BACKGROUND
The Clty Planning COmml.SS10n approved the Tentatl.ve Map and the
Tenant-Partl.cipatlng ConverSlon for the above proJect on May 20,
1985, after a publl.c hearlng and a careful reVlew of the record
and staff recornmendatl.ons. The actl.on of the Plannl.ng Commissl.on
was based on the Commlssion's findl.ngs that the proposed Tenant-
Partl.cl.pating ConverSl.on meets the requlrements of Article XX of
the Cl.ty Charter and that the proposed subdl.V1Sion is consistent
wlth appll.cable general and speclfic plans as adopted by the Clty
of Santd Moulca along with all mandatory requlrements of the Sub-
dlVl.Sl0n Map Act of the State of Call.fornla.

The owners have submltted to the City a Wr2tten Consent Agreement
blndlng the owners and any successors in lnterest to each condl-
tlon lrnposed 1n connect1on wlth approval of thlS Tenant-
Part1clpating ConverSlon. Th1S Wr1tten Consent has been approved
by the Cl ty Attorney and the C1 ty Manager. Each part1c1pating
tenant has been 1nformed 1n wri t1ng of hlS or her rights under
Art1cle XX of the Cl ty Charter. The Llcense Dl vislon reports
tllat proper arrangements have been made to ensure payment of the
Tenant-Particlpatlng ConverSlon Tax.
The Flnal Map conforms to the Tentat1ve Map. The Flnal Map has
been certlf1ed by the Clty Engineer for conformance wlth the Ten-
tative Map and condltions thereon, the SubdivlsJ.on Map Act and
local ordlnances. The Clty Attorney's offlce has approved a Dec-
laratlon of Covenants I Condl tlons I and Restrictlons I or equl va-
lent document, for thlS proJect as cornplYlng with the condltlons
of the Tentatlve Map and the Tenant-Partlclpating ConverSl0n.
COUDCll approval of a flnal map for a tenant-partic1patlng con-
version represents one of the last steps necessary In the conver-
Slon process. Followlng City CaUDell actlon and approval by the
Californla Department of Real Estate the appllcants may begin
selllng thelr unlts to the tenants. As each unlt lS sold a con-
verS10n tax per Sect10n 2008 of Artlcle XX 15 due 1n an amount
equal to twelve tlffies the monthly maXlmum allowable rent for that
unlt. These taxes wl1l be used to asslst low and moderate lncorne
households to purchase Or lmprove thelr unlts subJect to afford-
able repayment per Sectlon 2009 of Art1cle XX.

BUDGET/FISCAL IMPACT
The recommendation presented 1n this report does not have an lffi-
medlate budget or fiscal lmpact.
If and as unlts in the prOJect
are sold 1n the future, 'I'enant-part1cipat1ng Converslon Taxes
wlll be collected pursuant to the provislons of Art1cle XX of the
ci ty Charter and some lncreased property tax revenues may be
generated.
RECOMMENDATION
It 18 respectfully recoIT~ended that the Final Map for this
Tenant-Part1c1patlng Conversion be approved by adoptlon of the
accompanYlng resolutlon.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
ACCEPTING AND APPROVING
A FINAL SUBDIVISIO~ MAP FOR TRACT NO. 43881
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the Final Map of Tract No. 43881 1n the
C1ty of Santa Mon1ca hereby is accepted and approved.
SECTION 2. That the C1ty Clerk hereby 1S authorized and
dlrected to endorse upon the face of said Map this order authen-
tlcated by the Seal of the City of Santa Monica.
SECTION 3. That the C1 ty Clerk shall cert1fy to the adop-
tion of th1S Resolut1on, and thenceforth and thereafter the same
shall be in full force and effect.
