SUBJECT: Appeal of Two Planning Commission Conditions of
Approval and an Appeal of a Planning Commission
Approval of Conditional Use Permit 90-015 to Allow a
Restaurant/ Bar/ Dance Hall/ Billiards Club in an
Existing Building at 1431 Third street Promenade.

INTRODUCTION
These appeals were first heard by the city council on July lOth,
1990 at which time the Council requested further information
regarding the project. In response to the request, the applicant
has submitted project plans showing the location of the mezzanine
in relation to the second floor, the location of the elevator and
section of the existing building, and a floor plan of the
appellant's residence in relation to the dance floor/music
source. The Council also requested that staff confer with the
City'S consultant for the Noise Element regarding the noise
issue, which is the subject of the neighbor's appeal.
This report recommends that the City Council uphold the project
approval wi th the condition that the proposed dance floor be
eliminated, that the previous use of the dance floor area remain
as rentable space for special functions and that the nature of

any music generated from. such use shall be wi thin recommended
limits proposed by the City's noise consultant.
BACKGROUND
On April 18, 1990, the Planning Commission approved CUP 90-015 to
allow a restaurant/ barf dance hall/ billiards club in an
existing building at 1431 Third street Promenade by a vote of
5-1. The applicant filed an appeal regarding conditions of the
approval, and the adjacent neighbor (1429 Jrd street Promenade)
filed an appeal of the project approval regarding noise levels.
The appeal forms are provided as Attachments A and B. The
statement of Official Action is provided as Attachment c.
In the interim, the applicant, the appellant, and Planning staff
met with the City'S noise consultant to discuss the noise
situation and mitigation alternatives. The City's noise
consul tant prepared comments pertaining to the possible noise
level generated from the club/dance floor which might reach the
adjacent residence (Attachment D). The consultant's primary
concern is the level of low frequency noise or "bass" generated
by an amplified sound system which would be audible to the
neighbor. The consultant also presented recommendations to
control the low frequency noise travelling from the proposed
dance floor area to the neighbor's residence (Attachment E).
A noise consultant for the applicant inspected the site and
presented an alternative to the conditions recommended by the
city's noise consultant (Attachment F). Additionally, the
applicant's noise consultant performed measurements of ambient

noise levels along the Promenade and alley side of the 1431 3rd
street Promenade location. The data is presented in Attachment
G.
The applicant is requesting that hours of operation be increased
and that the number of seats be clarified with an amendment to
Planning commission special condition #5 (See Attachments C & H).
The applicant originally proposed the operation of a 48 seat
restaurant, 24 fixed-seat bar, and 82 seat dance area with 16
pocket billiard tables. At this time, the applicant is
requesting that the back room remain in its historic use as
rentable space for special functions (Attachment I). A Type 47
alcohol permit, on-sale general for bona fide eating place, is
being requested by the applicant. The restaurant/billiards club
would be located on the second floor of the building at 1431
Third street Promenade with existing retail to remain on the
first floor. An elevator for handicapped access to the second
floor as required under Title 24 regulations is provided (see
Attachment J) .
Applicantrs Appeal
At the Planning Commission meeting of April 18, 1990, the
Commission approved the proposed restaurant/billiards club with
the conditions contained in the attached statement of Official
Action (Attachment C).
The Planning Commission imposed a condition which limits hours of
operation for Sunday through Thursday from 10: 00 a.m. to 12: 00

