SR-308-006-01 EPWM:CP:AA:BZ:RS f:\data\spfiles\sp1466\cc1466roofs.doc City Council Meeting: February 8, 2000 Santa Monica, California To: Mayor and City Council From: City Staff Subject: Recommendation to Delete the Installation of the South Beach and Palisades Park Restroom Roofs from Valley Crest’s Contract, Waive Competitive Bidding and Authorize the City Manager to Negotiate and Execute a Contract with Maher Development Inc. for the Installation of the Restroom Roofs Introduction This report recommends that the City Council delete the installation of the South Beach and Palisades Park restroom roofs from Valley Crest's Contract, waive competitive bidding, and authorize the City Manager to negotiate and execute a contract with Maher Development, Inc. in an amount not to exceed $56,625 for the installation of seven restroom roofs and approve $10,000 in contingency funds for the contract. Background On June 9, 1998, the City Council awarded a contract to Valley Crest for the construction of South Beach Improvements and Palisades Park Improvements (Phase II) of the Beach Improvement Group (BIG) project, including the construction of seven restrooms requiring specialized roof fabrication. Valley Crest has completed most of the construction contract items; however, there are still some outstanding items to be completed, including the restroom roofs. The City believes that Valley Crest has been ineffective in supervising the fabrication of the roofs and in ensuring timely roof delivery and installation. Therefore, staff recommends deleting this item from the Valley Crest 1 contract and awarding it to a different contractor. The City will negotiate a credit with Valley Crest for the deleted work item. Section 2.24.071 (e)(3) of the Santa Monica Municipal Code provides that the public bidding requirements may be waived if, by a 2/3 affirmative vote, the City Council finds that there is an urgent necessity, and that the public health, welfare or safety would be jeopardized by following the normal public bidding requirements. This exception applies for the following reasons: At this time, none of the restrooms are in operation, necessitating the continued use of portable toilets in a very intensively used regional park. The staff’s intent is to complete the installation of the roofs and make the restrooms available to the public before the summer months. Beach restrooms are most heavily used in the summer months and operating the restrooms without roofs, or using portable toilets would jeopardize public health and safety. Maher Development Inc. was recently awarded a contract for the Youth Center Addition at Christine Reed Park. Since they have completed the reference checks satisfactorily and they are immediately available for work, the roof installations can be completed before summer. The California Contractors State License Board verifies that the Contractor’s license is current, active, and in good standing. 2 Financial Impact FUNDS REQUIRED Contract $56,625 Contingencies $10,000 $66,625 Funds are available in the following account numbers: Account Number Amount C01008100.589000 $66,625 Recommendation Staff recommends that the City Council: 1. Authorize the City Manager to delete the installation of the South Beach and Palisades Park restroom roofs from Valley Crest Contract, waive competitive bidding for the reasons set forth in the staff report, and negotiate and execute an agreement with Maher Development Inc. in an amount not to exceed $56,625 for the installation of the restroom roofs and approve $10,000 in contingency funds for the contract; and 2. Authorize the City Engineer to issue any necessary change orders to complete additional work in conformance with the administrative instruction on change orders.
