SR-405-002-01 (5) EPWM: \Share\STAFF REPORTS\FY 05-06\11_22\Easement.doc Council Meeting: November 22, 2005 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Adopt Resolution to Acquire Storm Drain Easements and Relinquish Acquired Storm Drain Easements to the Los Angeles County Flood Control District Introduction This report recommends that the City Council adopt the attached resolution to acquire storm drain easements from the State of California’s Department of Transportation (Caltrans) for the construction of the new Civic Center Parking Structure and authorize the City Manager to execute a certificate of acceptance and purchase agreement for the acquisition. Upon acquisition, this report also recommends that the City Council authorize the City Manager to negotiate and execute relinquishment of storm drain easements to the Los Angeles County Flood Control District (LACFCD). Background The Pico Canyon Storm Drain (PCSD) collects runoff from a portion of the I-10 freeway and surrounding areas to the coast at the westerly limits of Pico Boulevard. In 1965, the City sold a segment of the PCSD easement to the State of California. The PCSD system that operates within that segment, between the I-10 freeway and Main Street, is currently owned by Caltrans. 1 Discussion In the initial planning phase of the project, LACFCD permitted the City to use its storm drain easements to construct a new Civic Center Parking Structure. During the design phase of the project, City staff was advised by LACFCD that the storm drain easements are owned by Caltrans. Caltrans does not have a permit process that allows for construction of any structure over its easements. City staff met with representatives from Caltrans and agreed that it was to the best interest of the City, from an operational and maintenance perspective, to acquire control of this segment of the easement from Caltrans. Since the City originally sold the easements for a fee to the State of California, Caltrans and the City agreed that the City could repurchase the easements from Caltrans for the same fee. Upon acquisition, the City plans to enter into negotiations with LACFCD to relinquish ownership of these storm drain easements since LACFCD does have a permit process that allows for construction over its easements and already owns a significant number of storm drain easements within the Santa Monica city limits. No financial consideration to either party will be required for the relinquishment of storm drain easements to the LACFCD. Budget/Financial Impact The proposed cost of purchasing the storm drain easements that has been negotiated with Caltrans is $29,876. Authorize the City Manager to execute a certificate of acceptance and purchase agreement for the acquisition; and 3.
