INTRODUCTION This report recommends that the City Council certify the attached statement of Official Action for the above referenced appeal. BACKGROUND After a public hearing, and careful review of the record and staff recommendation, the City council denied an appeal of the Planning Commission's approval of a proposal to construct a five unit condominium subject to a special condition that requires the provision of vehicle access from a rear 20 foot wide alley instead of from Eighteenth street as shown on proposed plans. The City Council denied the appeal and re~lired access from the alley as stipulated in the Planning Commission approval. APPEAL DENIAL FINDINGS 1. The development of vehicle access from the front of a flat and even surface parcel that abuts a 20 foot wide alley does not comply with applicable provisions of the "City of Santa Monica Comprehensive Land Use and Zoning Or- dinance", and the General Plan in that SMMC Section 9044.8 and General Plan Policy Section 3.4.7 require access from the alley side, to reinforce the continuity of the residential streetscape, to preserve onstreet parking, and to ensure safety of children. 2. The proposed use would impair the integrity and character of the district in which it is to be located, in that the area is located within walking distance of pUblic school facilities and other public facilities that are accessed by children. The safety of children may be jeopardized by location of the driveway access on the front of the site. The development of a residential driveway aisle along Eighteenth Street may also result in a visually interrup- ted streets cape and loss of onstreet parking. - 1 - II . . 3. The subject parcel is not physically suitable for the type of land use being proposed, in that it is level, does not contain a substantial slope, is a standard rectangular shaped parcel and is located in a fully developed urban area. 4. The project as proposed would be incompatible with exist- ing and permissible land uses within the district and the general area in which the proposed use is to be located, in that the proposed use does not conform with SMMC Sec- tion 9044.8 and would not be consistent with the location of access aisles developed on similar R2 zoned parcels in the neighborhood. 5. The physical location or placement of the vehicle driveway aisle is incompatible with and does not relates harmo- niously to the surrounding neighborhood, in that newer developments proposed for the surrounding neighborhood provide alley access to parking areas and therefore rein- force the continuity of residential streetscape, preserve onstreet parking and reinforce aesthetic consistency among residential uses in the R2 District. The proposed project is significantly different from recently approved and pro- posed projects and will not reinforce aesthetic consisten- cy along this block of Eighteenth street.
