BACKGROUND
The City Plannlng Comnll_ssion approved the Tentat1.ve Map and the
Tenant-Part1.Clpatlng Converslon for the above proJect on March 4,
1985, after a publ1.c hearlng and a careful reVlew of the record
and staff recommendat1ons. The action of the Plannlng Commls81on
was based on the COmffilSS10n's findlngs that the proposed Tenant-
Particlpating Conversion meets the requlrements of Article XX of
the City Charter and that the proposed subdlvlslon 15 consistent
with appllcable general and speciflc plans as adopted by the Clty
of Santa Manlea along w1.th all mandatory requirements of the Sub-
divASlon Map Act of the State of Callfornla.

The owners have submitted to the City a Wrltten Consent Agreement
bind~ng the owners and any successors ~n 1nterest to each condi-
tlon 1mposed 1n connection w1th approval of this Tenant-
Partlclpatlng ConverS10n. This Written Consent has been approved
by the Clty Attorney and the City Manager. Each particlpat~n9
tenant has been informed 1n wC1tlng of hlS or her rlghts under
Article XX of the Clty Charter. The License Dl V1Slon reports
that proper arrangements have been made to ensure payment of the
Tenant-Partlclpatlng Converslon Tax.
The Flnal Map conforms to the Tentatlve Map. The Final Map has
been certlfied by the Clty Englneer for conformance with the Ten-
tatlve Map and condltions thereon, the Subdlvlslon Map Act and
local ordinances. The Clty Attorney's offlce has approved a Dec-
laratlon of Covenants, Condi tlons, and Restr lctions, or equi va-
lent document, for thlS proJect as complYlng wlth the condltlons
of the Tentatlve Map and the Tenant-Partlclpat~ng ConverSlon.
Counc~l approval of a f~nal map for a tenant-partlcipating con-
verSlon represents one of the last steps necessary in the conver-
Slon process. Followlng City Councl1 actlon and approval by the
Cal~fornia Department of Real Estate the appl~cants may begln
sell~ng thelr unlts to the tenants. As each unit ~s sold a con-
verS10n tax per Sectlon 2008 of Artlcle XX 15 due In an amount
equal to twelve tlmes the monthly maXlmum allowable rent for that
unlt. These taxes w11l be used to asslst low and moderate income
households to purchase or lmprove their unlts subJect to afford-
able repayment per Sectlon 2009 of Art2cle XX.

BUDGET/FISCAL IMPACT
The recommendat~on presented in th~s report does not have an ~m-
med~ate budget or flscal impact.
If and as units in the proJect
are sold in the future, Tenant-Participating Conversion Taxes
w~ll be collected pursuant to the prOV1S1ons of Artlcle XX of the
City Charter and some lncreased property tax revenues may be
generated.
RECOMMENDATION
It ~s respectfully recommended that the Flnal Map for thlS
Tenant-Partlclpatlng Conversion be approved by adoption of the
accornpanYlng resolution.
