Applicant/Appellant: Home savings of America. INTRODUCTION This report recommends that the city council requlre an Environmental Impact Report for Development Review 333 and remand the project to the Planning Commission. BACKGROUND On September 8, 1986, the Planning Commission conducted a public hearing on Development Review 333. Follotving a 3 to 2 vote, Development Review 333 was deemed denied in that four votes could not be obtained to either approve or deny the application. Only five Commissioners were present. On September 9, 1986 Christopher Harding, on behalf of the applicant, filed an appeal of the action. Subsequent to the filing of the appeal, the applicant met with interested neighbors and has requested the preparation of an Environmental Impact Report to address their concerns. /2,,4 - 1 - DEe - 9 1916 .$ ANALYSIS The applicant has requested that an Environmental Impact Report (EIR) be prepared pursuant to the California Environmental Quality Act (CEQA) to address the concerns of interested citizens and to provide further information regarding mitigation measures. Al though an initial study was prepared for this proj ect and a negative declaration recommended for approval to the Planning Commission, staff is agreeable to this request if the applicant will grant the City a ninety day extension to accommodate the additional work to be done. This is the maximum amount of extension time allowable under the Permit Streamlining Act. In terms of the amount of processing time required, preparing an EIR for the project and remanding it back to the Planning commission is tanamount to filing a new application. Therefore, even with the ninety day extension, the schedule for completing the document and the required hearings has little leevlaY for slippage. However, staff believes that the project can be expedited to accommodate this schedule through adjustments in the scheduling of other division workload. CO'CNCIL ACTION Should the council determine that an EIR should not be prepared and that the proj ect should not be remanded to the Planning Commission, the applicant has requested that consideration of the appeal be moved to the January 13, 1987 Council meeting. Jr. John, III, Joshua, Matthew and Tinothy Beck We are thankful that we live in a clty such as Santa Monica that has established laws and regulations governIng the interaction and relatIonshIp of property owners. This is especially meaningful to us this evenIng when one property owner, Hone Savlngs. does not appear to keep fSlth with another. us, their Immediate reSIdentIal neighbor to the south. This ToBY seem to be a harsh criticism but let me explain: 1. E~EKltl~ E8Q~bstl Our neighborhood has a significant parking problem. This has been created by the theaters located on the property that Horne Savings ownB at 26th and Wilshire. About 17 or 1S years ago, when the Brentwood Twins opened, tha city parking requirement at that time ~as one parking space for every 10 seats. At that time my {ather talked to Leg Storrg who was head of the Santa Mon1ca PlannIng Departnent and was told by h~m that the theaters could not possibly qualify using only the parking lot behind the theaters. Mr. Storrs further stated that they had issued the conditional use perm1t ~or the theaters becauBe 1I0l'\e Savings owned the theater building nnd had agreed to let the theater patrons also hove the use of Lhe bank parking lot at nl~ht when the bank was claeed. Hr. Storrs added this arrangement would be officially noted in the city records and on the zoning maps. 1 , , The park~ng lot of Home Sav1nga was only ava11able for the theater the f~rst couple of yea~s. Afte~ that "valet." park~ng appeared on the Home Sav1ngs lot and the theater patrons naturally moved to the streets for "free" parking. Our park1ng on 26th Street has been very poor at n1ght because Home Savings did not keep their orig1nal agreement. We have since checked the city records and the zoning maps end ve find no reference to the agreement of which Mr. storrs spoke. We would obJect strongly to the proposed new bU11ding unless serious consideration 1S given to the already exist~ng park1ng problem in the immed~ate vic1n1ty of Home Savings. We would 11ke to see a "CONDITION" that the new underground parking would be available to the public and theatre patrons free of charge dur1ng the hours the bank ~s closed. We would want to see this CONDITION entered into the off1cial C1ty of Santa Monica reco~ds so as ~o be a matter of permanent and pub11c record. 