Background At 1tS meet1ng on November 8, 1983, the C1ty Counc11 considered the recommendation of the Arts Commisslon to establ1sh a Percent for Art (PFA) program for capltal proJects. Because of quest10ns that were ra1sed dur1ng the d1Scusslon, Counc1l consldered add1tlonal Arts Commlss1on recommendations at a subsequent meet1ng on November 22, 1983. On the 22nd, the Council d1rected the C1ty Attorney to prepare a Resolut1on Wh1Ch establ1sh the PFA program. Th1S would Resolution, Wh1Ch 1S attached, addresses the followlng p01nts: 1. the defln1tion of those cap1tal projects whlch w1ll be subject to a 1% PFA allocat1on; q-A APR 2 4 1984 ~ . . 2. the procedures by WhlCh the City Manager w1Il administer the program; 3. the manner ln WhlCh the program budget wlll be prepared and presented to the City Councll; 4. the deflnltlon of two categor1es of projects with1n PFA program; 5. the process by WhlCh Selection Commlttees wlll be created to determ1ne, 1n conJunct1on wlth the Arts Comm1ss1on, the nature and locat1on of art work; 6. the process by WhlCh the Arts Commisslon will coordinate the preparat10n of an Annual Art Plan for subm1SS1on to the C1ty Council; 7. the process by Wh1Ch the Arts Comm1ss1on wlll coordinate the preparat10n of an Annual Schedule of Art Ma1ntenance. Budget/F1nanclal Analys1s One of the prOV1S1ons of thlS resolut1on lS that the PFA program beg1n on a regular bas1s wlth the 1984-85 F1scal Year. As the fundlng sources for the PFA program will vary w1th the type of capital prOjects adopted ln the budget, it is not poss1ble to determlne the exact f1nanc1al 1mpact of the proposed program at th1S t1me. The PFA budget wlll be detalled 1n the Annual Art Plan developed by the Commiss1on. CITY OF SANTA MONICA PERCENT FOR ART PROGRAM Adopted by Resolution Number 6854 . (ccs) . . 1. Establishment. The Percent for Art Program is hereby established in the City of Santa Monica. The Percent for Art Program shall be incorporated into each Budget of the ci ty of Santa Monica commencing with fiscal year 1984-85. 2. Definitions. For purposes of the Percent for Art Program, the following words and phrases shall have the following meanings: (a) Art. Art including but not limited to sculpture, paint1ng, graphic arts, mosaics, photography, crafts, mixed media, and environmental works. (b) Arts Commission. The Santa Monica Arts Commission estab11shed pursuant to Municipal Code Section 2931. (c) Ca~ital ProJect. Any capital proJect as defined in the Capital Improvement Program Budgeting Administrative Instruction inVOlving the construction. remodeling or renovation of property undertaken by the City of Santa Monica or one of its agencies, which property is owned by the City or one of its agenc1es or is subject to the Beach Operating Agreement with tfle State of California, including any building I park, sidewalk or street, parking facility, utility, decorat1ve structure and including portions thereof. The fOllowing shall be excluded from the def1nition of capital proJect: (1) Des1gn and research studies. (2) Purchase and renovat1on of rolling stock. (3) Urban design or art projects. (4) Grants to private agencies. I . . (5) Purchase of equ~pment not related to capital construction or renovation. (6) Operating costs (e.g., tree tr1mming). (7) Acquisition of land (whether 1mproved or unJ.mproved) . (B) Any cap1tal proJect for wh1ch legal restrlctions preclude applicat~on of this program. (9) Community Development Block Grants other than for the construction or renovation of publ1c facilities. (d) elP Cornm1ttee. The Committee established by the Capital Improvement Program Budgeting Administrative Instruction. (e) PFA. The Percent for Art Program. 3. Administration. PFA shall be administered by the City Manager. The Arts Commission shall provide guidance to the city Manager and assist in the selection of art as provided fo r in ~hese Guidellnes. 