SR-410-007 ITEM 1-C Santa Monica, California Council Meeting: February 27, 2001 To: Mayor and City Council From: City Staff Subject: Recommendation to Authorize the City Manager to Negotiate and Execute an Amendment to Contract #7744 with EIP Associates Resulting in a New Total of $122,110.45 Including a 15% Contingency ($15,927.45) for Additional Environmental Analysis for the Preparation of an Environmental Impact Report for the Development of Two-Mixed Use Buildings at 2012-24 Main Street and 2021-29 Main Street. INTRODUCTION This staff report recommends that the City Council authorize the City Manager to negotiate and execute an amendment to Contract #7744 with EIP Associates resulting in a new total of $122,110.45 ($106,183 plus a 15% contingency of $15,927.45) to conduct new analysis necessary to prepare an Environmental Impact Report (EIR) for the proposed construction of two mixed-use buildings, one to be located at 2012-24 Main Street and the other to be located at 2021-29 Main Street. BACKGROUND Pursuant to the City’s professional services selection procedures, EIP Associates submitted the successful proposal to prepare an environmental impact report (EIR) for two proposed mixed-use projects. During the course of the preparation of the EIR it was determined that additional environmental analysis would be required. This 1 additional analysis was not accounted for in the original scope of work and is necessary to process the development application and to finalize the EIR. The original contract was approved by the City Council on July 11, 2000 for an amount not to exceed $97,750 including a 15% contingency. The additional cost for historical and geo-technical analysis conducted by sub-consultants in those areas of expertise results in a total amount that exceeds the original contract amount including the 15% contingency. For this reason, the contract amendment requires the approval of the City Council. BUDGET/FINANCIAL IMPACT Since the California Environmental Quality Act (CEQA) work is being performed for the benefit of the private development applicant, the project applicant will deposit funds to cover the estimated $106,183 cost with the City. Funds from the applicant will be deposited into Account Number 80.201172. Additional contingency funds (up to a maximum of 15% or $15,927.45 of the amended contract amount) will be deposited by the project applicant to this same account if it is determined by the Director of Planning & Community Development to be necessary. Expenditures to cover the cost of this additional analysis will be charged to this account without any financial impact to the City. 2 RECOMMENDATION It is recommended that the City Council authorize the City Manager to negotiate and execute an amendment to Contract #7744 with EIP Associates for a new total of $122,110.45, including a 15% contingency ($15,927.45), to prepare an Environmental Impact Report for the proposed construction of two mixed-use buildings, one to be located at 2012-24 Main Street and the other to be located at 2021-29 Main Street.
