INTRODUCTION
At Its meetIng on September 11, 1984, CIty Council made several
inquiries of the Arts CommIssIon concernIng the proposed 1984-85
Ar t Plan for the Percent fo: Art Program. These inquIr Ies were
dIscussed by the Arts Commission at its meeting on September 24,
1984.
This report contaIns the responses of tre Arts CommissIon
to

recommendatIons
concernIng the Issues t~at were raIsed.
BACKGROUND
The fOllcwlng areas of concern were voiced by CouncIl WIth regard
to tre proposed Annual Art Plan:
1. Payment of Juror's Fees
Issue

Recommendation
The Arts CommIssIon reconfIrms ItS earlIer recommendation
that Jurors should, Indeed, be paId for theIr serVIce. ThIS
recommendation IS reconflrmed for the followlng reasons:

a. The Arts Commission feels that It IS Important to
establish the prInciple that persons who work in the arts
be paId for their labor.
Too often, artists and arts
professionals, unlike persons wro work in other fIelds,
are requested to donate treIr expertise and talents as If
trey were of a lesser order.
The unIqueness of tr.eir
expertise should be recognized and compensated, even if 1n
a nominal way.
b. Payment of Jurors WIll go far toward the establisrment and
maIntenance of profeSSIonal standards that will be used in
the selectIon of artworks.

c. Tre cost of paYIng Jurors IS not believed to be exceSSIve
and would be easily accommodated 10 the admHlistrative
budget of the Percent for Art Program. Based on a nomInal

d. The Arts CommIssion has consIdered and dIscussed CouncIl's
concerns regardIng the payment of Jurors' fees. Based on
this dIScussion, the Arts CommIssion has decIded to add
the followIng crIterIa for such payment:
1) Jurors who lIve or work In tre City of Santa MonIca would
be requested to volunteer theIr serVIce, upon the urgIng
of the CounCIl.
2) Jurors who are current members of CIty Boards and
CommissIons WIll not be paId for theIr serVIce.
2. Art Bank
Issue
Should the Art Bank be included In the Annual Art Plan?
RecommendatIon
The Arts CommIssIon reconfIrms Its earlIer recommendatIon
that the Art Bank be included In a prOject In the Annual Art
Plan as the Art Bank is an effectlve and approprIate way of
exrlbltlng contemporary artwork In publIC settIngs. The
purpose of tre Art Bank IS to acqUIre artwork for the CIty,
not In order to store It, but ratrer In order to dIsplay It
for the benefit of the publIC. The number of heaVIly-used
publIC spaces that could accommodate the dIsplay of artwork
would Insure that artworks acquIred for the Art Bank would
receIve continual use. Artworks would travel throughout tre
City by way of Its lIbrarIes, parks, recreatIonal facilitIes,
schools and government bUIldIngs. Because of the wide
varIety of exhibItIon locatIons, artworks approprIate for a
wide varIety of settings would be conSIdered for purchase.

Sculptural p~eces, as well as two-d~menslonal ones, would be
elIgIble for the program for both outdoor and lndoor
lnstallatlonS. For example, an exhlbitlon of artwork at tre
Fairview or Montana branch llbrarles would have been viewed
by as man~' as [our to flve thousand persons durIng August t
1984. An installatIon of artwork at Douglas or Clover parks
would have been slmilarly vlewed by two to three thousand
persons. All of these locatIons would make excellent
settlngs for exhIbitions of contemporary artwork.
3. Fourth street MedIan PrOject
Issue
Should the Fourt'" Street Median Project be Incl uded In the
Annual Art Plan?
RecommendatIon
Althougr It would like to see h~gh-quallty deSIgn elements
be Incorporated in tre constructIon of the Fourth Street
MedIan, tre Arts CommISSIon agrees with Council that the
$1,500 Percent for Art allocatIon 1S not an effectIve way to
accomplish thIS. Also, the Arts Commisslon agrees WIth
CounCIl that Hotchkiss Park, which adjoins Fourth Street,
would be a more appropr1ate locatIon for a major publIC art
prOject than would the Fourth Street MedIan. Therefore, the
Arts CommiSSIon recommends that the funding which had
prevlously been recOmmended for the Fourth Street MedIan
PrOject now be combIned wlth that of the Art Bank. Then, the
Art Bank Jury wlll be dIrected to purchase an artwork
sU1table for ~nstallat~on In HotchkISS Park, among other
acquIsltlons. The Art Bank Jury srall consult wlth residents

