BACKGROUND The State Department of Housing and Community Development (HCD) has completed its review of the City's Draft 2000-2005 Housing Element. In undertaking this review, HCD considered the 2000-2005 Housing Element that was conceptually approved by the City Council on April 24, 2001, supplemented with proposed revisions prepared by City staff in response to previous comments provided by HCD. These proposed revisions are attached to the December 11, 2001 staff report as Attachment D. In a letter dated December 3, 2001, HCD indicates that the element will be in full compliance with State housing element law (Article 10.6 of the Government Code) once adopted and submitted to HCD for certification. (Attachment A) BUDGET/FINANCIAL IMPACT The recommendation presented in this report does not have a budget or fiscal impact. November 13 and 26. 2001. AB you know, we are required to review draft housing elemerits and report our findings to the locality pursuant to Government Code Section 6SS8S(b}. Our rcMcw was facilitated by a series of telephone conference caI1s. cnlminaring in a telephone conference call with Ms. Laura Beck and Messrs. Bobby Ray, Barry Rosenbaum and Jay Travino, of the City's staff on November 28, 2001. This letter summarizes the conclusions of the November 28, 2001 telephone conversation. Pursuant to Government Code Section 65585(c), this Department has also considered comments about the City's housing element from Mr. Christopher Ranting of Harding, Lannom, Kntchcr and Kozal. The current revised draft element addresses all of the statutory requirements identified in our August 3, 2001 review. The element will be in full compliance with State housing element law (.Arlicle 10-6 of the Govemmmt Code) once adopted and submitted pursuant to Govcmment Cod(: Section 65:585(&). Thw;, any change to the existing regulati~ns to residential developtnem in Santa Monica, such as lowering the threshold for deve1opm.c:nt review permits for residential development in commercial zones, will mquire the housing element he amended to analyze the impacts of its land-use regulations upon the maintenance, improvement and development of housing fur all income levels in Smta Monica., and the amendment will need to be submitted to tills Department for our review. The City should analyze not only 1he individual impacts of each regulation that could potentially constrain the maintenance, improvement, and development of housing,. but also the cwnulative impact. The failure to amend the element to addn:ss changes to the City's residential development regulations would jeopardize Santa Monica's compliance with housing element law. The City and its staff are to be commended for their diligent efforts to revise the element to complywitb State housing element law.
