clty of Santa Monlca,
as the conductlng authorlty, should follow In cOMpletlng
the reorganlzatlon. As lS lndlcated thereln, the crltlcal
step lS the holdlng of the publlc hearlng to recelve any
oral or wrltten protests, obJections or eVldence WhlCh
may be made concernlng the proposed annexation. So far,
no WYltten protests have been recelved.
It 1S lMportant
that the councl1 close the hearlng lmmedlately after recelvlng
the wrltten protests, and that the hearlng be concluded
before January 1, 1979.
At the concluslon of the hearlng the Councll lS to
deterrnlne the value of wrltten protests filed and not
wlthdrawn. Not less than 30 days after the concluslon

A) Termlnatlng the proceedlngs lf the value of wrltten
protests exceeds flfty percent or more of the reglstered
voters wlthln the affected terrltYi
B) Orderlng the territory reorganlzed subJect to conflrnatlon
by the voters on the questlon and call1ng a speclal election
lf the value of wrltten protests is between twenty-flve
percent and flfty percent of the reglstered voters or
property owners;
C) Ordering the terrltory reorganlzed wlthout an
electlon if less than twenty-flve percent of the reglstered
voters wlthln the terrltory and less than twenty-flve
percent of the land owners wlthln the terrltory have filed
a wrltten protest.
The Councll should, lf it deslres, authorlze a concurrent change
In School dlstrlct boundaries to be made pendlng clarlflcatlon
of an apparent lnconslstency in the relevant Government and
Educatlon Codes. Staff lS attemptlng to obtaln the consent
of the Santa Monlca and Los Angeles School Boards. If lt 18
not posslble to achleve a slmultaneous school dlstrlct re-
organlzatlon, lt wlll be necessary to follow a lengthy pro-
cedure pursuant to the Educatlon Code.

A) Electrlclty. Those resldents WhlCh are served by
Los Angeles Department of Water and Power w~ll contlnue to
be served by Los Angeles. At some later tlme the Southern
Cal~fornia Edlson wl11 purchase the facl11tles from Los
Angeles D.W.P. and resldents w~ll be served by the Ed~son Co.
B) Water. For the present tlme, the resldents who are
now served by Los Angeles will contlnue to be served by Los
Angeles D.W.P. The rate wlll be 50 percent hlgher than they
are currently paying, l.e., Los Angeles charges out-Of-Clty
resldents 1.5 tlmes the regular water rate. If these resldents
deslre to be served by Santa Monlca, new 11nes wll1 have to
be lnsta!~ed and the residents wl11 necessarlly be assessed
for this constructlon.
C) Sewers SerVlce. The sewage from thlS area currently
flows lnto Santa Monlca sewers and u1tlmatelY'lnto the
Hyperlon Statlon, and wlll contlnue to do so. These residents
wlll now be charged a sewer serVlce fee.
This ltem should be placed on the agenda for the February
13, 1979 Councl1 meetlng for adoption of the resolution
regardlng reorganlzatlon, and for conslderation of fees,
assessments, taxes, school boundarles and other related matters.
Alternatlve Solutlons
The hearlng lS requlred by the LAFCO resolutlon and by
the Government Code. Alternatlves are not appllcable.

elght (28) acres of lnhablted terrltory, lYlng along the
rlm of Santa Monlca Canyon, westerly of San Vlcente Blvd.

~OW, THEREFORE, the Clty Councll as the conductlng
authorlty, hereby orders the terrltory descrlbed In Annexatlon
No. 7 annexed to the Clty of Santa Monlca and detached from
the Clty of Los Angeles wlthout an electlon, pursuant to Sectlon
35307 of the Governnent Code; and dlrects the Clty Clerk to
certlfy to the adoptlon of thls resolutlon and to transmlt a
certlfled copy thereof, together wlth any fees under Sectlon
54902.5 of the Government Code, to the Executlve Offlcer of

DETERMINATIONS AND APPROVING THE PROPOSED
MUNICIPAL REORGANIZATION OF TERRITORY,
DESIGNATED AS "ANNEXATION ID. 7' TO THE CITY
OF SANTA MONICA (DETACHMENT FROM THE CITY
OF LOS ANGELES)
WHEREAS a petition for the proposed municipal reorganization involving
annexation to the Ciry of Santa Monica and detachment from the City of Los Angeles
of cenain tenitory was heretofore filed by chief petitioners with the Executive
Officer of this Local Agency FOnuation Commission pursuant to the Municipal
Reorganization Act of 1977 (part 2, TItle 4. Division 4, commencing with Section
35000 of the Government Code), and said Executive Officer has examined said
petiuon and executed a certificate determining and certifying that said petition is
sufficient; and
\VHEREAS, at the tim{ and in the fOlT(l and manner provided by law, said
Execuove Officer set November 22, 1978 as the heanng date on thiR proposal and

an adverse effect upon the environment and approves a Negative Declaration.
Section 2. Subject to the terms and conditions hereinafter specified.