of the communIty near HotchkISS Park 1n select1ng th1S
artwork. The cost of the artwork shall be at least $1,500.
In order to formalize and standardlze the pollcles and
proced ures of the Art Bank, the CIty Attorney has prepared
the attached resolutlon for Council approval.
BUDGET/FINANCIAL IMPACT
The adoption of the Arts Commiss1on recommendations concern1ng
these three lssues would rave the folloWIng budget impact:
1. Payment of Juror Fees
Of the $12,958 that would be allocated for the adminIstrative
expenses of the Percent for Art Program (as outlined 1n the
preV10us Staff Report), apprOXimately $1,lIOO would be spent
for Juror fees.
2. Art Bank ( 1nclud1ng the former Forth street MedIan ProJect)
From the General Fund portion of the CapItal Improvemnts
budget (01-740-560-000-902), $18,600 would be used to acqu1re
works of art; at least $1,500 of wr1ch would be used to
acqu1re an artwork for 1nstallation 1n HotchkiSS Park.
RECOMMENDATION
The Arts CommISSIon respectfully requests that Council adopt itS
add1tIonal recommendations concerning the 1984-85 Art Plan of the
P~rcent for Art Program and adopt the attached resolution
establlsh~ng the Art Bank.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADOPTING THE
ART BANK POLICY
WHEREAS, the City Council of the City of Santa Monica
has established an Arts Commission to carry out certain
specifIed purposes; and
WHEREAS, the Arts Commission has recommended that the
CIty Council of the City of Santa Monica adopt an Art Bank
Program. and
WHEREAS, an Art Bank Program will enrich the lives of
all resldents of and visitors to the City of Santa Monica by
provldlng funding for various forms of public art,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
The Art Bank Program attached hereto is
hereby adopted.

EstablIshment.
The Art Bank Program 1s hereby
establIshed in the City of Santa Honica.
2 Goals and Pvr~Q~~. The goals of the Art Bank are:
(al To bring contemporary art into the
enVIronment and life of Santa Honica.
(bl To encourage both emerging and established
artIsts by supporting and purchasing their work.
{cl To acquire a distinguished art collection for
the CIty of Santa Honica.
Cd} To document the history of art in Santa
HonIca.
The Art Bank will function as a repository for artwork
selected by the Arts Commission or its representatives, and
purchased for the City of Santa Monica. The work of both
resident and non-resident artists will be considered for
purchase. The Art Bank will make the artworks accessible to
the general public through exhibitions and loans. The Art
Bank Collection will be displayed in the interiors and grounds
of publIC spaces such as City Hall, schools, libraries and
parks. The Art Bank Collection will be a valuable resource
for community organizations, museums, and galleries who may,
by complYIng with specified procedures, borrow works for
exhibit and educational purposes. The Collection will also
function as an archival source for historical reference.

4 ApPointment of Jurors. The Arts CommISSlon will
appoInt three jurors for the Art Bank for a one year term at
the beginning of each fiscal year. Jurors may be reappIonted
for a second term, but may not be reappointed for three years
after the end of anyone year term. A majority of jurors
shall lIve or work in the City of Santa Honica. Each jury
shall lnclude at least one artist. Other jurors will include
acknowledged experts in contemporary art: collectors,
critICS, historIans, educators, etc. One member of the Arts
CommlSSlon may be appointed as a juror.
S Annual Purchase Program. At the beginning of each
fIscal year, the Art Bank jury will prepare a plan for the
expenditure of funds made available by the adopted budget for
the flscal year. This plan shall include the number and types
of artwork to be purchases. Prior to any purchase of artwork,
the Annual Purchase Program must be adopted by the Arts
CommlSSIon. Based on the Annual Purchase Plan, the Arts
CommIssIon will establish review periods and application
procedures for the year.