a.m. and for Friday and saturday from 10:00 a.m. to 2:00 a.m.
The Commission also approved a condition that alcoholic beverages
be served only between the hours of 10:00 a.m. to 12:00 a.m. (see
Attachment C).
The applicant is appealing both conditions above as being
unnecessarily restrictive and as imposing a prohibitive economic
condition (see Attachment A). The applicant is requesting that
the hours of operation be extended to 2:00 a.m. seven days a week
and that the restriction upon serving of alcohol between 12 a.m.
and 2 a.m. be removed. The applicant is proposing to have all
patrons exit the club from the rear alley entrance at closing
time and feels that this would prevent disturbance of the
adjacent neighbor at late hours.
Representatives of the Police Department and Alcohol Beverage
Control Department (ABC) indicated that they did not object to a
closing time of 2 a.m. each day for the establishment (See
Attachment C, Alcohol Outlet Conditions). However, the Vice
Division of the Police Department and the Planning Division have
a concern for the proliferation of alcohol outlet facilities in
the Third street Promenade area. Planning staff are also
concerned about the relationship of the project to the adjacent
residential unit.
Another restaurant/bar/billiards club, located 450 feet north of
the site, was approved by Planning Commission with hours of
operation from 6 a.m. to 2 a.m. and with no restrictions upon
serving of alcohol during those time periods. Notwithstanding

that approval, the Planning Commission felt that limiting late
night operations Sunday through Thursday was appropriate. staff
also feels that with the location of the dance floor area being
used for occasional functions adjacent to the neighbor's
residence and workplace, a closing time of 12 a.m. for Sunday
through Thursday is appropriate, with a 2 a.m. closing time
permitted on Fridays and Saturdays.
The applicant is also requesting a clarification of the number of
seats as opposed to IIpersons" specified in the Statement of
Official Action permitted for the establishment as follows: a 48
seat restaurant, a 24 fixed-seat bar, and an 82 seat dance floor
area for a total of 154 seats (see Attachment H). Due to the
nature of the noise situation and staff's recommendation to
eliminate the dance floor, staff is recommending that the total
number of seats be as follows: a 48 seat restaurant, and a
24-fixed seat bar. This condition would replace special
condition #5 (Attachment C).
Neighbor's Appeal
Following the April 18, 1990 Planning Commission approval of the
proposed proj ect, a neighbor appealed the Commission's action.
The neighbor's appeal relates to the effects of noise generated
from the dance area located adj acent to the neighbor's
workplace/residence on the second floor of the adjacent building
(see Attachment Band J). Windows on the second floor of each
structure are adjacent to each other and the neighbor is
concerned about her ability to open the windows without adverse

noise impacts. The neighbor was concerned that Planning
Commission special condition #4 (see Attachment C) requiring that
party walls between residential and commercial units be
soundproofed to a standard of 60 decibels (dBA), was not
sufficient to mitigate noise impacts from the establishment.
staff consulted with the city's consultant for the Noise Element
to review the project plans and existing conditions and report on
the effects of developing the space. The initial memorandum
following the consultant's review indicated that a Sound
Transmission Class (STC) rating of 60 for the common wall between
the residence and the club/dance area would not be sufficient to
block out low frequency noise generated by an amplified sound
system (Attachment D). The consultant suggested that a noise
level limit of 95 dBA for the dance floor area "orll 35 dBA for
the residence be established. This would eliminate the audible
"boom" from the bass end of the stereo in the neighbor's
residence (Attachment E).
On September 11, 1990 a meeting was held with the applicant, his
architect, the neighbor, the City'S sound consultant and staff to
discuss noise impacts and mitigation. At that time, the neighbor
expressed a concern that the applicant's plan to have windows
opening onto the Promenade would adversely affect the noise
levels in her residence (see Attachment J) .
The consultant issued a second memorandum following the meeting
which specifically addresses the noise impacts from the adjacent
use (Attachment E). The state Department of Health recommends an

interior noise limit of 40 dBA. The City's sound consultant
recommended that a median noise level of 35 dBA as measured in
the adjacent residence be set to limit noise from the adjacent
use. However, the consultant stipulates that this level may be
difficul t to enforce. The noise consultant also recommended,
along with a 60 STC rating for the common wall and a desired
noise level of 35 dBA for the residence, that a noise level limit
of 95 dBA for the proposed dance hall/billiard club be
established. The consultant also recommended that a field test
be performed to ensure compliance with these noise levels.
ANALYSIS
The applicant is requesting that limits on hours of operation be
increased from 12 a . m. to 2 a . m. for Sunday through Thursday.
Staff feels that the approved hours of operation are reasonable
and appropriate considering the proximity of the neighboring
residence. The applicant also requested an increase in the hours
of serving alcohol. staff recommends the following amended
condition in place of Planning Commission alcohol outlet
conditions #5 and #8:
Alcoholic beverages may be served between the hours from
10:00 a.m. to 12:00 a.m. Sunday through Thursday and from
10:00 a.m. to 2 a.m. on Friday and Saturday.
In response to the applicant. s request for clarification and
approval of the number of seats, staff recommends the following
amended condition in place of Planning Commission special
condition #5:

