Certification of the Initial Study and
Negative Declaration for the Beach Bikepath
Extension
INTRODUCTION
This report recommends that the City Council certify the Initial
study and Negative Declaration for the extension of the Beach
Bikepath from north of the Santa Moncia Pier to the northern city
limits.
The environmental review for the project will be
complete upon City Council certification of the Negative
Declaration.
The next steps of this proj ect before completion
will involve securing a permit from the Coastal Commission and an
additional grant of $192,764 from the Los Angeles Transportation
Commission to completely cover the $428,143 cost of construction.
BACKGROUND
In 1968 the Los Angeles County Board of supervisors adopted a
resolution calling for the creation of a bikepath along the ocean
front from Point Dume to Torrance.
The Beach Master Plan,
approved by the State of California, includes a bikepath the full
length of the Santa Monica beach front.
When the currently existing bike path was built by the County in
August, 1976 federal Land and Water Conservation were used.
However, construction of the path was not extended to Santa

Monica's north city limits at that time because of opposition
from beach front property owners.
In the spring of 1985 City staff learned that the county of Los
Angeles had been awarded funds from the Los Angeles
Transportation Commission to complete the bikepath extension.
The city agreed to hold two pUblic workshops in June, 1985 to get
input on the location of the bikepath and to bring the route
before the City's Recreation and Parks commission and city
council for approval.
On July 9, 1985 Council approved placement for the bikepath
approximately mid-way between the high water line and the western
edge of beach front properties with tie-ins to two pUblic parking
lots. Shortly thereafter city staff learned that the County
wished to turn over funds for the project to Santa Monica. The
Ci ty was asked to complete the proj ect which involves securing
the needed permits and approvals and constructing the bikepath
extension.
In spring of 1986 the city received $235,378.73 from the County
for completion of the project. However these funds are
insufficient and the City has applied to the Los Angeles
Transportation Commission for the additional $192,764 required.
A decision on this additional grant is expected in early
November.
In order to construct the bikepath, approval is required from the
State Department of Parks and Recreation \vhich questioned the
placement recommended by the City. After the state Department

reviewed the proj ect for several months the city was asked to
convene another public hearing, compatible with the schedule of
the state officials involved, to receive additional input. Over
75 people attended a September 20, 1986 hearing and
overwhelmingly voted to support the location proposed by the
City. The state has subsequently agreed not to oppose the City's
placement of the bikepath.
The remaining approval needed before construction of the project
can begin is from the Coastal Commission. It is anticipated that
the Commission will consider this project at its scheduled
meeting in December to be held in Southern California. council
will be notified when an exact meeting place and time is
announced.
BUDGET/FINANCIAL IMPACT
It is anticipated that adequate funding will be received from
Regional Bikeway funds through the Los Angeles Transportation
Commission and that no City contribution will be required for
this project.
RECOMMENDATIONS
It is recommended that City Council approve the following
findings:
1. The City Council has reviewed the Initial study and Negative
Declaration (ErA 806) consisting of the January 1986 "Santa
Monica Bikepath Extension Initial study,lI the February 7th, 1986,
Determination, the February 10, 1986, Negative Declaration, and

the comments on the Initial study from Richard A. Shortz, March
4, 1986 and Richard G. Rayburn, February 28, 1986, and finds that
the Initial study and Negative Declaration adequately review and
analyze potential environmental effects of the proposed project,
including effects on earth, water, noise, risk of upset, land
use, transportation/circulation, Public services and aesthetics.
2. The Initial study and Negative Declaration include adequate
review and analysis of the design and location of the project as
considered and approved by the City Council on July 9th, 1985.
3. The City Council certifies the Negative Declaration in that
the Council has reviewed and considered the Initial study and
Negative Declaration prior to acting on the project, that
environmental review for the project was conducted in accordeance
with state and city CEQA guidelines, that there was adequate
public review of the proposed Negative Declaration, and that
there is no substantial evidence that the proj ect may have a
significant enviornmental effect.

