Recommendations for Public ~ccess and Improvement Requirements
for Development Projects
INTRODUCTION:
This report recommends that Article VII be amended to reqU1re access and
1mprovement requirements on publlC streets and alleys as a condit1on of
development.
BACKGROUND:
In Santa Monica all development projects which require zone changes, conditional
use permits, or other discretionary approvals are requlred by the Planning
Comm1ssion and/or Architectural Review Board, and/or the City Council, to
make certain lmprovements 1n the public streets and alleys that are adjacent
to the development. There are no requirements 1n the Mun1cipal Code for
these improvements for projects which do not require dlscretlonary approvals.
As an example, if a developer wishes to build a multi-story office building
on any street which is currently zoned for such a bUlld1ng, there are no
requirements for replacement of sub-standard sidewalk, curb rad1i, lnstal-
lation of wheelchair ramps, installat10n of street trees, alley pavlng, or
sim1lar improvements that may be necessary to serve such a bU1ld1ng. Many
cities have such ordinance requirements; these include Los Angeles,
Manhattan Beach, He~osa Beach, and Laguna Beach.

RECOMt~ENDATI ON:
The Staff recommends that ordinance changes be adopted which will make
such improvements a requirement and a condition of the development
permit. It is recommended that the City Attorney be instructed to
prepare similar ordinance modifications to provide for access and
i~provement requirements as shown ln the attached sample ordinance.

25.53.002 ApplicabilIty. The followmg access and improvement
requirements shall apply In all zones unless specIfically exempted by other
approvals of subdivlSlons, land dIvISIOns. condItIonal use permIts, variances,
deSIgn review, preCIse street plan lines or unless specIfically waived by the
CIty council where theIr applicatIon would cause hazardous or other
undeSIrable sItuatIons. When apphed to currently developed property, If
additions or alterations exceed fIfty percent of the eXIsting population
denslty or intensity of use, these standards shall apply as if the construction
were on vacant property. (Ord. 832 ~ 31, 1975 Ord. 812 ~ 1 (part), 1974).

25.53.004 Vehicular access. (A) For defimtions of "access," "street"
and "usable vehicular nght-of-way of record" In relatIOnshIp to a "lot or a
legal buIlding site," refer to Chapter 25 08, "DefinitIons and Standards."
(B) There shall be safe vehIcular access from a "usable vehIcular
nght-of-way of record" to off-street parking facilIties on the property
requmng such faCIlItIes.
(e) Vehicular access to lots frontmg on artenal and pnmary reSIdentIal
collector streets shall be such that there shall be a paved turnmg area on the
lot or device to permIt motor vehicles to head into the street, as approved by
the CIty engIneer. (Ord. 812 ~ I (part), 1974).
25 53.006 Access and street improvements To proVIde proper access for
the users and to prevent congestIOn and other hazards related to the use of
the land penmtted in the apphcable zones, the followmg improvements are
deemed necessary and must be proVIded by the property owner prior to the
publIc utditIes beIng authonzed permanent connectIon and occupancy being
permItted:
(A) Alleys shall have been Improved along the full alley frontage of the .
subject lot to the standards approved by the CIty engineer
(B) Curbs, gutters and SIdewalks shall have been installed along the full
street frontages of the subject lot to the standards approved by the CIty
engIneer.
(C) Street base and pavement along the full street frontage of the

safely blend the configuratIon of existmg improvements WIth the above

water In natural dramage courses, or WIthin streets or other pubhc

25.53.01 0 Underground utilIties. All utilIty connections shall be
undergrounded WIthIn the subject property to the standards approved by the
CIty engIneer and other appropnate agencies, from the nearest eXIsting
off-site utIlIty pole, structure or serVIce (Ord. 812 S 1 (part), 1974).

25 53.012 Trash and storage areas. Areas for trash and outdoor storage
shall be proVIded on each property Such areas shall be deSIgned to conceal

25 53.016 Relocation or repau of existmg improvements. Where
necessary due to development on private property or due to the applicatIOn
of these improvement reqUIrements, the CIty engIneer may reqmre the
relocatIon of, repaIr of, or Improvement to, eXIstIng publIc lITwrovements
and facIlIties, as may reasonably be affected by the proposed development
Said relocatIOn, repaIr or Improvement may mclude, but shall not be limited
to, streets, curbs, gutters, SIdewalks, dramage and sewage facIlItIes, street
lIghts, street SIgnS, publIc utility hnes and poles, traffic SIgnals, street trees
