I [~TRODt7CT I ON This report sets operationaZ standards for the granting of out- door dining J.zcense agree~~ents on the Third 5treet Mall and recommends that City Council authorize the Director of Co~ri~t-unity and ~cor~omic Developnient to ad:~i~nister these standards anu the City Manager to negotiate and execu~e t~e Zi cense agree~~ents. Both the operatzonal. standards anc~ the ?icense agreerr~ent are at- tachec~ for Cou~cil approval. BACKGROUND Outdoor din~ng lic~nse agree~~ents on the Thxrd Str~et Ma11 a~z currently brought before City Cauncfl on an individual basis. Th1s process has worked in the past d~e to the infrequency of requ~sts to provade outdoor din~ng. With the revitalizat~.on of the Thzrd Street Mall, reques~s for outdoor cafes are anticipated to ~ncrease. Ther2fore, in ord~r to standardize the approvai process, staff has prepared operational standards for Council appraval which would enab~e staf~ ~o adm~nister and expc~te the agreements. These standards were d~veloped with input fro~ri the ~ MIIY 14~ - ~ - General Serv~ces ~epart~ient, Fare Depart~ient, and the staff of the Third Street Deveiopntent Carparation. ~ISCUS5I0~ The outdoor dining sta~dards presented in Attachnaent 1 describe Eizgibl~ uses, sites and layouts, design and operational stan- da~ds and the applicatian procedu~e. Ifis purpase is ~o standa~d- iz~ the approval process and ensure the approprzat~ness and at- tractiveness of outdaor d~ning on ~he Ma~l in conformance with th~ recently adopte~ Ma11 Design Guidelanes. Outdoor dining is an encouraged use for th~ revitalization of the Mali. The stan- dards are sub~ect to r~v~sion upon adaption o~ the Mall Specific Plan. They are presented ~n adeance of the Plan's adoptlon to enable staff to r~sponc~ to se~Teral currer~t merchant requests for outdoor dining faezl~ties. Also, because the Plan may take s~veral years to ~ully implement, this action w~ll create a basis for incremen~al in~provements on the Ma11 during this period, Upon adoption of these standards by Cauncil, the Con~munity and Econom~c Develop~t~~nt D~par~ment will refer thert~ to ~he Architec- tural Review Board and Planning Co~t~mission foz clesign review. Dnce the design component is a~apro~ed by those bodies, the I7e- partment of Con~~unity & Economic Developmen~. will begin ad~«nis- tez~ng the prograrn and will request com~tients on ind~.vidua~ proposals_ _ from the Third Street Deve~opn~~nt Cozparation kn an advisory rale. Upon approval of these parties, a~icens~ agree~cent wi11 be pxepared, approved by the City Attorney, and Qxecuted by the C~ty Manager. The lieense agreeRient currently in use will ren~ain the contractual instrument {Attachment 2). The agreemen~ requires ~iab~lity insurance ~n the amoun~ a~ $1,~~~J,0~1~; sets a n~onthly license fee of $1.p~0~ to $1.25 per squar~ foot; es- tablishes a contract terr~i of two years wzth an optxon to renew up to an additional three years upon satisfactory performance; and provides additional contractual requ~remen~s.