6. Selection of Artwork for Purchase. The following
guidelines shall be used by the jury in the purchase of
artwork:
(al The purchase of work~ of art by artists
lIvIng or working in Santa Honica shall be ~ncouraged.

(bl All works will be purchased at the most
favorable price to the City, which will be determined on a
case-by-case basis.
(c) During the year of their servIce, members of
the juries of the Art Bank and the Percent for Art Program
(and Its Advisory Committee) may not have their works of art
consIdered for purchase.
7. DIsplay Policy. Each year, the Arts Commission WIll
publIcIze to all City departments and agencies all artworks
that are avaIlable for display. Department Directors and City
officIals will then make their requests for works of art to
the Arts CommIssion, which will decide the loans to be made.
All work from the Art Bank will be displayed only in public
areas In public facilities and in public ceremonial spaces.
Artwork will be on display for one year periods of tIme.
8. AdmInistration. An agreement between the Arts
CommISSIon and the borrowing Department shall be written for
each pIece of artwork to be loaned and sha 11 include the
followIng:
(a) Handlinq. Only an Arts Commission staff
member, the borrowing Department (with permission), or

Arts CommIssion.

Staffing the Art Bank, including
all support services, support for the jury} and all assocIated
costs, WIll be the responsibility of the Arts Commission.
(h} Honorarium.
Jurors who are not members of
the Arts Commission may r~ceive an honorarium from the
CommlssIon.
Jurors who live or work in the City of Santa
Monica will be requested to volunteer their service as jurors.
Jurors who are current members of City boards and commissions
Will not be paid for their service.
Former members of the
Arts Commission who are serving as jurors will not be eligible

to be paId for their service for one year after the expiration
date of theIr service as an Arts Commissioner.
(i) Unusual Costs. Any unusual transportation,
InstallatIon, and/or maintenance c~sts will be the
responsIbIlIty of the Arts Commiss,ion.

9 Permanent L9ans, Donations and Beauests.
(al The Arts Commission will only consider offers of
artworks to the Art Bank that are permanent loans,
unencumbered gifts, and bequests.
fb) A donor who wishes to make such an offer must send
a letter to the Arts Commission that contains the following
information:
(1) The type of donation being made.
(2) Documentation materials of the artwork being
offered for donation, including pictures, slides, size,
medium, title, year of creation, etc., and a resume of the
artist, if possible.
(3} Maintenance requirements of the artwork.
(4) A document showing that the artwork is free
of encumbrance.
(S} ~ release fetter by the donor, should the
Arts CommIssion decide to deaccess the artwork in the future.
(cl The City of Santa Honica will acknowledge receipt
of the donated artwork without any valuation for tax purposes.
The donor must find other means of establishing a value of the
artwork.

(d) The Arts Commission will present all proposals for
donated artworks to the Art Bank jury for consideration.
(e) Based on this recommendation of the Art Bank jury,
the Arts Commission will decide on accepting all offers of
donated
artworks
and will
notify
donors of its decisions

(f} Any loan or any restricted gift must be reviewed
and approved by the City Hanager in consultatlon with the Clty
Attorney
10. External Loans.
Museum and private curators may
apply to the Arts Commission for artworks in the Art Bank to
be included in exhibits in the City of Santa Honica and
temporary exhibits outside the City of Santa Monica. Rental
fees shall be charged for such loans.
11. Travelino Exhibits.
Arts Commission staff may
organIze traveling exhibits in the City of Santa Monica from
the Art Bank and temporary traveling exhibits outside the city
of Santa Monica.
12. Reoroduction Right~. Reproduction rights, if any,
shall be established in an agreement between the City and the
artlst.
13. Deaccession.
Deaccession of any piece of artwork
In the Art Bank may be considered if the artwork has not been
publicly displayed over a five year period. The decision to
deaccess a piece of artwork shall be made by the Arts
Commission upon the advice of the current year jury. The
