of age. Thls publlc hearlng \..as -set by the Council at lts
January 8, 1980, meetl.ng.
BACKGROUND
On October 9, 1979, the Clty Councll adopted Ordinance
#1139 WhlCh prohlbits dlscrlffilnatlon In rental houslng on the
baslS of age. At the tlme the ordlnance was prepared, It
was the Vlew of staff that 51nce the ordlnance was ln the nature
of a civll Rights Law and dld not affect the occupancy or
density standard of rental houslng, it had no effect on the
envlronment. Thus, no envlronmental lmpact documents were
prepared.
The constltutlonal valldlty of this ordlnance was
challenged In a lawsuit called Mlller v. C~ty of Santa Monl.ca,
L.A.S.C. NUMber C393789. On January 24, 1980, Junge
Jerry Pacht denied the motlon for prellmlnary In]Unctlon and,
therefore, upheld the ordlnance pendlng further proceedl.ngs.
In so ruling. Judge Pacht lndlcated that no Envlronmental
Impact Report was required.

FtNIRON~mNTAL IMPACT OF ORDINANCE
1WMBER 1139, RELATING TO DISCRI-
MINATION IN HOUSING OF THE BASIS
OF AGE, &,~ PROVIDING FOR PUBLICATION
THEREOF.
WHEREAS, the City Attorneyls Offlce has applied
for a Negative Declaration of Enviro~ental Impact relating
to Ordlnance #1139(CCS), commonly known as The Falr
Houslng for Chlldren Ordinance, and
WHERK~S, the Envlronmental Impact Revlew Commlttee has
determlned, in accordance wlth the procedures established
by Resolutlon *4351(CCS), that the proposed activity will
not have a substantial adverse effect upon the envlronment,
and
WHEREAS, It ~s approprlate that a public hearing be
held to recelve comments prlor to the final adoption of this
Negatlve Declaration:
THE C1TY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY RESOLVE:
SECTION 1. A publlC hearlng on the Negative Declaratlon
regarding Ordinance #1139 shall be held before the Clty
CaunCll at the February 26, 1980, Cauncll meeting.
SECTION 2. The Clty Clerk shall cause notlce of this
public hearing to be publlshed ln the Evening Outlook
accordlng law.

SECTION 3. The Clty Clerk shall certify to the
adoption of thls resolution, and thenceforth and thereafter
the same shall be In full force and effect.
