SUBJECT: Recommended Changes to Landmarks 0rd1nance.
Introduct1on
Th1S re90rt transm1ts a recommendat1on by the Landmarks Com-
mlSSlon that certa1n chanqes in the t1~e Ilmlts set forth ln
the Landmarks Ordlnance be made.
Background
On October 11th the Clty Councll requested the Landmarks Com-
m1sslon to reVlew the regulat10n perMitting recons~derat1on of
a proposed land~ark after only one year followlng denlal w~th a
Vlew toward 1ncreas1ng the time per10d to f1ve years. On
~ovember 1st the Landmarks COMM1SS1on reviewed the Ord1nance
and approved a recommendat~on that the time 11mlt be 1ncreased
fro~ one year to three years wlth the except10n that the owner
of the property 1nvolved would not be restrlcted to the three
year term. This would permlt a new owner or one who may have
had prev10us Ob]ect1on to have an appl1cat1on recons1dered at any
tune.
The Comm1SS1on also has found that the present thlrty day limlta-
t10n for the staff to submlt a prel1minary reco~endatlon and the
sett1ng of a publ1C hearlng after the re~ort 1S rece1ved does not
prov1de suff1Clent t1me for the CommlSSlon to act In the event

they only Meet once a month. The Commission recommends that
the time period be l.ncreased from 30 to 45 days In both l.n-
stances whl.ch Wl.ll provide ample time in the event only one
meeting a month 1S held.

The Cl.ty Councl.l has the a1ternatl.ve of actl.ng favorably upon
the recommendations of the Landmarks COmM1SSl.On by instructl.ng
the Cl.ty Attorney to pre~are the necessary amenQments or may
mod1fy the recommendations of the COmm1SSl.On by requesting an
ordl.nance w1th a d1fferent t1me ll.mitat1on.

It 1S respectfully recommended that the Landmarks Comml.ssl.on's
suggestl.on be accepted and the Clty Attorney d1rected to prepare
an ordl.nance lncorporat1ng these aMendments and return it for
Councll consl.deratl.on l.n the usual course of procedure.

FINDINGS AND RECOMHENDATIONS OF THE SANTA
MONICA LANDf1ARKS COHMISSION ON A PROPOSED
CHANGE IN THE LAND~ffiRKS AND HISTORIC DIS-
TRICTS ORDINANCE RELATING TO RECONSIDERA-
TION OF PROPOSED LAND~~RKS~
The Santa Monica City Council having requested that those regu-
lations pertaining to the perlod of time required between re-
consideration of a Landmark or Historic District be reviewed
and the advisability of increasinq the present one (l) year period
and the Landmarks Commission havlng undertaken the requested
review and consideration of alternatlves hereby reconmends as
follows:
That the present one (l) year minlmum period between denial of a
landmark designation and reapplication or resubmission be
increased to three (3) years wlth the exception that the owner
of the subject property May reapply at any time.
That the present thirty (30) day period during WhlCh a prelim-
inary recommendation and the setting of a public hearlng on an
application for a Landmark or an Historlc District be increased
to forty-five (45) days ln both instances.
The Landmarks Commisslon believes these changes to be necessary
for the followlng reasons:
1. Membership of the Commission may change substantially
within a three (3) year period and reconsideration of a
previously den~ed application may he viewed d~fferent1y
by a new Commission.
2. New historic lnformation may have been uncovered re-
garding a potential Landmark or Historic District.
3. The community's sensitivity to historic preservation
may have 1ncreased in a period of three (3) years.
4. Changes in structural engineerlng methods and tech-
niques involving the preservation of historic properties
may occur.