2. khH~~~hE~ ~hBBJgB Another area where Homes Savings has not kept fa1th with ~t~ ne1ghbor concerns the green space that 15 to ex~st between commercial use and resldential use ~roperty. Th1s landscap1ng 18 a requ~re~ent ~~posed by the city that has been om~tted by Home Savings for the already eX~st1ng fac~l1ty. The purpose of landscaping is to sh1eld resident1sl property from business and commercial property. The hedge that protects the front half of our property 11ne serves its intended purpose. Approximately five or six years ago Hone Sav1ngs enlarged its parking let bordering ~he rear portion of our property line. At this tine they removed the landscaping already in existence with the understanding that a new hedge would be planted. When the new tandem parking spaces were paved~ Home Savings then failed to extend the hedge in front of the new parking Bpaces. As a result, we find that some of the people who park in this new section will stand by the wall and Bet drink cans or throw beer cans and other trash over the wall into ou~ yard. At the end of 1985, I gpoke to Mr. Jones, the manager of the Home Savings bronch next door to our property. In March of 1986 I spoke to Julie Elli3, a representative of Hone Savings. I requested that they complete the landgcaping along our property line. Mr. Jones told U8 of the pOAsibility of new construction and that the landscaping that borders ou~ property would not be completed until after the proposed new construction was completed. 2 Julie Ellis in Marc~ further seemed to reflect t~e same understanding of this landscaping comoletion date. The failure of Home Savings to complete th~s Fest proJect has created a nuisance that would not be occurring today if Home Sev1ngs had fulfilled its earlier obligation to complete the hedge along our property line. In addit~on, if new construct~on begins next door, noise and dust protection will not be possible for that portion of our property l~ne unprotected by the requ~red lendscao~ng. The current block wall is very sat~gfac~ory. But if the wall is to be removed or moved we would, first, request that we be notified 30 daya in advance in order that we may be able to protect our property end. second. i= the wall ~g to be removed or moved ue would also li~e to ask ~o be given an opportunity to review and have so~e 1~pUt ~nto the f~nal design and landscape of th~s area adJacent ~o our property. ~EW CC~STRUC7ION PROPOSED Slnce we are now be~ng lnfor~ed that rew construction is lm~lnent we are concerned about ~ow closelv Home Savlngs will follow the Clty requ1remen~s for th1s new proJect. These two 1te~9, the par~{1ng and ~he la~dsca~lng adJacent to our property are extreMely lnpor~3nt ~o us and up to thie point Hore Savings has ignored our requests for help. These two pOlnts, the parklng and the :ancscap~ng, pertain to both the existing facility and any future developement. We are also concerned about the plan to enlarge their office building in these addition91 areas: 3. 11 EQQI BE;~E Y~EQ f!!.!s! "~I~2 QQ~t!.. ~QH~IBY~I~g~ The new structure does not confor~ to the bUlldlng code requirement of a 14 :foot rear yard nor the "etep do\../n" des~gn that 18 necessary \..,then bu~lding adJacent to a residential zone. The "FINAL INITIAL STUDY" (blue book) expla~ns that the building wl11 be separated fre, residential uses by a 20 foot alleyway and a 40 foot wide par~ing lot [page 20, end of 5th paragraph]. It is true that the building will be separated by a 20 ~cot 31leyway, but the 40 foot parking lot is not conmerciel prooerty but is ~oned R-2 and there is no record of a CO~DITICNAL USE =or that property BS "park i ng lot". The bl ue boo\{ does recognize that the building may need to be scaled down or reduced to provide a better trangition to adJscent residential land UBee (page 20, second to last paragra?hl. 3 As the next res1dence directly south of the proposed development we are not~ at this tine, 1n favor of lolaVl.ng the 14 foot rear yard nor setting aside the "etep down" design requirement or the 1984 LUE plan [see page 6S-,69 or LUEJ. 4. !~~BQe~R ~3~ QE B~~!Qs~II~h ~BQrsBIY The current design subm1tted to the Plannl.ng Commlss1on show that a TRANSFORMER will be located at the front end of 1215 2&th Street, and a TRASH BIN at the rear of that same lot. This lot is zoned R-2. It is my understanding that at the present time there is no CONDITIONAL USE PERMIT on record to use this lot in any ather way than the current zoning which is res1dentl.al. Both or these uses, a transrormer and trash bl.n. are l.mproper for res1dent1al property and should not ~e allowed. Even if Home Savings should apply ror a CO~DI7IC~AL USE PERMIT to use this lot for parking 1t would still not pern1t a TRASH BIN or TRANSFORMER installation. 5. 1~~EQEg3 ~QIIgg QE ~3Q~Q~gQ ~QI~QIE~ We, and I presume our nel.ghbors, rece~ved B not~ce Of a meeting to consider a "three story" bUl.ld~r.g. CONCLUSION We are not trY1ng to make th~ngs dlfilcult ror Home Savings, but we do have some problema of great concern which can probably be worked out to the satis:fac~~on of both of us, with a little serious :face to race dialog.
