'-I{J~ -/)()'d.-tJ I (8 2 8 1989 Santa Monica, Californla CPD:PB:DKW:bz Council Mtg: February 28, 1989 TO: Mayor and City Council FROM: City staff SUBJECT: Ordinance for Introduction and First Regarding Modification of Section 9023.7 of Ordinance Regarding Restaurants in CM District Reading Zoning INTRODUCTION This report recommends that the City council introduce for first reading an ordinance modifying the regulations of the Main Street Special Commerical District to allow a fifth restaurant on Block 6 of Main street and to prohibit new restaurants on Main street. This matter was considered by the Planning Commission on February 15, 1989 and recommended for approval by the Commission. BACKGROUND On January 10, 1989 the City Council directed the city Attorney to prepare an ordinance to permit a fifth restaurant in the 2500 block of Main street and to prohibit new restaurants in the CM District on Main street. A copy of the Council staff report is attached as Exhibit A, and a copy of the Council minutes for this item is attached as Exhibit B. A copy of the proposed ordinance is attached as Exhibit C. - 1 - ~-~ ~ l n "j...;~ . '.. . . Under the eM regulations, restaurants may not exceed two per block, unless such restaurants pre-dated the creation of the eM district. Restaurants were limited based upon concerns with potential adverse parking, noise, traffic and land use impacts associated with an excessive number of restaurants on the street. Under the CM regulations, the Main Street I'blocks" were treated similarly, regardless of their length. The 2500 block is, at 1,098 feet, the longest on Main street and al ready has more than two restaurants. The proposed ordinance would allow an additional restaurant at 2510 Main street on this block. with the exception of the restaurant at 2510 Main Street, the proposed ordinance would prohibit any new restaurants on Main street pending a review of the entire CM District regulations, which is scheduled to be completed prior to January 1990. CEQA STATUS The proposed Text Amendment is categorically exempt from the provisions of the California Environmental Quality Act, Santa Monica Guidelines for Implementation. Class 5(12). BUDGET/FINANCIAL IMPACT The recommendation of this report would have no budget/financial impacts. - 2 - . . RECOMMENDATION It is recommended that the City reading the ordinance set forth following findings: Council introduce in Attachment C for first with the FINDINGS 1. The proposed amendment is consistent in principle with the goals, objectives, policies, land uses and programs specified in the adopted General Plan in that it allows an additional restaurant on the longest block of Main street, providing more equitable treatment as compared to other areas of Main street, and in that through the proposed temporary probibition of new restaurants, it will provide for a reasonable planning period in which to evaluate and develop regulations for other new restaurants on Main street which may, given location, size, or other characteristics, have potential adverse effects on the community: 2.
