SR-410-005 (3) " e 'II(}-(JO~ e G,T APR 8 ~980 Santa Monica, California March 27, 1980 TO: FROM: SUBJECT: Mayor and City Councl1 City Staff Construction of Floating Dock (Float), Santa Monica Pier -- Basic Deslgn Approval and Appropriation of Funds Introductlon This report provides design information and a cost estlmate for construction of a float at the sailboat rental facillty at the pier and recommends that the City Council appropriate $20,000 from Pier funds to build and install the float lncluding necessary mooring. Background In May, 1979, the Council majority voted to relieve the lessee of the responsi- bility of constructing a float at the Pier Sailboat Rental Facillty. This float was to have been Jointly used by the lessee and the public. At that time the Council voted to have the City construct such a float and the Staff prepared a design and intended to construct the float, approximately 12 feet by 24 feet in size. Mr. Koch did not approve this size float, nor did he approve of the method of mooring. He insisted that the float be much larger in size, with fingers to accommodate a much larger number of boats. The Staff consulted a contractor regarding the design which Mr. Koch proposed, and the contractor stated that, ln his opinlon, a float with fingers could not safely be constructed and operated in the harbor because of the wave action. Staff now proposes a 10 foot by 32 foot float, to be built and installed by City forces at the Sallboat Rental Lease location as shown on the attached ~T APR 8 1980 e e To: Mayor and City Council -2- March 27, 1980 Exhibit "All (Dock "B"). ThlS float, which is sllghtly larger than originally proposed by Staff, would be for joint use of the public and the lessee, and will handle l6-feet-long boats. The proposed float will utilize the existing gangway and be moored adjacent to the Pier lower deck bumper piles. The City would retain ownership of the float. Estimated cost is $20,000 which includes the timber/styrofoam float; mooring lines, anchors, and counterweights; replacement of bumper piles as necessary including steel lIrub rails"; and repairs to the existing gangway. Even though the use of the float lS to be jOlntly shared by the Public and the lessee, the lessee is requlred to assume liability for his operations in conjunction with the float including the furnishing of insurance in accordance with the present lease (Contract No. 3000 (CCS)). Also, repairs and mainten- ance to the portion of the float used by the lessee shall be at the expense of the lessee as covered in the eXlstlng lease. Under this proposal, during heavy storms the City Harbor Patrol would determine the timing of removal of the float from use and perform its safe mooring from north of the Pier structure in order to have the float "nde out" heavy wave actlon. Only upon release of the float for the Public's and the Lessee1s use by the Harbor Patrol, would it be returned to lts Pier location. e e To: Mayor and City Council -3- March 27 t 1980 Alternatives 1. Allow the lessee to continue using his 81 x 24l floating dock (Exhibit "A", Dock llAIl). This float was damaged during the recent storms and was not designed in accordance with the minlmum engineering specifications furnished by the City Engineer to the less, and 1S therefore considered unsafe and undersized. ln the oplnion of staff. The lessee has lndlcated that publ1C use of hlS float would be allowed if the City Harbor Department raised and lowered the gangplank and assisted in other operations. 2. City construct Dock "CIl, the proposed design submitted by the lessee. This float, including proper mooringt would cost more than $40tOOO to build and could not be safely operated in the relatively unprotected harbor in the opinion of Staff. 3. Revert to the original lease provisions wlth the lesseet which require that he deslgn and build a float for the combined use of the public and the lessee in conformance with the City Engineer's speclfications. An extension of the lease deadline for construction of the float would be required under this alternative. The staff does not believe that any float deslgn (Float B or Float C) will result in satisfactory opportunlty for public use as long as the Joint use wlth the lessee is retained. The nature of joint publlc-prtvate use is such that there are, ln the opinion of the stafft built-ln problem areas. This is e e To. Mayor and City Council -4- March 27 s 1980 especially true in the present case because the desired public use is for fishing, while the pr1vate use is for sailing. The Staff believes that there should be two separate floats, one public and one private. If this concept were approved by Councils a portion of the area could be a public area and a portion could be private. The lessee could construct a float to meet his needs and the City could construct a float for public use. Recommendation Staff recommends that the Clty Council approve the Float B design and appropriate $20,000 from the P,er Surplus Fund, and assigned to Account Number 30-400-622- 000-324, for the City to construct the new lO-foot-wide by 32-foot-long float including mooring. This recommendat1on 1S in conformance with recent Council directives to Staff. It is recommended that the lessee be required to fulfill all other port1ons of the leases including that the lessee provide llability insurance.
