24-25, 1999, a speaal municipal election was held in the City of Santa Monica for fhe purpose of elect~ng one member to the Santa Monica City Councd to fill an unscheduled vacancy with a term ending November 2000 The City Counc~[ also placed one measure, a charter amendment. on the ballot requinng a ma~onty vote of thos~ voting in order to pass The measure placed on the ballot read as follows PROPOSITION I Shall Santa Monrca C~fy Charter Secfion 1806(b) be amended to prowde that a fenant in a controlled renta! unrt cannot be evicted unless fhe tenant has comm-tted a matenal and substantral vro/ation of the lease whrch the landlord has not waived or otherwrse lost the legai nghts to use as the basrs for an evrctron~ BACKGROUND On September 25, 1998, Councilmember Asha Greenberg tendered her resignation from the City Counci] due to moving her residence outside of the City boundaries At its regular meeting of October 13. 1998, the City Council accepted Councilmember Greenbe~g's resignation and declared her seat vacant Section 603 of the City Charter provides for fdling of any unscheduled vacancy on the Council by appointment within MAY 1 1 ~ggg 3A thirty days after the office is declared vacant and, that if not fdled, a speaal elec#ion be called to fill the vacancy The City Council d[d not fill the vacancy w~thin th~rty days and on December 22, 1998, adopted a resolution calling a special election to be held over a two-day period on Saturday and Sunday, April 24-25, 1999 Although the City usually consolidates a61 its special and regular elections with Los Angeles County ~n order to encvurage hrgh voter turn out and to minrmize costs. because the date the special election was scheduled was off-season, consolidation with the County was not possible In addition, because of the unprecedented nature of holding a two-day, weekend, stand-alone election in the City, the City Clerk was directed to use all means avadable and necessary to ad~ertise the election ELECTION RESULTS For this election there were 54,156 registered voters in the City There were seven candidates on the ballot for the Councd vacancy Candidate Richard Bloom received a ma~onty of 7,848 votes that equaled 54 0% of the fotal ballots The charter amendment passed with a total of 10,231 equaling 71 8% of the vote The number of ballots tallied was 14,869 Out of that number 5,183 were absentee ballots (with a few pro~isior~al included) and 9,686 voted at the polls for a final 27 5% turnout of ~ofers R~PORT ON TWO-DAY WEEKEND ELECTION Precinct Workers Staff was prepared to have difficulties recruitmg precinct workers that would agree to work both election days and/or work during a weekend Staff was gratified to secure, within a reasonable time, poll workers who committed to work both days In addition, staff had a waiting list of ~ver 100 people that were willing to be precmct workers On the days of the election there were the expected worker cancellations due to unforseen even#s However, staff was able to substitute workers quickly and all the preancts were stafFed as planned ~ Precinct workers attended a mandatory 90-minute training class on the procedures established for the two-day election and on the process for securing the "hve" (~ofed) and unused (unvoted) ba1[ots at the end of the day on Saturday Pollinq Sites The County precincts were consolidated from 66 into 34 City preancts Although stafF made every effort to utilize the polling sites used by the County m previous elections, fifteen of the sites were not available for the entir~ two days and were not available because of the weekend Sfaff was dingent in secunng thirteen conventional (residences, schools, ho#el lobbies, etc ) polling sites to replace t~ose that were unavailable. except for two Out of this necessity arose the concept of using two coffee shops as pollmg s~tes Based on the comments recei~ed by staff, the use of the two coffee shops as polling sites was a no~elty and appears to have been beneficial A number of inembers of the public called our office prior to the election to express concerns regarding, and/or to protest #he change in polling places The callers were understanding once staff explained the reasons for the changes Staff prowded pollmg site location information continuously ~ia the telephone during the last two weeks before the election and from 7 00 a m, to 7 00 p m, the Friday before, and on Saturday and Sunday of the election Precinct boards were provided with a city-wide polling site map to assist them in directing voters to their appropnate polling place After the end of the absentee votmg period on March 26`h and through 7 00 p m, on Sunday of the election, staff pro~ided home delivery and pick-up ser~ice of ballots to a number of indi~iduals physically unable ta go vote at the polls Student Worker Proqram The three local high schools. Samohi. St Mon~ca's. and Crassroads. were in~ited to participate in the Student Precrnct Worker Program The requirements for students wishing to participate were that they be U S citizens, seniors with a minimum of 2 5 3 grade point average and that they attend a precinct worker training