The number of approved seats for the project shall be as
follows: a 48 seat restaurant and a 24 fixed-seat bar.
The neighbor's appeal is related to the effects of noise
generated from the operation of the restaurant/bar/dance
hall/billiards club. The Planning Commission stipulated that the
shared wall was to be soundproofed to a standard of 60 dBA. The
neighbor did not feel that this was sufficient to mitigate the
effects of noise emanating from the dance floor area and
requested that an acoustical inspection and report be prepared.
After consultation with the city's sound consultant, a
recommended level of 45 dBA was proposed for the project at the
July loth City council hearing. Subsequent investigation by the
city's sound consultant indicates that the common wall STC rating
will be altered to some degree after seismic upgrade of the
building at 1431 3rd Street Promenade.
A noise consultant for the applicant conducted measurements of
ambient noise levels along the Promenade and alley side of the
subject location. The field data indicates that average ambient
noise levels (Lmin) at the site location are higher than the
median exterior noise level of 60 dba allowed in the commercial
districts by the Santa Monica Noise Ordinance (Attachment G) .
The following conditions are recommended in place of Planning
commission special condition #4:
A noise level limit of 95 dBA in the Billiard Club shall
be established and the applicant shall demonstrate to the

City that the building envelope will achieve a 60 STC
rating through an actual field test after seismic upgrade
of the building. The conditions of the test shall be that
the residence windows shall be open and that the windows
on the Billiard Club side shall be closed. The City shall
have the right to test noise levels at any time at any
location in the Billiard Club and that such levels are not
to exceed 95 dBA.
All windows of the Billiard Club shall remain closed
during operating hours of the establishment so as not to
have adverse impacts on the neighboring residence or
general public.
BUDGET/FINANCIAL IMPACT
The recommendation presented in this report does not have any
budget or fiscal impact.
RECOMMENDATION
It is respectfully recommended that the Council uphold the
Planning commission approval of Conditional Use Permit 90-015
with the findings and conditions contained in the April 18, 1990
Planning Commission statement of Official Action, with the
deletion of alcohol outlet conditions # 5 & 8 and Special
Conditions #4 & #5 in the statement of Official Action
(Attachment C) and with new conditions stated below.

Alcoholic beverages may be served between the hours from
10: 00 a. m. to 12: 00 a. m., Sunday through Thursday, and
from 10:00 a.m. to 2 a.m. on Friday and Saturday.
The number of approved seats for the project shall be as
follows: a 48 seat restaurant and a 24 fixed-seat bar.
The dance floor shall be eliminated. The dance floor area
may remain as rentable space for special functions; the
nature of any music generated from such use shall be
within recommended limits set forth in these conditions.
Special functions such as wedding receptions etc., shall
not exceed two per month if conducted after 9 p.m.
A maximum noise level limit of 95 dBA in the Billiard Club
shall be established. The applicant shall demonstrate to
the City that the building envelope will achieve a 60 STC
rating through an actual field test after seismic upgrade
of the building. The conditions of the test shall be that
the residence windows shall be open and that the windows
on the Billiard Club side shall be closed. The city shall
have the right to test noise levels at any time at any
location in the Billiard Club and that such levels are not
to exceed 95 dBA.
All windows of the Billiard Club are to remain closed
during operating hours of the establishment so as not have
adverse impacts on the neighboring residence or general
pUblic.

