Landmarks and H~stor~c D~str~ct Ordinance.
Introduct~on
The Landmarks COIT~ission has requested that a representatIve
of the city be duly authorlzed to apply to the State and Federal
governments for cert~flcation of Santa Monica's Landmarks and
HlstorlC Dlstrlct Ordlnance. Such certlficatlon is the flrst
step In enabllng the owners and long-term lessees of certain
property in Santa !ionlca to take advantage of dJ..stJ..nct J..ncome
tax benefJ..ts. ThJ..s could help to promote hlstorlc preservatJ..on
J..n the city.
Background
The Tax Reform Act of 1976 provJ..des tax incentlves to
owners and lessees for their rehabllltatlon of speclflc hlstorlC
structures and lncludes tax penaltles for those who dem~llsh
and replace hlstorlC structures (see Appendlx A) .
However, before the provlSlons of the Tax Reform Act can
be used or lmposed the Clty'S Landmarks and HJ..storic D~str~ct
Ordinance can be certlfled by the State Historic Preservation
officer and the Natlonal Register Dlvlslon of the Department
of the InterJ..or. The appllcation can only be made by a repre-
sentatlve of Santa Monlca WhlCh has been authorlzed by the
Clty Council. The Landmarks Commisslon lS requestlng that a

representative be authorized to apply for cert~f~cation of
Santa Monica's Landmarks and HistoriC District Ordinance.
Alternatives
There appears to be three alternatives available to the
C~ty Counc~l. These include:
1) authorizing Valdis V. Pav1ovsklS, Princlpa1 Planner and
acting Landmarks Commission Secretary, to request State and
Federal certification of Santa Monica's Landmarks and Historic
District Ordinance,
2) authorizing some other person to apply for certification, or
3) not seek certification of the ordinance and district.
Recommendations
Because the provisions of the Tax Reform Act of 1976 may
provide distinct benefits to the owners or long-term lessees
of certain structures in the potential historic districts in
the City and thus help to promote the preservation of historiC
bUildings and districts in the City, the Landmarks CommiSSion
respectfully recommends that Valdis v. pavlovskiS be duly auth-
orized to apply to the State and Federal gevernments for certif-
ication of Santa Monica's Landmarks and HistoriC District Ordin-
ance.