class At the outset twenty-one studen#s signed up to partiapate However, for vanous reasons sixteen students canceled and five students worked on Saturday and Sunday of the election Reports from the Precinct Inspectors where the students were assigned indicate that the students performed their duties in a competent and efficient manner The students were paid the same stipend as the precinct clerks, $50 for the first day and $75 for the second day Advertisinq Staff advert~sed the election in various ways !n coordination with the School District, notices were sent home one week before the election with elementary, middle, and high school students not~fying voters of the election and remmding them to vote Six banners were placed at ma~or intersections throughout the City from April 5-25, 1999 Fifteen panels were placed on the outside of the Big Blue Buses from March 8-2fi, 1999, adver#ising the deadlme ta register to vote, and from A~ril 5-25. 1999, remmding people to vote on the election days Staff included notices in Our Trmes, Seascape and ~n the Rent Control News, as well as on the City's Webpage and on CitylV During the Santa Monica Fest~~al on Apnl 17, staff hired an indi~idual to dress as "Uncle Sam" walking on stdts who drstnbuted sun visors advertising the election to attendees ~inally, after voting at pollmg sites, voters were gi~en red penals inscribed with I voted at the Apn124-25. 1999. Santa Monrca Special Munrc~pai Elecflon~ Saturday and Sunday The opening and closing of the polls was uneventful on both days The turn out was a total of 4.950 mailed absentee ballots, 4.571 votes cast on Saturday, 5.115 votes cast an Sunday. and 233 absentee/provis~onal ballots from the ~olls Staff visited every pol[mg site on Saturday to assist the precinct boards, mon~tor the process. and answer questions related to the two-day procedure 4 Staffs most pressing concern, afso voiced by members of the public, was secunty of the ballots voted on Saturday Precinct inspectors were instructed to return to City Hall after the closing of #he palls on 5afurday, with the voted ballots in a sealed box, and hand them into the custody of the elections official The pol~s closed at 7 00 p m By 8 30 p m, all 34 precincts had reported ~n with the voted ballots in a sealed contamer, as well as absentees dropped off at the precinct and pro~isional ~otes received, in a sealecf envelope The contamers were stored m the City Clerk's vault The combination to the ~ault was changed on Friday, the day before, and was known only to the elections staff The ~ault was then locked and a Sheriff's Deputy stood guarc€ overnight until 8 00 a m, on Sunday morning when staff returned The sealed boxes remained m the ~ault unt~l 7 00 p m, Sunday, and were then escorfed by a an elections warker and a Police Officer to the central caunting area in Councd Chambers to process for counting Countinq of Ballots A total of 6,150 applications for absentee voting were received and the same number of absentee balfots was issued for this election Out of this number, 4,835 absentee ballots were returned by voters by the end of the day Saturday. April 24, 1999 The Absentee Canvass Board processed (prepared for counting) the absentee ballots received by mad on Friday and Saturday The absentee ballots that were dropped off at the polling sites on Saturday were processed on Sunday and mtegrated with the mailed-m absentees These were the first ballots to be counted by the computer immediately after the polls closed at ~ 00 p m, on Sunday Whi1e the absentee ballots were being counted elections staff opened the sealed boxes contaEning ballots voted on Saturday, prepared them for the computer, and were counted next The third and final count on Sunday was the "hve° ballots voted on Sunday and deli~ered by the precmct inspectors to the central counting place The last precinct reported in at approximately 9 30 p m, and the counting was finished by about 10 00 p m ; There were 233 remaining pro~isronal and absentee ballots after the final count on Sunday They were a combination of provisional ballots voted on Sa#urday and Sunday, ar~d absentee ballots dropped off at the polls on Sunday Final count of these ballots was campleted on Thursday, April 29, 1999 TELEPHONE SURVEY REPORT As it has been portrayed by the news medfa, this is the first two-day weekend election that has been held in the State of CalFforrna and in the nation, m modern times Because of its uniqueness, staff contracted with Paul Goodwin, of GLS Research. to conduct a post-election telephone survey The findings and summary are attached as Exhibit B The report concludes that were the City to switch to a two-day weekend election. it might increase turnout among ~oters ieast iikely to participate during elections held on Tuesdays, including younger ~oters, mmorities, renters, and non- partisan voters Conversely, such a practice might impact a large block of more frequent voters for whom a weekend election would be incon~enienf or less convenient, or who would be concerned about cost issues The survey included a question about an all-mail ballot After being informed of the benefits of an all-mad baliQt, including cost-savings and mcreased voter participation. 