BACKGROUND
In 1968 the Los Angeles County Boarj of Super',llsors adopted a
resolut~on requIrlng that a bIkepath along the PacifIC Ocean from
POlnt Dume to Torrance be constructed. When the eXIst~ng
olkepath was bUll~, WI~h federal Land and Water ConservatIon

the general publIC and staff from the County Roads Department
were InvIted to, and attended these hearIngs. The concerns
expressed at these meetIngs, together w~th letters to the
Department of RecreatIons and Parks resulted ~n reVISIons to the
locatIon of the path. The b~kepath shown hereIn reflects these
reVISIons.
It IS important to note that the placement of the bIkepath takes
Into conSIderatIon tIdal actIon, engIneerIng analysis, publIC
usage of the beach, the concerns of beachfront property owners,
access from publlC parkIng lots and the needs of blCycllStS.
On July 9, 1985, the Santa MonIca Cl ty CouncIl approved the
conceptual locatIon of the bIkepath WhICh WIll be constructed by
the CIty of Santa MonIca USIng County funds and maintaIned by the
Coun ty of Los Angeles Roads Depar tmen t. The necessary steps
following that approval involve thIS envIronmental rev~ew and
determInatIon, fInal actIon by the CIty CounCIl, Coastal
CommIssIon review and approval, and State RecreatIon and Parks
Department reVIew and approval.
ZonIng
The extens~on of the bikepath, whIle located on the State Beach
will run parallel to parcels zoned Rl and R4. The structures to
the east of the bikepath locatIon consist of multI-family
dwellIngs, slngle famIly dwellings and three beach clubs. In
addition, there are two McDonald's restaurants and several publIC
parkIng lots.

Local Coastal Plan
POlICY 32 of Santa :-1onlca I s draft Land Use Plan (Lap) of the
Local Coastal plan CLep) states an OO]ect:lve of extend1.ng the
blkepath to tne northern Clt:y llmlt to connect WIth ehe blkepath
bUll t by tne CIty of Los Angeles along WIll Roger s State Beach
and, thus, promote bIcycle access to the beach through the
Coastal Zone. Clearly, the blkepath extenSIon 15 cons1stent WIth
the Local Coastal Plan.
The Coastal Act
Several Coastal Act polICIes arc relevant to the proposed one
mIle add1t~on to the eXlstlng bl~epath. These Include promotIon
of shorelIne access (PublIC Resources Code SectIons 30210-30212)
and recreatIon and V1SI tor-se rv Ing fac III t1es (Publ1C Resources
Code SectIon 30212.5, 30214, 30222, and 30250[C]). Access to the
shorelIne w1ll be Improved through the addItIon of the one mIle
b1~epath and through use of the blKepath, access to water-
orlented recreatIon actIv1tles wlll also be 1mproved. The
bIkepath addItIon wlll be linked to two publIC parking lots, one

Should a tsunamI occur, the Technlcal Report states that the
SeIsmIC Sea-Wave ~iarnIng system admlnlstered by the u. s.

tImes of the waves. l'he warnlng times vary WI th dIstance
f~om the source, but for most tsunam~s approa~hlng the coast
several hours are avaIlable to evacuate CItIzens and to make

r have received and revieweQ the InItial Study and
Negative DeclaratIon of the Beach Bike Path Extenslon, dated
February 1986. I found the Negative Declaration to be
serIously flawed In several respects. The rno~t SerIOUS defect
involves the critical hazard to chlldren who ~aY be uSIng the
beach at the varIOUS beach clubs along the bike path.
Regardless of the ultImate path that is utJlIZed, there WIll be
substantial numbers of small children moving frow the cluhs to
the waters edge on a daily basis in the summer without close
supervision of adults. The bike path presents a clear and
present danger to these children and only tragedy can result.
The dIScussion beginning on page 12 under Item 18. wholly
ignores the danger to children and is an unwarranted and clear
deficiency in the Negative Declaration. Even without studIes
of the traffIC pattern to and from the beach by chIldren~ any
responsible man would conclude that the conclusIons that
reached on pages 12 and 13 are erroneous. However, apparentlY
there has been no serious effort to study the traffIc patterns
of children to and from the beach as no reference has been made
in the report to such a study. ConstructIon of the bike path
by the city without a serIOUS evaluation of this Jssue would

accidents occur, as they wust assuredly will, would subJect the
City and its leaders to serious liabllity.

It was the conclUSIon of the February 1986 InitIal Study that the
proposed proJect would not result In a SIgnIfIcant effect on the
enVIronment. CEQA does not mandate that a proposed proJect
prOduce no externalities or have no effects on the enVIronment.
Rather, It reqUIres analySiS to determine whether any such
effects on the enVIronment are II SIgnIfIcant" or "substantIal."
If af ter conduc tIng an Inl tIal Study 1 t IS determined that the
proJect WIll not have a SIgnIfIcant effect on the enVIronment, a
NegatIve DeclaratIon IS prepared. It rema111S the conclUSIon of
thIS Initial Study that no SIgnIfIcant impacts Will result from
the proJect, and that a Negative DeclaratIon should be approved.

