SUBJECT: Reconsideration of an Appeal of a Planning Commission
Condition of Approval for Conditional Use permit 89-072
and Tentative Parcel Map 21640 to Allow a Four Unit
Condominium at 1109 16th Street.

Attached is the staff report related to the above referenced
project which was considered by the City Council at the meeting
of April 10, 1990. This item is being reconsidered at request of
the City Council.
The city council denied the appeal and upheld the Planning
commission I S condition of approval relating to the location of
the required 41 un excavated side yard.
The Commission's
condition of approval required the unexcavated s ide yard to be
located on the south side of the parcel in order to preserve an
existing vine. The applicant is proposing that the unexcavated
side yard be located on the north side of the parcel, as
originally proposed, and that a planting pocket be provided on
the south side in order to preserve the vine.
Attached is a letter from Planning Commissioner Mehrdad Farivar
concurring with this latest proposal. Staff agrees that this is
a reasonable compromise which achieves the obj ectives of the
applicant and the neighbor's desires to save the vine.

The above project was before the Plann1ng Commission some time
ago In response to a reQuest of the adjaCent neighbors, the applicant was
asked by the Commlss1on to provlde an unexcavated slde yard on the south
slde of the proposed bU1ldmg m order to save some trees and other plant
materlal on that SIde
The appl1cant has appealed this decision to the City Couocll cla1mmg
undue hardshIp I met w1th the applicant and acknowledge that complYlOg
w1th the Commlsslon's rUlmg may lOdeed subject the applicant to
unintended hardship. Accordingly, as the maker of the motion on thlS ltem,
I propose the following as an alternate way of achieving the Intent of my
motlon WIthout subjecting this applicant to undue hardship:
That the applicant retain the originally proposed 4'
unexcavated side yard on the north SIde of the proposed
bUlldlng.ma. leave unexcavated areas of adequate size
around the three e)(15ttog trees on the south side of
the ~oosoeCl DU1ldlng; QC provIde a cont1nuous 2" wide
unncavated side yard along the south property lIne while
matntalntng the 4' unexcavated slde yard on the north side.