69% of the voters were in support and 24% opposed RECOMMENDATION It is respect~ully recommended that the City Councd adopt the resolution certifying the canvass of the votes cast at the special muniapal election Prepared by Maria M Stewart, City Clerk Beth Sanchez, Assistant City Clerk Attachments Resolufion 6 EXHIBITA RESOLIfTiON NO 9390 (CCS} (C1TY COUNGL SERIES) RESOLUTION OF THE CITY COUNCIL OF ~HE CITY OF SANTA MONICA ACCEPTING THE CITY CLERK'S OF~ICIAL CANVASS AND OFFICIAL STATEMENT OF VOTES CAST FOR THE SPECIAL MUNICIPAL ELECTION HELD ON APRIL 24-25, 1999, AND DECLARING TH~ RESULTS THEREOF WHEREAS, a Speaal Municipal Election was hefd m the City of Sante Monic~ on Apnl 24-25. 1999. for the purpose of filling an unscheduled vacancy on the C~ty Counc~l and to place a rneasure on the ballot, and WHEREAS, the provisions of the Electrons Code of the State of California for the holding of e~ections in Charter cities were complied w~th and notice of the election was g~ven in the time. form and manner as provrded by law. voting precincts were properly estabhshed. election o~cers were ap}~ointed. votes were cast, received and canvassed, and the returns were made and declared in the time, form and manner as required, and WHEREAS, the Santa Mo~~ca C~ty Clerk canvassed the returns of the election and certrfied the results to the City Counal, and those results are attached and made a part hereof as "Exhibit A." However, if an insufficient number of volunteers are available from that hst to serve a particular pro~ect, the Crty may assjgn any qualified employee(s) who are willing to work such pro~ect. The Police ~epartment shall supply the necessary two-way radio communication between the employee and the Police Station and transportation from the station to the filming site. Subject to the provrsions of this Section, the admmistration of this program shall be performed by the City at its discretion and this Section shall be promulgated as Police Department rules and regulations Employees who are given filming assignments shall receive a bonus of 550.00 for each day assigned to movie overtime. The main reason that weekend supporters prefer to ~ote on those days is that they find it more convenient and they ha~e more time to vote Eighty-two percent of the weekend supporters expressed those views • Only 9 percent ha~e "strong personal ob~ections" to a weekend election, chiefly related to the cost associated with such elections The strongest variation in preference for election days is seen among hameowners compared to renters 56 percent of homeowners prefer voting on Tuesday, compared to 34 percent af renters, 27 percent of homeowners prefer voting on the weekend, compared to 47 percent of renters In add~tian, less frequent voters are more likely than very frequent voters to say they prefer the weekend election, and young voters also appear more likeiy to say they prefer the weekend compared to older voters Less frequent voters are more likely to be non-wh~te, non-partisans, younger than age 50, and renters • Fifty-eight percent agree that they are more IEkely to vote if the polls are open two days rather than one This figure is highest among those people who vote least frequently, among renters, and among r+oters under age 35 • Eighty-seven percent said they were aware of the election the city held fast weekend Voters under age 35 were significantiy less hkely to be aware of the electEOn • Voters divide evenly on the question of holding city elect~ons entirely by mad Initially, 47 percent support the idea, and 43 percent oppose it But once voters learn more about elections by mail (i e that it sa~es the city money, that it irtcreases ~otmg participa#ion, and fhat they cauld dehver the ballots by hand on election day), support rises significantly fo 69 percent, with ~ust 24 percent opposed These figures suggest that by switch~ng to all-weekend voting over two days, the aty is likely to facihtate turnout among those ~oters who are least likely to participate at present En elections These would include younger voters, m~nonfies, renters, and non-partisan voters However, there would remam a large block of more frequent ~oters for whom a weekend elect~on would be inconvenient or less convenient, or whom would be concerned about cost issues Summary of Findings Santa Monica Election Study Page 3 When it comes to an all-mail ballot, the s~rvey makes it clear that the city must transmit some cntical mformation to ~oters in advance of any such election Only after ~oters learn about the cost savEngs, convernence, and increase in tumout associated with mail ballots does ma~ority support for an all-mad ballot emerge A voter education in ad~ance of any such change would be extremely ~aluable DETAILED FlI~DINGS Preference Tuesday v Weekend Voters divide nearly evenly when asked ~f they would prefer to ~ote on a Tuesday or rf they prefer voting o~er a weekend As shown in Table 'f , neither opfion earns ma~ority support among voters Table 1 Preference Tuesday or Weekend Elections?
