INTRODUCTION
ThIS staff report recommends that the HOUSIng AuthorIty authorIze
reClSSlon of a 1981 agreement between the HOUSIng AuthorIty, the
Coastal Commlss Ion and One PlCO Ente rpr Ises, Inc.
ReclsSlon IS
beIng recommended SInce permIts for the subject development
proJect have expIred and are no longer valId. The CIty Attorney
concurs wIth thIS recommendatIon.
BACKGROUND
On July 14, 1981 the CIty CounCIl approved a FInal Tract Map for
a 20-unI t, 3-story condomInIum proJect to be developed by One
PICO EnterprIses at One PICO Boulevard, along wIth twelve
apartment unIts at l815 AppIan Way (see attached SIte plan).
In November, 1980 the CalIfornIa Coastal CommIssIon approved
PermIt A-l41-80 to construct the proJect WIth the conditIon that
twelve affordable apartments be constructed on the 1815 Appian
Way parcels.
A deed restrlctlon to this effect was recorded
agaInst the property In Apr11 1981 (copy attached).
The deed
restrIctIon prOVIdes that the Clty.S HOUSIng AuthorIty would
admInIster
an affordable hOUSIng program by WhICh twelve
apartments would be bUll t on the 1815 AppIan Way parcels and

rented to persons earnIng no more than 80% of the County median
Income. Four unIts were to be one-bedroom, 4 two-bedroom and 4
three-bedroom. The affordable unIts were to be constructed prIor
to the condomInIums.
Al though the Coastal PermIt was extended In 1982, no buildIng
pe rml t was ever Issued by the CIty. The Coastal PermI t has now
lapsed. Our lng the tIme SInce City approvals were granted, the
proJect developers flIed for bankruptcy and the propertIes were
taken over by ImperIal Bank. Several legal challenges seekIng to
enjoIn the bank's abIlIty to sell the property have been
unsuccessful, and the bank has closed escrow on a sale to another
party. The new property owners deSIre to remove the affordable
hOUSIng deed restrIctIons from the property tItle.
ANALYSIS
Staff belIeves the request to be reasonable, SInce perml. ts for
the One PICO housing proJect have expIred and are no longer
valId. Any new development proJect at the SIte would be subJect
to CIty and Coastal CommISSIon revIew and ImpOSItIon of
appropr late reqUIrements and restr IctIons, l.ncludlng applIcable
CIty Incluslonary hOUSIng requl.rements and prOVISl.OnS of the Land
Use Element of the General Plan. The CIty Attorney has reVIewed
the relevant documents and concurs wIth the staff recommendatIon.
