Ordinance Adding section 9l48G to the Santa
Monica Municipal Code Relating to Conditional
Use Permits
On December 9, 1986, the city Council directed the City
Attorney to prepare an ordinance which allows certain uses of
property which are consistent with the Land Use Element of the
General Plan, but are prohibited by the existing Zoning
Ordinance, to be subject to the discretionary review of the
Conditional Use Permit process.
This can be accompl ished by
adding Section 9l48G to the Santa Monica Municipal Code. The
accompanying ordinance has been prepared and is presented to the
City Council for its consideration.
Certain problems have arisen because of the discrepancies
between the current Land Use Element of the General Plan and the
Zoning Ordinance. These discrepancies will be eliminated by the
new Zoning Ordinance. However, until the new Zoning Ordinance is
adopted,
the above-mentioned addition to Section 9148 is
necessary to provide a mechanism through which certain uses
permitted by the Land Use Element but in conflict with the
existing Zoning Ordinance could be considered and approved by the
Planning commission.

afford adequate ~tection against inapprop~te projects being
approved.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be introduced for first reading.
