California 3CJ~~C03-tf;J1 /TOD 1(, S--A TO: Mayor and City Council FROM: City Staff SUBJECT: Response to Council ~nquir~es at the November 8. 1983 Counc~l meeting concern~ng the establishment of a Percent for Art (PFA) Program. INTRODUCTION At its meet~ng on November 8. 1983, C~ty Counc~l made several ~nqu~r~es of City Staff concern~ng the establ~shment of a Percent for Art (PFA) Program. This report responds to those ~nquir~es and recommends modificat~ons to the previous staff report. BACKGROUND The following areas of concern were vo~ced by Councll with regard to PFA: 1. City Property Issue: Clar~f1cation that PFA app11es only to c1ty property. and not to private development with~n the C~ty. Recommendation: Amend item 2. page 1 to read: .~ny proJect involving the construction, remodeling or renovation of property w~th~n city limits, owned by the City. and on City property and the Santa Monica State Beach. 1 A-DO ~ S---A . . 2. Substantial Renovat10n Issue: Should PFA apply to c1ty construct1on proJects and substant1al (with costs of at least 50% of the orig1nal construction costs) remodeling or renovat10n projects? Recommendation: As defined in the Capital Improvements Program Budgeting Administrative Instruct1ons, only those renovation prOJects of at least $10,000 are lncluded in the Capital Improvements Program. This provision already limits those renovation proJects WhlCh would be lncluded under PFA as maJor renovatlon proJects. The addition of a further lim1tation would also further llmit the scope of the program. It is rare that any renovation project has a budget which 1S 50% of the orig1nal construct1on (see Attachments A and B). In the past two years, only one such proJect, the renovat10n of the Ocean Park Library, would have qual1fied for PFA uS1ng th1S criterion. Therefore, staff recommends no change 1n the or1ginal language of the Staff Report. 3. The Inclusion of Sidewalks, Streets, and Ut1lit1es Issue: Should the constructlon or renovation of sldewalks, streets, and utilit1es be included in PFA? Recommendation: Based on the successful experlences of other cities, sidewalks, streets, and utilitles should be 1ncluded in a PFA Program. For example, manhole covers have been designed by artlsts 1n Seattle and Wash1ngton, D.C., 2 . . and sldewalks in Seattle, Boston, and Chelsea, Mas sachuset ts. Staff believes that Santa Monlca to benefit from a Slmilar the opportunity 4. Off-Site Provisions Issue: Should PFA 1nclude a prov1sion for off-site artwork? Recommendat1on: The inclus10n of an off-s1te provision 1n PFA enables the program to reach beyond the geographic llm1ts of on-slte artworks into other areas of the city. As one of the purposes of a PFA program 1S to enhance the physical deslgn of the city, the lncluSlon of a prov1sion for off-site artworks better enables the City to place artwork in a wider var1ety of locations. It will also balance access to artwork throughout the c1ty by enabl1ng targeting neighborhoods that otherwlse ffilght not rece1ve art through the on-site procedure. Also, by prov1dlng funds for a rotating collectlon, art may be made avallable to public spaces in all parts of the city. For example, a facility which may not have a large capital improvement budget may be a natural place to 1nclude 3 . . art in conJunctlon with lts function, such as the Falrview or Montana branch llbrarles. 5. Admlnistrative Costs Issue: Should the administrative costs for PFA be limited to 18% or a lower flgure? Recommendation: The recommended adminlstrative costs of actual expendltures up to a maximum of 18% for the PFA program were averaged on the experlences of other cities. However, as maLntenance costs for the program should be low durlng its lnltlal years and Council has expressed concern over these costs, staff recommends that admlnistrative costs be reduced to actual expenditures up to a maXlmum of 15%. 6. Limit on Jurors' Honorarla Issue: Should a limlt be placed on the amount of an honorar1um that a PFA Juror may receive? Recommendat1on: It 1S recommended that PFA Jurors may rece1ve honoraria not to exceed $600 each (a maximum of $200 per day for a maXlmum of three days). 7. Annual Arts Plan for PFA Funds Issue: The format for an annual arts plan for PFA funds needs to be clarified. Recommendation: As presently envlsaged, plans for PFA will be closely tied in with the CIP budget1n~ process. The CIP Committee, as it cons1ders capital improvement proJects, w1l1 Judge the appropriateness of PFA for each one. In the months preceding the C1ty Councll budget hearings, a 4 . . committee on selectlon for each project (a representatlve from both the Arts Commission and the user Department, together with a third person of mutual chooslng) wlll establish a plan for selecting on-slte artwork. Each Committee on selection (there may be one committee for several proJects withln a department) will act in accordance with its duties as set forth ~n the selection guidelines in the PFA staff report. Each committee's plan will outllne: 1. Type of artwork desired: for example, sculpture, mural, or tapestry. 2. Method of selection: open or lim~ted compet~tion, 1nvitation, or direct purchase. 3. Proposed constitution of Jury for the project. 4. Involvement of appropr1ate boards or commissions; for example, Landmarks Commission or Arch~tectural ReVlew Board. 5. Proposed commun~ty involvement: for example, adv~sory panels, public hearings, pol11ng. 6. Method of public announcement: for example, press releases, invitation to artists, general malllngs. ThlS plan, for each project, will then become the Arts Plan for PFA, to be presented to C~ty Council for rev~ew and approval after approval of the CIP budget. 8. Issue. The exclus10ns to Percent-for-Art need to be clar~fied. 5 . . Recommendation: It is recommended that the following items be excluded from PFA allocations: 1. Design and research stud1es 2. Purchase and renovation of roll1ng stock 3. Urban des1gn or art projects 4. Grants to private agencies 5. Purchase of equipment not related to capltal construction or renovat10n 6. Operat1ng costs, such as tree trimming 7. Acquis1t1on of land BUDGET/FINANCIAL IMPACT Issue: What would have been the actual costs of a PFA program dur1ng 1982-83 and 1983-84? Assuming that Enterprise Funds and State and Federal grant funds could be used for PFA, the actual costs for the program for the past two years are presented as Attachments A and B. RECO~1ENDATION It 1S respectfully recommended that the City Councl1 d1rect the City Attorney to prepare an ordinance creat1ng a Percent for Art program WhlCh encompasses the prov1s1ons as set forth 1n the November 8, 1983 Staff Report and as amended at the November 8, 1983 City Council meeting and in this Staff Report, and to exam1ne the possible appllcatlon of PFA to Redevelopment and Parklng Author1ty Funds. 6 _G"lO'tl pOroP/"1 . .
