SUBJECT: Resolution F1nding That Beach Parking Lot Rate
Increase Is Exempt from CEQA
On June 30, 1981, the C1ty Council approved an increase in
beach parking lot rates f~om $ 2.00 to $ 3.00. The accompanying
resolution is presented for adoption to exempt the rate inc~ease
from the requi~ements of the Cal1fo~nia Environmental Qual1ty
Act. Although the City Atto~ney bel1eves that the Act 1S not
applicable
the rate increase, the proposed resolution
to
establishes the basis fo~ a statutory exemption.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA FINDING THAT BEACH
PARKING LOT RATE INCREASES ARE EXEM?T
FROM THE PROVISIONS OF THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
THE CITY COUNCIL OF THE CITY OF SANTA MONICA RESOLVES AS
FOLLOWS:
SECTION 1.
The C~ty Counc~l finds tha~ the establiahment,
modif1cation, structuring, restructurlng, or approval of beach
parklng lot rates contalned in Resolutlon Nu~ber 6300 (CCS) is
for the purpose of meet1ng operating expenses, includlng employee
wage rates and fringe benefits and/or obtaining funds for capltal
proJects necessary to maintain se=vice wlt~ln eXlsting serVlce
areas.
SECTION 2. The Clty Councll hereby finds as follows:
1. The increase in beach parking lot rates 1S
establ~shed to meet operating expenses, lncludlng
employee wage rates and fr~nge benefits and/or
obtainlng funds for caplcal projects ~ecessary to
malntaln service wlthln eXlsting service areas.
2. Pursuant to the Beach Operating Agreement between the
City of Santa ~onlca and the State of Cal~fornla, all
beach park~ng lot revenues ~ay only be used in
connection wlth expenses for operat~on of or cap~tal
lmprovements in the subJect beach area.
3. The rate lncrease is necessary to f~nd l~feguard
serv~ce at the beach~

SECTION 3.
Pursuant to PublLc Resources COGe Sectlon
21080{b)(8), the actLon lnd~cated in Section I was and :5 exempt
from the provlsions of the Cal~fornla Environmental ~~al:ty Act
of 1970, publLc Resources Code Sectio~ 21000 et seq.
SECTION 4. The City Cler~ shall certlfy to the adoptlon of
this resolution and thenceforth and thereafter the same shall be
10 full force and effect.
