SUBJECT: Proposed rezonlng of certaln areas from M2 Industrlal
to C4-A Cornmerclal.
Introductlon
This report forwards to the Clty Councll the Plannlng Commisslon's
recommendatlon on the proposed rezonlng from M2 Industrlal
to C4-A Llffilted Hlghway Commerclal of the area surrounding
Pennsylvania Avenue currently occupled by the Hlgglns BUSlness
Park and the area bounded by Twenty-slxth Street, Olymplc
Boulevard I Cloverfield Boulevard, and Colorado Avenue currently
occupied by SDC and Vlsualtek. The proposed rezonlng does not
affect the Greenwood proJect slte or the Papermate property.
Background
In adoptlng lts resolutlon of lntentlon to amend the comprehenslve
land use ordlnance (Resolutlon 6385 CCS), the Clty Council
lncluded the Commerclal and Industrlal Development Task Force
recommendatlon that the above referenced areas be rezoned to
C4-A from its current M2 deslgnation. The Task Force's lntent
ln making this recornmendatlon to the City Councll was twofold:
1) to have the proposed zoning conform to the prevalent
eXlstlng use of the property In the area and 2)
to allow some
commerclal offlce development In the lndustrlal corrldor but
to concentrate that development ln a Ilmlted area that appeared
approprlate. This recommendatlon was made In conJunctlon wlth
the recornmendatlon by the Task Force to limlt offlce development

in the industrlal zones to only that needed to support an lndustrlal
or manufacturlng establishment thus prohibiting general cornrnerclal
offices ln the lndustrlal dlstrict. Based on a v1sual survey
of the lndustrial corrldor, this area seemed to be an approprlate
area ln WhlCh to focus comrnerclal office development since
much of the existing development appeared to be offlce buildings.
Planning staff recommended that the CA Commerclal Admlnistrative
dlstrlct be consldered rather than C4-A thus reduclng the varlety
of retall uses permltted WhlCh appeared to be a zoning
classiflcatlon that better met the Task Force's intent to
reserve the area for offlce development.
The Plann1ng Commission held a publlC hearlng on the matter on
February I, 1982, at which three affected property owners spoke.
Component Research, SDC, Visualtek, Ponder and Best, and V1v1tar
are located on these properties. Two owners obJected to the
rezonlng Slnce the eXlsting businesses are industrlal
(Component Research lS lnvolved ln assembllng capacltors and
SDC and Vlsualtek perform some manufacturing of varlOUS products
from time to tlme), and clalmed that the rezoning would restrict
the abillty of these buslnesses to possibly expand. One property
owner representlng Ponder and Best and the Vlvltar distribution
faCll1tles approved of the proposed zone change only lf It dld
not affect the use of hlS property.
The owner of the Gemologlcal Instltute of Amerlca, the remaining
affected property, dld not appear at the hearlng.

The Planning Commisslon approved a motlon by a vote of 7 yes
and 0 no to recommend against the proposed rezonlng because
the area seemed to contain industrial rather than office
uses. Several CommlSSloners felt that the area was prlmarlly
lndustrial and not offlce in nature, desired to preserve the
lndustrlal uses ln the industrlal corrldor, and deslred to
have the office-style building design and the park-llke setting
of the Higgins BUSlness Park be extended to other new lndu5trial
and manufacturlng development ln the lndustrial corrldor.
Alternatlves
Under Section 9149 governlng zone changes, the C~ty Council may
accept or reJect any recommendation of the Planning Co~mlSSlon
regardlng a proposed change but if a dlfferent actlon 1S
consldered a new Public Hearlng must be held glving the same
publlC notices as before.
Recommendatlon
It 15 respectfully reco~ended that the Plannlng Commission's
action be afflrmed and the proposed rezoning be denled.
