Sections 9300 through 9314 of the Santa Monica
Municipal Code are repealed.

ments as may be proposed for dedication

denial of tentatlve maps and t~e approval
or denlal of extensions.
(c) 7he City Councl1 shall estab-
lish by resolution reasonable fees for
the processlng of maps and for other
procedures required or authorized by thlS
Chapter or the Subdivision Map Act.

Deletl.ng Section 9390 of the Santa Mon1ca Munlcipal
Code.
Introductl.on
The purpose of this report l.S to recommend an ord~nance amendment
to elimlnate a confl1.ct between the Subd~vislon Ordinance and the
Zonl.ng Ordlnance regarding m1nlmum lot Slze for subdivisions.
Th1.s conflict in regulatl.ons dlrectly affects the processl.ng of
"
two appl1catlons pend1ng before the Plannl.ng Commlssion.
Background
In connection w1th the reVlew of two parcel map requests recently
submitted to the Plannlng and Zoning Divisl.on, an apparent con-
fllct In regulat10ns has emerged.
The Subd1Vl.S10n Ordlnance con-
talns a provls1on (Section 9390) Wh1Ch prohlbits the subdlviSlon
of a property containl.ng a lot with less than 50 feet of frontage
or 5,000 square feet of net area.
In contrast, the Zon1.ng Or-
dlnance prescrl.bes a varlety of lot Slzes whlch vary from Dl.S-
tr1.ct to Distrl.ct.
The C1ty Attorney has adv1.sed staff that the
m1n1.mum lot Slze contalned in the Subdivlsion Ordinance is an
absolute standard, not subJect to variance procedures for lot
size as set forth in the Zoning Ordinance (Sectlon 9145A3).
Even though the 5,000 square foot subdl vislon lot size standard
lS reasonable for general Cl.ty-wide appllcatlon, there are oc-
caSlonal
si tuat1.ons where consl.deration of subdl. Vl.Sl.ons not l.n

mechanism.
Therefore Section 9390 in the Subdivision Ordinance
prohlbits any consideratl.on of unusual circumstances.
Examples
Revlew of lot Slzes throughout the Cl.ty reveals that there are
several areas J.n which many of the lots are less than 5,000
square feet.
The Ocean Spray Tract 1S an example.
An applicant
may argue reasonably that dl.Vldl.ng a large parcel that is not
qUlte 10,000 square feet lnto a 5,000 square foot lot and a 4,672
square foot lot may be consistent with the maJorl.ty of other
propertles In the zone and would represent a reasonable way to
develop the property.
Ms. Haidy McHugh has requested such consideration of her proposal
to subdJ.v1de the lot at 601-613 Pac1.fic.
Or1g1.na1ly the lot had
been subdlvlded lengthw1.se (east/west) l.nto a 40 x 141 and a 30
xl41 lot.
Subsequently Tract Map 37912 was approved and recorded
for subd1vlsion 1n connectlon wlth a seven unlt CondOMl.nlum proj-
ect.
Ms. McHugh I s request would revert the subdi V1S1on to two
parcels wJ.th the lot line runnlng north/south.

deleted 1.n its entlrety, on the bas1.s that m1.nlmUm lot size stan-
dards are more approprl.ately located ln the Zoning Ordlnance
where they currently are specifled, and on the baS1S that the
absolute standard contained ~n Section 9390 prohl.blts consider-
atlon of occaSlonal s1.tuations where tentative subdivislcns for
lots less than 5,000 square feet In area may be appropriate.

The recommendatlon presented ln this report does not have a
budget/financial lmpact.
Recornmendatlon
Staff recomrnends that the Clty Councll dlreet the City Attorney
to prepare an ordl.nance deleting BeetlQn 9390 of the Munlclpal
Code and set the matter for public hearlng at the next posslble
counc1.l meetlng l.n order to eliminate the confllct between the
Zonlng Ordlnance and the Subdlvision Ordl.nance noted above.
