BACKGROUND
The Cl ty Planning C0'1\l1llSS10n approved the Tentatl ve Map and the
Tenant-Part1clpating ConverSlon for the above proJect on Aprl1 1,
1985, after a publlC hearlng and a careful reVlew of the record
and staff reco~~endations. The actlon of the Plannlng CO~JUisslon
was based on the COJU~lss10n's flnd1ngs that the proposed Tenant-
Partlclpatlng Converslon ~eets the requlre~ents of Artlcle XX of
the Clty Charter and that the proposed 5ubd1v1slon 15 conslstent
wlth appllcable general and specLf1c plans as adopted by the City
of Santa Monlca along wlth all ~andatory requlre~ents of the Sub-
dlVlSlon Map Act of the State of Callfornla.
The owners have sub~ltted to the Clty a Wrltten Consent Agree~ent
bLndlng the owners and any successors 1n interest to each

Partlclpat~ng ConverSlon. This Wrltten Consent has been approved
by the City Attorney and the City Manager. Each partlclpatlng
tenant has been lnfor'lled 1n wrl t1ng of hl S or her rlghts under
Article XX of the City Charter. The License Dl vlsion reports
that proper arrange'llents have been 'llade to ensure paY'llent of the
Tenant-Partlclpatlng Converslon Tax.
The Flndl Map confor'lls to the Tentatlve Map. The Flnal Map has
been certlfled by the City Englneer for confor'llance wlth the Ten-
tatlve Map and conditions thereon, the Subdivls10n Map Act and
local ordinances. The Clty Attorney's offlce has approved a Dec-
laratl0n of Covenants, Condltlons, and Restrlctions, or equlva-
lent docu'llent, for thlS project as CO'llplYlng wlth the condltlons
of the Tentatlve Map and the Tenant-Partlclpatlng Conversion.
Councl1 approval of a flnal >nap for a tenant-partlclpating con-
verSlon represents one of the last steps necessary lU the conver-
Slon process. Followlng City Couucl1 actlon and approval by the
Callfornla Depart>nent of Real Est-ate the applicants >nay b{;!gin
selllng thelr unlts to the tenants. As each unlt lS sold a con-
ver Slon tax per Sectlon 2008 of Artlcle XX 1 S due ln an a'llount
equal to twelve tl'lleS the 'llonthly >naXl'l1U'l1 allowable rent for that
unlt. These taxes wlll be used to assist low and ~oderate inco'lle
households to purchase or i'llprove thelr unlts subject to afford-
able repaY'llent per Sect10n 2009 of Artlcle XX.

The reeo~~endatlon presented 10 thlS report does not have an L~-
~edlate budget or flseal L~paet.
If and as unlts in the proJect
are sold 1n the future, Tenant-ParticLpatLng Converslon Taxes
wlll be collected pursuant to the provislons of Artlcle XX of the
C1 ty Charter and SO'lle 1ncrea sed property tax revenues 'TIay be
generated.
RECOMMENDATION
It 18 respectfully reco'll'11ended that the Flnal Map for th1S
Tenant-Partic1pating Convers1on be approved by adoptLon of the
accO'TIpanY1ng resolut2on.
