BACKGROUND
The City Plann~ng COrruTI1SSlon approved the Tentative Map and the
Tenant-Particlpat~ng Convers~on for the above project on March 4.
1985. after a publlC hearing and a careful rev~ew of the record
and staff recommendatlons. The action of the Plannlng Commlssion
was based on the Commlsslon's flndings that the proposed Tenant-
Partlcipat~ng Conversl0n meets the requirements of Article XX of
the Clty Charter and that the proposed subdlvlslon is consistent
wlth applicable general and speclflc plans as adopted by the Clty
of Santa Monlca along wlth all mandatory requ~rements of the Sub-
dlV1Slon Map Act of the State of California.

The owners have subm~tted to the C~ty a Wr~tten Consent Agreement
b~ndlng the owners and any successors ~n interest to each condi-
tion lmposed ~n connectlon wlth approval of thlS Tenant-
Partlcipating ConverSlon. This Wrltten Consent has been approved
by the Cl ty Attorney and the Cl. ty hanager. Each partlclpatlng
tenant has been lnformed 1.n wri tl.ng of h1.s or her rl.ghts under
Article XX of the Clty Charter. The License Divl.sion reports
that proper arrangements have been made to ensure payment of the
Tenant-Partl.cipatlng Conversion Tax.
The Fl.nal Map conforms to the Tentatl.ve Map. The Flnal Map has
been certifl.ed by the City Englneer for conformance with the Ten-
tatlve Map and conditl.ons thereon, the Subdl.vislon Map Act and
local ordlnances. The Clty Attorney's offlce has approved a Dec-
laratlon of Covenants, Condl. tions, and Restrl.ctlons, or equl.va-
lent document, for this proJect as complYlng wlth the condl.tl.ons
of the Tentative Map and the Tenant-Partic1.patlng Conversion.
Council approval of a final map for a tenant-partlC1.patlng con-
verS1.on represents one of the last steps necessary in the conver-
S1.on process. Followl.ng City Counell actlon and approval by the
Call.fornla Department of Real Estate the applicants may begin
selllng the1.r unlts to the tenants. As each unit 1.S sold a con-
verS1.on tax per Section 2008 of Art1cle XX lS due 1.n an amount
equal to twelve times the monthly maXlmum allowable rent for that
unlt. These taxes will be used to aSS1.st low and moderate lncorne
households to purchase or lmprove thelr unlts SUbJect to afford-
able repayment per Section 2009 of Artlcle XX.

BUDGET/FISCAL IMPACT
The recommendatlon presented 1n this report does not have an im-
med1ate budget or f1scal 1mpact.
If and as units 1n the project
are sold 1n the future, Tenant-Part1cipating Conversion Taxes
will be collected pursuant to the prov1sions of Article XX of the
CJ.ty Charter and some 1ncreased property tax revenues may be
generated.
RECOMMENDATION
It is respectfully recommended that the Flnal Map for thlS
Tenant-Part1cipating ConversJ.on be approved by adopt10n of the
accompanYlng resolution.

ACCEPTING AND APPROVING
A FINAL SUBDIVISION MAP FOR TRACT NO. 43841
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the F~nal Map of Tract No. 43841 in the
C~ty of Santa Monica hereby is accepted and approved.
SLCTION 2. That the C1ty Clerk hereby is author~zed and
directed to endorse upon the face of said Map th1s order authen-
t1cated by the Seal of the City of Santa Monica.
SECTION 3. That the C~ty Clerk shall cert1fy to the adop-
t~on of th15 Resolut~on, and thenceforth and thereafter the same
shall be in full force and effect.
