SUBJECT:Professional Service Agreements Necessary to Construct the new Civic
Center Parking Structure.
Introduction
This report recommends that the City Council authorize the City Manager to negotiate and
execute professional services agreements with Smith-Emery Company for Deputy
Inspection and Materials testing; D7 Consulting, Inc. for Waterproofing Inspection; and
Ninyo and Moore for Geotechnical Inspection and Environmental Oversight Services for
the Civic Center Parking Structure project.
Background
As a result of increased parking demand and the necessity to complete earthquake
retrofitting of the downtown parking structures, the City has undertaken the development
of a new parking facility in the Civic Center. The new structure will be constructed on land
owned by the City bounded by 4th Street on the east, Civic Center Drive on the south,
Avenida Mazatlan on the west and Olympic Drive on the north.
On October 23, 2001, City Council approved a contract with ARB, Inc. for design-build
services for the parking structure and approved a guaranteed maximum price for the

project on September 14, 2004.
Discussion
In order to meet code requirements and ensure proper quality control during construction
of the parking structure project, City staff issued Request for Proposals to procure qualified
consultants for deputy inspection and materials testing, waterproofing inspection and soils
inspection and environmental oversight.
Deputy Inspection and Materials Testing
Request for proposals for deputy inspection and materials testing were sent to four firms
on September 16, 2004. Responses were received from two firms and reviewed by a
selection committee. Staff recommends Smith-Emery Company as the most qualified
consultant. Smith-Emery Company has performed numerous public works projects
including several for the City of Santa Monica, with the most recent being the new Main
Library project. The firm has a very qualified team of inspection staff that is available
within the Civic Center Parking Structure project’s schedule requirements that can perform
all aspects of special inspections required for the project. Smith-Emery Company has a
complete laboratory that can perform all of the necessary material testing required by
building codes. References contacted indicate that they have performed satisfactorily.
Smith-Emery Company has submitted a cost proposal in the amount of $223,258 that is
fair, reasonable and competitive for the work scope that was outlined in the RFP.
Waterproofing Inspection

Request for proposals for waterproofing inspection were sent to four firms on September
16, 2004. Responses were received from two firms and reviewed by a selection
committee. Staff recommends D7 Consulting, Inc. as the most qualified consultant. The
firm has performed numerous similar public works projects including the Metropolitan
Transportation Authority and Municipal Water District Headquarters in Los Angeles and
the Las Vegas Convention Center. D7 has a very qualified staff that can perform all
aspects of waterproofing inspection required for the Civic Center Parking Structure project.
Staff contacted references and all respondents indicate that work was performed
satisfactorily. D7 Consulting, Inc. has submitted a cost proposal in the amount of $66,700
that is fair, reasonable and competitive for the work scope that was outlined in the RFP.
Soils Inspection and Environmental Oversight
Request for proposals for soils inspection and environmental oversight were distributed to
five firms on September 20, 2004. Responses were received from four firms and reviewed
by a selection committee. Staff recommends Ninyo and Moore as the most qualified
consultant. Ninyo and Moore has worked on several projects in a similar capacity for
public and private sector clients including City of Fontana Library, Technology Resource
Center in Fontana, Norwalk Transportation Center in Norwalk, and Bloomfield Business
Center Property in Santa Fe Springs.The firm has demonstrated experience in providing
geotechnical and environmental services on projects. Ninyo and Moore has field inspection
staff that are trained in aspects of engineering which provide the City with the most cost
effective approach to monitoring the excavation and foundation work on the Civic Center

parking structure project. The firm has a very sound reputation in the industry and

eferences contacted indicate that they have performed very satisfactorily. Ninyo and
Moore has submitted a cost proposal in the amount of $204,700 that is fair, reasonable
and competitive for the work scope that was outlined in the RFP.
Budget/Financial Impact

Contingencies (10% per contract) $ 49,465

Funds in the amount of $544,123 are available in account C010562.589000, “Civic Center
Parking Structure.”
Recommendation
Staff recommends that the City Council authorize City manager to negotiate and execute
contracts with the following:
a. Smith-Emery Company in an amount not to exceed $223,258 and approve
$22,325 in contingency funds.
b. D 7 Consulting in an amount not to exceed 66,700 and approve $6,670 in
contingency funds.

c. Ninyo and Moore in an amount not to exceed $204,700 and approve
$20,470 in contingency funds.