As wood conducts sound easily, and there are also Wlildows that open
adjacent to mine, I am requesting that a certlFled acoustlcal engln-
eer inspect and report on the possibility of developing the space at
1431 as presented by the applicant and successfully containing the
neise.
I am also not in agreement that 60 decibels is a noise level Oile
can sleep with as described to me by the planning department.
They say 60 decibels is equivalent to the sound of a cash register
or commercial dish washer at the distance of 10 feet. No one could
work, live or sleep with this amount of noise.

ALCOHOL OUTLET FINDINGS
1. The proposed use and location are in accordance with good
zoning practice, in the public interest, and necessary
that substantial justice be done in that the use is one
which is conditionally permitted in the C3C district, and
is encouraged by the Third Street Mall Specific Plan. The
condltional use permit pertain only to the ancillary sale
of alcoholic beverages in connection with a permitted bona
fide restaurant use. The ancillary alcohol sales will
allow greater daytime and and nighttime use of the site
and will contribute to the economic revitalization of the
downtown area as discussed in the Third street Mall
Specific Plan Policies.
2. The proposed use is compatible with existing and potential
use. within the general area: traffic or parking
congestions will not result: the public health, safety,
and general welfare are protected; and no harm to
adjacent properties will result in that the redevelopment
of the Third street Promenade was anticipated when the
specific plan was adopted, and the City has and will make
improvements to the street system and parking facilities
to accommoclate redevelopment of the area. The Parking
Demand Analysis, Third street Mall Specific Plan EIR and
several Initial studies prepared for projects located in
the Downtown Parking Assessment oistrict indicate that
surplus parking is available in the six parking

structures. The 125 net parking spaces needed tor the
restaurant use will not exceea the available parking
supply ana will not result in added congestion at key
project intersections.
3. The weltare of neighborhood residents will not be
adversely affected in that the proposed use is located
away from maj or residential areas. The proj ect site is
located adjacent to downtown parking facilities that can
be accessed directly from maj or arterial and collector
streets. vehicle use of local residential streets is not
required.
4. The granting of the license will not contribute to an
undue concentration of alcohol outlets in the area in that
the maj ori ty of bona fide restaurant uses located along
the Th~rd Street Promenade are developed as part of larger
office or mixed commercial developments. A primary goal
of the restaurant uses is to provide services to
employees, customers and visitors from other Third street
Mall sites. The Third Street Mall Specific Plan
encourages restaurant uses along the Promenade and the
uses should therefore not be viewed as an undue
concentration in the District.
5. There will be no detrimental affect on nearby
residentially zoned neighborhoods considering the distance
of the alcohol outlet to residential buildings, churches,
schools, hospitals, playgrounds, parks, and other existing
alcohol outlets in that site is not located near
residential neighborhoods, and in that the conditions for
approval will minimize the potential affect on the
adjacent residential uses.
CONDITIONAL USE PERMIT FINDINGS
1. The proposed use is one conditionally permitted within the
subject district and complies with all of the applicable
provisions of the "City of Santa Monica Comprehensive Land
Use and zoning ordinance", in that the sale of alcohol is
conditionally permitted in the C3C district, and in that
the sale of aleohol as a complimentary item with meal ser-
vice in the restaurant should not result in adverse
eonditions.
2. The proposed use would not impair the integrity and
character ot the district in which it is to be established
or located, in that the Third Street Mall Specific Plan
encourage. restaurant uses. A primary us. of the 9,365
square foot area will be to provide bona tide .ea1 service
with ancillary alcohol serviee. Provided the alcohol use
does not become primary in nature or the bar area does not
funetion as a stand alone bar, the us. should not impair
the surrounding district.

