Clty Staff SUBJECT' Request for Author1zat1on to Negotlate Contract for Beach Concess1on Stand rntroduct1on Th1S report requests Counc1l to author1ze the C1ty Manager to negot1ate a contract for the operatlon of the beach conceSS1on stand at 1100 Pac1f1c Coast H1ghway wlthout further compet1t1ve blddlng, and subject to State approval. Background C1ty Counc1l, at thelr meet1ng of Aprll 12, 1983, awarded blds for four of the f1ve conceSS1on stands spec1f1ed 1n Sld No. 1836 Awards were made as follows: two stands at 2600 and 2400 Promenade to P1zza Works, rnc , one stand at 1200 Paclf1c Coast H1ghway to N & J, Inc., and one stand at 930 Pac1f1c Coast H1ghway to L & L Concess1on Supply. The stand located at 1100 Paclflc Coast H1ghway was not awarded because the sole b1dder on the stand was found to be not a respons1ble b1dder. Although propoal forms were mal led to 45 conceSS1onalres and not1ces were advert1sed 1n accordance w1th C1ty Charter and Munlclpal Code prov1s1ons, only the four b1ds ment10ned here1n were rece1ved Due to th1S llm1ted response, staff feels 1t would be most cost effective and t1me eff1c1ent to negotiate with those who responded to the lnit1al b1d, two of whom have expressed an 1nterest 1n the remaln1ng 10cat1on. Although the C1ty Code does not requlre compet1tlve b1dd1ng to negotlate a lease, It has been the practlce In the past to go through the compet1t1ve b1d process pr10r to negotlatlng a lease. We are now requestlng that the b-L lease be negot1ated wlthout further compet1tve b1dd1ng, subject to State approval.