4. Proposed Bud~et. The proposed budget submitted to the City Councll shall include an allocat1on of at least one percent (1%) for each capital project developed in accordance with the following procedures: (a) The PFA allocations shall be determined by the ClP Cornm1ttee and be contained in the capital improvement budget submitted by the City Manager to the City Council. The CIP Committee shall determine into which of two categories the PFA allocation shall be placed: 2 . . (1) First Tier. Capital projects of more than $100,000 sU1table for on-site art. (Any proJect outside the City of Santa Monica shall be deemed unsu1table for On-s1te art.) For these proJects, 1% of the non-art related costs shall be budgeted for on-s1te art. (2) Second Tier. Capital proJects of less than $100,000 or capital proJects of more than $100,000 for which on-site art 1S unsuitable. For these projects, l% of the non-art related costs shall be budgeted for (1) increased allocation for f1rst t1er proJects, (ii) on-site art projects, (1ii) one or more off-site projects, and/or (iv) purchases of art for pub11c d1splay. Notw1thstanding the above, no allocation from any cap1tal proJect funded by any enterpr1se fund shall be allocated except for an art proJect related to the enterprise. (b) A PFA Account shall be establ1shed 1n the capital budget. Appropriation authority shall be contained in the cap1 tal budget for First Tier and Second Tier proJects. From time to tl.me, the City Manager may recommend other budgetary procedures to appropriate and expend PFA allocations, including any necessary interfund transfers. (c) A PFA Adminl.strative Account shall be established in the capital budget for the administrative expenses of the Arts Comm1SS1on in carrying out PFA. Fifteen percent (15%) of each PFA allocat1on shall be placed 1n th1S account. 3 . . 5. Adopted Budget. The budget adopted by the City Councl1 shall contain a PFA allocation for all First Tier projects. The budget adopted by the City Council may contain a PFA allocation for Second Tier projects. 6. Annual CIP Art Plan. The Arts Commission shall coordlnate the preparatlon of an Annual Art Plan, which shall set forth speclflC projects for the PFA allocations in accordance wlth the following standards: (a) Each Department shall form one or more Selection Committees to determine the type of art for anyon-site art from its capital proJects. The Selection Committee shall consist of one member of the Arts Commission, One person appointed by the Department Head (which may be the Department Head), and one person mutually agreed to by the Arts Commission appointee and the Department Head appointee. One of the members of the Selectlon Committee shall be an artist. (b) The Arts Commisslon shall form one or more Selection Committees to determlne the type of art for any off-slte art. (c) The Selection Committee shall have the following responslbl1itles: (1) To determine the type of artwork desired for the site. The Selection Committee shall consider all pOSS1.ble constralnts On the site and shall attempt to ensure that the artwork selected is appropriate for the site's overall deslgn and 1.S pract1.cal in terms of maintenance and operation. Only low ma1.ntenance artwork shall be considered for outdoor, non-secured locations. The maintenance implications of the artwork shall be 4 . . explored with the approprlate department having maintenance responsibillty for the site. If the Selection Committee determines that the art should consist of a mural, the Standards and Procedures for Public Murals shall govern the project. (2) To work with appropriate review boards. (3) To solicit advice from art professionals and from businesses and residents that will be affected by the proJect. (4) To determine the method by which the artwork w11l be selected: invitation, limited competition, open competitlon, or direct purchase. All selection must be done in accordance with applicable legal requirements. (5) To empanel a jury, if its determines necessary, to make the selection decision. The procedures for any jury shall be approved by the Arts Commission. (6) To recommend a maintenance schedule for the artwork, including whether or not the contract with the artist wlll lnclude any ongoing maintenance responsibilities. (7) To prepare a report settlng forth the manner in WhlCh it met its responsibillties under these Guidelines. (d) The Arts Commisslon shall prepare the informatlon contalned from the varlOUS selection committees into an Annual Art Plan. The Annual Art Plan shall be submltted to the Commission for its comments and to the Ci ty Counc1l for its approval. 7. Implementation of Annual Art Plan. After the Annual Art Plan has been approved by the City Council, the Selection 5
