SR-404-007 (16) PCD:SF:JT:AS:JM:f:\plan\share\council\strpt\fm\fm52838Rev.doc Council Mtg: March 5, 2002 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Subdivision Improvement Agreement and Resolution Approving Final Tract Map No. 52838 for a 5-Unit Condominium Project at 1719 Ocean Front Walk. INTRODUCTION This report transmits for City Council approval a Subdivision Improvement Agreement and Final Tract Map for the following condominium project. The Vesting Tentative Map was approved by the Planning Commission on June 9, 1999. TRACT MAP ADDRESS SUBDIVIDER UNITS 52838 1719 Ocean Front Walk Michael Rahimi 5 This report is being resubmitted for City Council approval. City Council approved the Final Tract Map on December 18, 2001; however, reference to the Subdivision Improvement Agreement was inadvertently excluded in the recommendation of the staff report and the City Council must authorize the City Manager to negotiate and execute the Subdivision Improvement Agreement and then approve the Final Tract Map. BACKGROUND After public hearing and careful review of the record and staff recommendations, the Planning Commission approved a Vesting Tentative Tract Map for the above project on June 9, 1999. The action of the Planning Commission was based on its findings that the proposed subdivision will have no significant environmental impact and is in conformance with all State and local laws and regulations and applicable General Plan Elements. DISCUSSION The Final Map conforms to the Tentative Map. The License Division reports that the developer has agreed to pay the condominium tax. The project has been approved by the Los Angeles County Engineer’s office and certified by the City Engineer for conformance with the Tentative Map and conditions thereon, the Subdivision Map Act and local ordinances. The City Attorney's office has approved the covenants, conditions and restrictions for the Final Map as complying with the conditions of the Tentative Map and applicable laws. The applicant has signed the Subdivision Improvement Agreement, Performance Bond and Labor and Materials Bond, stating their agreement with the City to complete the required public improvements at the expense of the applicant. The improvements consist of the removal and replacement of sidewalk and construction of a new curb and gutter adjacent to the project. The agreement has been approved as to content by the City Engineer and as to form by the City Attorney. Therefore, there is no impediment to approval. BUDGET/FISCAL IMPACT The recommendation presented in this report does not have a budget or fiscal impact. RECOMMENDATION It is recommended that the City Council authorize the City Manager to negotiate and execute the Subdivision Improvement Agreement and adopt the accompanying resolution approving the Final Tract Map.