3. The subject parcel is physically suitable for the type of
land use being proposed, in that Third Street Mall
specific Plan Policy Sections 4.1.34 and 4.1.37 encourage
restaurant uses along parcels of the promenade.
4. The proposed use is compatible with any of the land uses
presently on the subject parcel if the present land uses
are to remain, in that the bUllding currently on site will
contain general retail uses that are physlcally separated
trom the restaurant and billiard hall use. The restaurant
use wlll not interfere with use of the remaining commer-
clal uses along the mall and may stimulate greater use of
the retall space.
5. The proposed use would be compatible with ex~sting and
permissible land uses within the district and the general
area in which the proposed use is to be located, in that
the zoning of the site conditionally allows the proposed
use and the Third Street Mall Specific Plan encourages
eating and dining uses at this location.
6. There are adequate provisions for water, sanitation, and
public utilities and services to ensure that the proposed
use would not be detrlmental to public health and safety,
and the site is located in an urbanized area with all the
utillties readily available.
7. Public access to the proposed use will be adequate, in
that no on site parking is required and the pedestrian
access is sufficient. SUfficient parking is provided via
the downtown parking structures and the site is accessed
by an alley from the rear.
8. The physical location or placement of the use on the site
is compatible with and relates harmoniously to the sur-
rounding neighborhood, in that the the second floor res-
taurant will contain a design that will reinforce street
level activity along the Promenade.
9. The proposed use is consistent with the goals, Objectives,
and policies ot the General Plan, in that the zoning or-
dinance, Third Street Mall Specific Plan, and the General
Plan promote and encourage daytime and nighttime activi-
ties Which the proposed use accomplishes.
10. The proposed use would not be detrimental to the public
interest, health, safety, convenience, or qeneral welfare,
in that the site is zoned for entertainment use with a
Conditional Use permit and the Third street Mall Specific
Plan encourage. this type of use in the downtown area away
from residential neighborhoods.
11. The proposed use conforms precisely to the applicable per-
formance standards contained in Subchapter 6, Section 9050
and special conditions outlined in Subchapter 7, Section
9055 of the City of Santa Monica Comprehensive Land Use

and Zoning Ordinance, in that these sections do not apply
to this project.
12. The proposed use will not result in an overconcentration
of such uses in the immediate vicinity, in that the Third
street Promenade area is proposed as the location for res-
taurant, entertainment and other nighttime activities and
the proposed proj ect is contributes to the establishment
of the Mall as an entertainment center.
SPECIAL CONDITIONS
1. The applicant shall comply with all legal requirements
regarding provisions for the disabled, including those set
forth in the California Administrative Code, Title 24,
Part 2. If conditions are not met, Planning Commission
approval for this project is considered void. Any changes
in project plans must be approved by the Planning
Director.
2. Hours of operation for Sunday through Thursday shall be
limited from 10:00 a.m. to 12:00 a.m. The hours of opera-
tion for Friday and Saturday are from 10:00 a.m. to 2:00
a.m.
3. Persons 21 years of age and over are permitted to enter
the bar and dance floor areas only. Persons under 21
years of age are permitted access to the restaurant area
only.
4. Party walls between residential and commercial units are
to be soundproofed to a standard of 60 decibels.
5. Number of persons shall be 1 imi ted to 85 persons in the
dance floor area and 48 persons in the restaurant area.
6. The Landmarks Commission shall review the site plans and
design prior to review by the Architectural Review Board.
7. Plans for the exterior remodel shall be reviewed for the
whole facade at one time by the Architectural Review
Board. The Architectural Review Board shall pay particu-
lar attention to the design of the site facade.
CONDITIONS
Plans
8. This approval is tor those plans dated Karch 8, 1990, a
copy of which shall be maintained in the file. of the
City Planninq Division. project development shall be
consistent with such plans, except as otherwise specified
in these conditions of approval.

9. The Plans shall comply with all other provisions of Chap-
ter 1, Article IX of the Municipal Code, (Zoning Or-
dinance) and all other pertinent ordinances and General
plan policies of the City of Santa Monica.
10. Minor amendments to the plans shall be subject to approval
by the Director of Planning. A significant change in the
approved concept shall be subject to Planning Commission

Architectural Review Board or Director of Planning.
11. Construction period signage shall be subject to the ap-
proval of the Architectural Review Board.

