On May 3, 1988 the City council directed staff to revise the Fourth Draft of the proposed Zoning Ordinance and return by July 5, 1988 with the revisions. As part of the city council's review of the Fourth Draft, a number of issues were identified to be studied. In order to meet the the schedule set by the Ci ty Council, some of the issues could not be addressed in the Fifth Draft. The attached list outlines those issues staff intends to address within six months after the Ordinance is adopted: Within the Fifth Draft, changes requested by Council are reflected in strike-out and bold face type. Proposed new text is indicated in bold and text proposed to be deleted is indicated in strike-out. In addition to the changes requested by the Council, the Fifth Draft contains modifications requested by the City Attorney for legal consistency. With the exception of the areas listed above, staff has attempted to incorporate all the revisions requested by the City Council. - 1 - f3-~ JUN 2 8 1988 However, one provision that has not been changed is the prohibition of second dwellings in the Rl District. Notwithstanding the City Attorney's opinion that the language should be removed, the provision has been retained in the Fifth Draft. As part of the adoption process of the final zoning ordinance, it will be necessary for the City Council to adopt a transition ordinance to implement the new Code, and certify the environmental documents. Both these items will be distributed to the City council at a later date. To facilitate review of the Fifth Draft, staff recommends the Council focus on substantive policy issues in lieu of reviewing the document page by page. We would suggest this procedure during Council Council deliberations in order to facilitate completion of the public hearing and adoption of the Ordinance. BUDGET/FINANCIAL IMPACT The recommendation presented in this report does not have any budget or fiscal impact. This threshold will determine if the expansion will be subject to a CUP or performance standard permit. o Refer changes in the FAR on Main street to the organizations representing Main street. o study prohibition of curb cuts when traffic must turn left I into project. o Study to determine total amount of fees required for commercial development. o study elimination of the replacement housing requirement associated with demolition permits. o Prepare incentives to encourage preservation and new construction of service stations. o Prepare performance standards for existing auto repair uses. o Revise Site Review process and criteria for approval. o Survey number of existing auto storage and sales lots that would be required to be removed within the proposed five year amortization period. - 1 - o study to determine if FAR bonus devoted to residential uses would impact parking in the Downtown District. o Explore alternatives and incentives to encourage affordable housing to be developed in the C3C District. o Develop list of automobile repair activities that have the potential of creating environmental problems. o study the problems associated with the conversion of existing muti-family units to transient uses in the R4 District and develop alternatives to preclude this type of conversion. o Discuss as separate matter permitting parking structures in the R4 District. o Revise purpose statement in all commercial districts to reflect Council action to downzone. - 2 -