Comments of Richard A. Shortz
On March 7, 1986, the CIty PlannIng 01 VI S Ion rece Ived a letter
commenting on the InItIal Study for the Beach Blkepath ExtenSIon.
The letter took issue WIth Item 18d, pages 12 and 13. An excerpt
from the letter states:

"I found the NegatIve Declaration to be serIously
flawed In several respects. The most ser IOUS defect
Involves the cr 1 tIcal hazard to chIldren who may be
USIng the beach at the var lOUS beach clubs along the
bike path. Regardless of the ultImate path that IS
utIlIzed, there wlll be substantial numbers of small
chIldren mOVIng from the clubs to the waters edge on a
dally baSIS In the summer without close superVISIon of
adults. The bIke path presents a clear and present
danger to these chIldren and only tr agedy can r esul t.

There lS no substantIal eVIdence that extensIon of the blkepath
wlll result In the creatlon of a sIgnIfIcant safety hazard to
chIldren or other persons.
The City's most heaVIly used pedestrIan area near the beach lS
south of the Santa MonIca Pler, also where there are eXlstlng
bIkepath lanes. The CIty ParkIng and TraffIC EngIneer has
lndlcatea that there have not been any slgnIfIcant safety
lnCldents InvolVIng chIldren in that area, and notes that the
sectIon of beach where the proposed path IS to be constructed IS
utIlized slgnIflcantly less than the PIef area, thus reduclng the
lIkelIhood of any pedestrlanjblcycle conflIcts.
The DIrector of RecreatIon and Parks for the Clty of Santa MonIca
concurred that the record refl~cts that chIldren or other persons
have not been Involved ln any serIOUS bIkepath InJurIes In Santa
Monlca.
The eXIstIng 19 mIles of beach bIkepath's aCCIdent records,
accordIng to the County blKepath coordInator, do not reflect the
assumptIon of the letter that bIkepaths present slgnlflcant
danger to chIldren.

On t1arch 14, 1986, the Plannlng DIV1Slon recelved a letter from
the State OffIce of Plannlng and Research WhlCh 15 c:~sponslble
for dlstributlng the Init1al Study-NegatIve DeclaratIon to
several State agenCIes for reV12W. Only one of the State
agencles responded and that was the State Department of Parks and
Recreatlon.
The Parks and Recreation Department expressed concern about the
placement of the bIkepath and an excerpt from thelr letter
follows:

tiThe route of the bIke traIl should be realIgned to
follow the eastern edge of the State property as
closely as possible. ThlS would provlde better access
from the parklng lots, avold Interference \Hth beach
sanltatlon equlpment, and somewhat reduce the effects
of storm and shore Ilne erOS10n. Most 1mportantly, the
trall should be brought lnto conformance WIth the rest
of the teall system, WhlCh follows an lnland

The placement of the blkepath was the result of several meetIngs
lnvol vlng the County Eng lneers, CIty staff, resIdents, property
owners, beach club members, and subsequently, the CIty CouncIl.
The result of these meetIngs and CIty CouncIl Input was that the
path would access parkIng lots, it would provIde as much space as
possIble between the path and pr Ivate property and beach club
fa~llltIes, and it would curve Into parking lot areas In order to
keep bICyclIsts at a slow smooth speed and lessen the chances of
exceSSIve speeding.
The blkepath, In Its proposed locatIon, prOVIdes dS much access
from parkIn9 lots as would a path that had a more Inland
alIgnment as there would be no more access or egress lanes
establIshed by a dIfferent path confIguratIon. There are several
sectIons of the existIng coastal blkepath that are not alIgned In
an inland manner, for instance, Just south of the Santa Monica
PIer It is not, and south of MarIna del Rey and along the Playa
del Rey Beach area the path IS well away from an Inland
allgnmen t.
It was the CIty's obJectIve to keep the path as far away from any
Inland sectIon of beach that IS tradI tlonally used extens~vely,
and to keep the path In as safe a locatIon as feaSible w~ th
respect to storm and shord lIne erOSIon. ThIS was accomplIshed
through a deslgn process that lncluded extenSIve publIC Input and
County and CIty EngIneerIng expertIse.
The path locatIon IS not a slgniflcant obstacle to sanItatIon
equlprttent, SInce In other areas, eqUIpment and theIr operators
have been abl~ to work around the beach bIkepachs WIth llttle or
no dIffIculty or d~sruptlon of theIr serVIces.
