INTRODUCTION
This report transmits for Clty Councll approval a F1nal Map for
the Clty of Santa Monlca's f1rst tenant-part1c1pat1ng converSlon
proJect:

BACKGROUND
Councll approval of a flnal map for a tenant-partlclpat1ng con-
verSlon represents one of the last steps necessary in the conver-
Slon process. These converS1ons began 1n September 1984, follow-
lng the June 1984, electlon when Santa Monlca cltlzens voted and
approved Proposl tlon X, Artlcle XX, the Tenant OWnershlp R1ghts
Charter Amendment (TORCA).
This proJect lS the f1rst of 29
bUlldlngs, representlng 279 unlts (see Attachment A), currently
on f1le wlth the Plannlng D1V1S1on to come before Clty Counc11.
Followlng C1ty Counc~l actlon the appllcants may then move ahead
to beg1n selllng thelr unl ts to the tendnts.
As each unit lS
sold a converS10n tax per Section 2008 of Article XX lS due 1n an

amount equal to twelve tlmes the monthly maXlmum allowable rent
for that unlt. These taxes wlll be used to asslst low and moder-
ate lncorne households to purchase or lmprove thelr unlts subJect
to affordable repayment per Sectlon 2009 of Artlcle xx.
These proJects represent cooperatlve agreements between tenants
and property owners and provlde the opportunl ty for tenants to
own their own residences and owners to sell thelr property wlth
an lmproved return on lnvestment.
The Clty Planning CommlSS1on approved the Tentatlve Map and the
Tenant-Partlclpatlng Conversion for the above proJect on January
21, 15185, after a publlC hearlng and a careful reVlew of the
record and staff recornmendatlons. The actlon of the Plannlng
Commlsslon was based on ltS flndlngs that the proposed Tenant-
Partlclpatlng ConverSlon meets the requirements of Artlcle XX of
the City Charter and that the proposed subdlvlslon is conslstent
wlth appllcable general and speclflc plans as adopted by the Clty
of Santa Monlca along wlth all mandatory requlrements of the Sub-
divlSlon Map Act of the State of Callfornla.
The owner has subrru tted to the Cl ty, and the Cl ty Attorney has
approved, a Wrltten Consent Agreement blndlng the owner and any
successor s ln intere st to each condition imposed ln connectlon
wlth approval of thlS Tenant-Partlclpatlng ConverSlon. Each par-
tlclpatlng tenant has been lnformed ln wrl tlng of hi s or her
rlghts under Artlcle XX of the Clty Charter. The Llcense D1Vl-
Slon reports that proper arrangements have been made to ensure
payment of the Tenant-partlclpatlng Converslon Tax.

The Flnal Map conforms to the Tentatlve Map. The Flnal Map has
been approved by the Los Angeles County Englneer I s office and
certlfled by the Clty Englneer for conformance wlth the Tentatlve
Map and condltJ..ons thereon, the Subdlvlslon Map Act and local
ordlnance 5 .
The Clty Attorney's offlce has approved a Declara-
tlon of Covenants, Condltlons, and Restrlctlons, or equlvalent
document, for thlS proJect as complying with the condltlons of
the Tentatlve Map and the Tenant-Partlclpatlng Conversion.
BUDGET/FISCAL IMPACT
The recommendatlon presented In thlS report does not have an lm-
medlate budget or flscal lmpact.
If and as unlts In the proJect
are sold ln the future, Tenant-Partlclpat1ng Converslon Taxes
wlll be collected pursuant to the provls1ons of Article XX of the
Cl ty Charter and some lncreased property tax revenues may be
generated.
RECOMMENDATION
It lS respectfully recommended that the Final Map for thlS
Tenant-Partlclpating Converslon be approved by adoptlon of the
accompanYlng resolutlon.
