BACKGROUND Los Angeles County provides lifeguard services, beach maintenance and parking management for all beach communities within the County except the cities of Long Beach and santa Monica. Long Beach operates and funds its own program. The City of Santa Monica provides beach maintenance and parking lot operations. The current contract between the City and County for lifeguard services is due to expire June 30, 1989. It has been in effect for a three-year period. Presently, the percentage paid to the County for lifeguard services from beach parking and concession revenues is 34%. This contract provided for the city to be self insured and provided for shared liability for accidents which I I-I) - 1 - JUN 1 3 1989 </ ~ -- . . were the result of natural or artificially caused ocean conditions. DISCUSSION The contract recommended for City Council approval is for a period of four years and runs from July 1, 1989, to June 30, 1993. The contract calls for a 1/2% per year increase in fees paid to the County over the term of the contract according to the following estimated schedule. The liability provisions of the contract are_somewhat different. Under the recommended contract the City assu~es sole liability in certain limited situations arising from failure of the county Lifeguards to warn beach users of ocean hazards caused by man made improvements to the coast. In all oth~r respects however, the City and County's liability remains the same. For instance, the County remains liable for the negligence of its employees in patrolling the beach or in performing rescue services. The impact of this change in indemnification is difficult to quantify. Lawsuits involving such issues are infrequent and recent state legislation provides immunity for accidents Which result from naturally occurring ocean conditions. In addition, the County would provide the City with a grant of $350,00 to repair the beach parking lots. - 2 - . .