proval by the Architectural Review Board.
13. The Architectural Revie..... Board, in its review, shall pay
particular attention to the project's pedestrian orienta-
tion and amenities: scale and articulation of design ele-
ments; exterior colors, textures and materials: window
treatment~ glazing: and landscaping.
Fees
14. The City is contemplating the adoption of a Transportation
Management Plan which is intended to mitigate traffic and
air quality ~mpacts resulting from both new and existing
development. The Plan will likely ~nclude an ordinance
establishing mitigation requirements, including one-time
payment of fees on certain types of new development, and
annual fees to be paid by certain types of employers in
the city. This ordinance may require that the owner of
the proposed project pay such new development fees, and
that employers within the project pay such new annual em-
ployer fees related to the City'S Transportation Manage-
ment Plan.
Construction
15. A sign shall be posted on the property in a manner consis-
tent with the public hearing sign requirements which shall
identity the address and phone number ot the owner and/or
applicant tor the purposes of responding to questions and
complaints during the construction periOd. said sign
shall alao indicate the hours of permissible construction
work.
16. A copy of these conditions shall be posted in an easily
visible and accessible location at all times during con-
struction at the project site. The pages shall be lami-
nated or otherwise protected to ensure durability ot the
copy.

Environmental Mitigation
17. Ultra-low flow plumbing fixtures are required on all new
development and remodeling where plu~binq is to be added.
(Maximum 1.6 gallon toilets and 1.0 gallon urinals and low
flow shower head.)
Miscellaneous Conditions
18. The building address shall be painted on the roof ot the
buildl.ng and shall measure four feet by eight feet (32
square feet).
19. Refuse areas, storage areas and mechanical equipment shall
screened in accordance with SMMC section 9040.13-9040.15.
Refuse areas shall be of a size adequate to meet on-slte
need, including recycling. The Architectural Review Board
in its review shall pay particular attention to the
screening of such areas and equipment.

rights of way adjacent to the project if and as needed per
the specifications and with the approval of the Department
of General services.
Validity of Permits
21. In the event permittee violates or fails to comply with
any conditions of approval of this permit, no further per-
mits, licenses, approvals or certificates ot occupancy
shall be issued until such violation has been fully
remedied.
22. Within ten days of Planning Oivision transmittal of the
Statement of Official Action, project applicant shall sign
and return a copy of the statement ot Official Action pre-
pared by the Planning Division, agreeing to the Conditions
of approval and aCknOWledging that failure to comply with
such conditions shall constitute grounds for potential
revocation ot the permit approval. By signinq same, ap-
plicant shall not thereby waive any leqal rights applicant
may possess regarding said conditions. The signed State-
ment shall be returned to the Planning Division. Failure
to eomply with this condition shall constitute grounds for
potential permit revocation.
23. This determination shall not become effective for a period
of fourteen days from the date of determination, or, if
appealed, until a final determination is made on the ap-
peal. Any appeal Dust be made in the form required by the
Zoning Administrator.

1. The Santa Monica Police Department shall not be restricted
in access to any private party areas or to the upper level
room containing billiard tables.
2. No person under 21 years of age shall be allowed in the
bar and dance floor areas and signs shall be posted to
this effect.

closing hour.
4. The owner shall provide for designated types of beverage
dispensers which will clearly distinguish alcoholic
beverages from non alcoholic beverages.
5. Alcoholic beverages shall only be served between the hours
of 10:00 a.m. to 12:00 a.m.
6. Signs shall be posted in conspicuous locations advising
patrons that alcoholic beverages shall not be sold unless
proper identification is displayed.
7. A security and operations plan shall be approved by the
Chief of Police prior to issuance of a business license.

