However, my understanding in this area is inadequate, and I request a staff report or opinion that will enhance that understanding. A good start for me would be for staff to answer questions such as the fOllowing as well as anything else staff can think of that will clarify the issues raised: 1. In what precise ways are general plan and its housing element mandated by state law? 2. To what degree, if any, are housing SERVICES for the poor, low and very low, and moderate income sectors of the community --and the homeless, too, I guess--required by state law in connection with the state's requirements for "housing elements"? 3. Do we have a housing element today that complies with whatever state requirements exist? And what are the basic ingredients of that compliance? 4. If we do have a valid housing element, what specific provisions, if any, exist in that housing element for dealing with the needs of low, very low, and moderate income residents, and the needs of the homeless? 5. If we do not have a housing element that deals with the above items, what is the significance of that, legally, and in terms of our planning? What, if we don't have a proper housing element, should ~7e do about it, and whatl if anything, does it have to do with our zoning laws , LUCE, and development and social services policies, if anything? 14"'~ .}f>.~ ?. b ~~ ..- . . 6. Some of the above is legal, some planning, and some C & ED. I don't know who should and can answer these questions. Therefore I ask it to all of you with the hope that someone can help me focus.If the questions are legal, perhaps the city attorney can provide a legal opinion . If the questions are planning, perhaps planning can provide a planning opinion. I would like an opinion and report from the city attorney and the planning staff. I look to staff to decide how much time it takes to address my questions and I request that the matter be placed on the agenda of the Council meeting of January 26 as a Finkel 14 item....at least for the limited purpose of having staff tell council and me how long it will take for the generation of a report...one I perhaps, to be made on a future date to be decided by staff.
