SUBJECT: Request of Councilmember Herb Katz to set a publlC
hearlng date to conslder appeal of Tentatlve Tract Map
43805 for subdlvlslon of property at 1220 Marlne
Street.
On Monday, November 11, 1985, Councilmember Herb Katz flIed an
appeal of the Plannlng Commlsslon's declslon to approve Tentatlve
Tract Map 43805 for a 12 lot subdlvision at 1220 Marine Street.
Under the provlslons of the Munlclpal Code pertalnlng to tenta-
tlve tract map appeals (Sectlon 9366), wl.thl.n 10 days, or the
next regular Clty Council meetl.ng followlng the flllng of the
appeal, whlchever is later, the CounCll may at lts discretlon
reJect the appeal or vote to set the matter for publlC hearlng.
If the Counell decl.des to accept the appeal, a publl.C hear long on
the matter must be held wlthln 30 days after the appeal has been
flIed.
To comply with the requlrement of the Munlclpal Code, Councilmem-
ber Herb Katz's appeal is now before the COUDCll to be accepted
or re Jected.
Should the Councll vote to accept the appeal and
set the matter for publlC hearlong, the matter wlll be scheduled
on the December 10, 1985 Cauncl.l agenda to allow for requlred
publl.C notloflcatlon.