9. The owner shall control noisy patrons leaving the
restaurant.
10. The use of the premises for sit-down meal service to

1 0 Scope of the Srudy
.
The scope of IM)rk performed IS as follow;:
1) Ambient nOlse v.a.s measured at the extenor of the eXlStlng SHe at tlM)
locatIons. on the west SIde of the butldmg faCing the TIllrd Street Promenade.
and on the east Side of the bulldmg facmg the alley behmd the bUlldmg
2) The data collected in the fIeld was analyzed to determme the ambient nOIse
levels.
3) The Ambient conditions for the measurement days -v.ere prepared for
presentation In a graphIcal manner.
2.0 ~OJse MfO.asurement
Ambient nOise was measured at the site for a cumulatIve penod of 11 days from
October 5 to 16. Measurements at the ThIrd Street Promenade locatlon were
perfonned from October 5 to 10. Measurements at the alley location were performed
from October 5 to 6 and from October 8 to 16 Three hours of data on October 12
(Fnday) from 8:00 am to 11.00 am was not recorded,
Measurements v.ere made With tv.o enVU"onrnental nOIse measurement systems
manufactured by Larson DaVIS Laboratotles. The ThIrd Street Promenade
measurements \\ere made With a s}Stem consISting of a Bruel & Kjaer type 4155
mIcrophone, a Larson DaVIS microphone pre-amphfler, and a LDL model 700
dOSImeter 10 conJUnctlon v.1th an Epson computer (for data storage). Alley
measurements were made \\11th a Bruel & KJaer type 4176 microphone, Larson Davis
microphone prewarnphfler, and a LDL model 870 envrromenlal nOIse measurement
system whIch has bwlt 10 proVISIOns for data storage
3.0 Results
Three ambient nOIse values were measured and recorded for every hour of
measurement. They are:
1) Leq The "Average" nOISe level expenenced 10 the particular hour of
measuremem
2) Lmm The nl1rurnu.l11 nOise level expenenced In the parncular hour of
measW"ement
3) Lmax The ma.xl.I11U..1TI nOIse level expenenced In the partIcular hour of
measlZe'TIe:lt
All three are A-welghted sound levels 10 dB re 2 x 10-5 N 1m2
These three values are plotted for every hour of measurement 10 Figures 1 through
17 Leq, Lmm. and Lmax are sho'Wn as three mdependent curves on each graph
represennng one d~y of measurement

Dear Mr. Berlant:
The hearing on the appeal from the above CUP granted by
the Planning Commlssion 1S set for September 25, 1990. The City
Staff lssued a report ("Report") to the Mayor and Clty Council for
the July 10, 1990 meeting, which I believe should be modified in
two respects.
Page 3 of the Report states that "on several recent
proJects involving restaurants with bars, no alcohol may be served
ln the bar after midnlght, but alcohol may be served ~n the dining
room after midnight." Although the llst of previously approved
establishments serving alcohol and their hours of operatlon
submitted as part of the Report does show that some different
restrictions were placed on the serving of alcohol, the general
statement ln the report is incorrect. Only two of the seven listed
prlcr approve~ establishments prohibit the =~rvice of alcohol in
bar areas after midnight. One of these establishments, the "L.A.
International Culinary Institute" is the type of operation in which
the restriction is meaningless. As to "Teasers Restaurant", the
other prior approved operation restricted, the operator is
nevertheless permitted to operate the dance floor area until
2:00 a.m. on Friday and Saturday, contrary to the restrictions
placed on my client. All other restrictions on all other operators
permit servinq of alcohol at least unt~l 1:00 a.m.. with the
maioritv hav1ng no restrictions, and my clients direct competitor
"Yankee Doodle" beinq permitted to operate and serve alcoholic
beveraaes until 2:00 a.m. seven (7) davs a week. I believe it is
only fair for the City Staff Report to-present a complete factual
summary rather than the conclus~onary statement now contained in a
-report.

Secondly, although the Report states that the appllcant
1S requesting a clarification of the number of seats as opposed to
"persons'. spec~fied in the prlor Staff Report to the Planning
commissioner so that a forty-elght (48) seat restaurant, twenty-
four (24) fixed seat bar and eighty-two (82) seat dance floor, and
although 1t was my understanding that the staff would clarify this
matter and recommend such a change to the Clty Council, 1n the
"Recommendation" portion of the Report no reference Vihatsoever is
made to this matter.
I would appreciate both of these matters being clarified
to the c~ty Council 1n an amended report for the September 25, 1990
hearing.
