ThlS report transffilts for relntroductlon a regular ordlnance
establlshlng a ~laln Street Speclal Cornmerclal Dlstrlct and
reclasSlfYlng C-4 zoned propertles In that dlstrlct to "CM."
BACKGROUND
A regular ordlnance establlshlng the Mdln Street Speclal
Co~erclal Dlstrlct and rec12sslfYlng all C-4 zoned propertles
In that dlstrlct to "Ctl" was lntroduced by COUDC1I as Item 8A
at lts August 12, 1980 meetlng and was a~ended and adopted In
emergency form at that tlme. The ordlnance reflects a plan for
that dlstrlct agreed upon by the ~aln Street Plannlng Commlt~ee,
a group representlng local merchants, property owners, and
resldents.
The ordlnance was amended by Council as follows:
1. The subsectlons of Sectlon 9119C3a were rearranged so
that the "conputatlon/dlmenslon/drlveway" provlslon for front
yards precedes the speclflc requlrements for each of the sub-
dlstrlcts.

2. Sect~on 9119C3c(1) (a) and Sect~on 9119C3c(2), relat~ng
to rear yard requ~rements for Cm-2 d~strlct, east slde of Maln
Street and CM-2 dlstr~ct, west slde of f'laln Street, respectl vely,
were revlsed to refine the language and clarlfy the ffilnlmum rear
yard requlrement for the flrst floor of a two story structure.
~~ere the flrst floor exceeds Dlne feet In helght, or wlth
respect to any two story structure on the east slde where the
flrst floor 15 not fully enclosed, the mlnimum requlrement lS
flve feet.
3. Sectlon 9119C9 lncludes a provlslon that eXlstlng uses
shall count toward the total number of bars and restaurants
permltted wlthln the dlstrlct.
4. Sectlon 5 of the ordlnance was amended to deflne the
parameters of the Cj\1-2, CM.-3, and C~1-4 dlstrlcts.
The emergency ordlnance was publlshed before the language
clarlfYlng the rear yard requlrement could be worked out. ThlS
proposed ordlnance contalns that clarlflcatlon.
Moreover, Slnce the adoptlon of the emergency ordlnance, an
amblgulty between two prOVlSlons of the ordlnance was reallzed.
Due to an apparent lnconslstency between Sectlon 9119B2o permlttlng
medlcal and dental cllnlcs or laboratorles and Sectlon 9119B4a
requlrlng flrst floor uses to be "publlC lnVl ted" establlshnents,
Sectlon 9119B2o has been revlsed to allow laboratorles above the
flrst floor only. Slnce resolutlon of thlS amblgulty requlres a
substantlve amendment to the ordlnance, the ordlnance must be
relntroduced.

ALTERNATIVES
As an alternative to relntroductlon of the regular ordlnance,
the Counc~l may adopt the regular ordlnance wlthout the amendment
relatlng to medlcal and dental laboratorles and thereafter
lntroduce a separate ordlnance wlth the approprlate amendment.
RECOMMENDATION
It lS respectfully recommended the Counell relntroduce the
regular ord1nance as aBended establlshlng a Ma1n Street Speclal
Commerclal Dlstrlct and reclasslfYlng all C-4 zoned propertles
In that dlstrict to "cr-1. II
