SR-304-002 (14) . 30 C/ - 00"'2- . , \-jl caMJ.~ch-~i~8B CRS:BFM:DTA:DM:JG:KS:tb city council Meeting July 12, 1988 Santa Monica, STAFF REPORT TO: Mayor and city council FROM: City staff SUBJECT: RECOMMENDATION TO APPROVE ALTERNATE PARADE ROUTE INTRODUCTION The city's Event Management Team has received a request from the Main Street Constitution Day Parade committee to conduct a parade on a route other than the City'S authorized parade route (SMMC Section 4241). The following report outlines this event request and recommends approval, with modifications, as established by the city's Event Management Team, as well as approval of the alternate parade route. BACKGROUND At its regularly scheduled meeting of April 26, 1988, the City'S Event Management Team reviewed a request by the Main street Constitution Day Parade Committee to conduct a parade on Saturday, September 17, 1988, at 10:00 a.m. Their staging area would be the Rand Corporation parking lot with the parade starting at city Hall and proceeding south on Main street to the southernmost City limits. - 1 - I '-D JUL 1 2 19B8 . . Based upon the information submitted, the Event Team felt more information was needed before a final determination could be made regarding their request. A letter was sent requesting that the parade committee: 1. Consider a possible date change to Sunday to lessen the impact on the City traffic and on the bus routes; and 2. Consider staging south of pico Boulevard due to traffic congestion at pico and Main Street; and 3. Obtain official endorsement from Main street merchants indicating their approval due to the disruption of Main Street business which the parade is likely to cause. The letter indicated that, upon receipt of this information, further discussion would be held by the Event Team. On July 5, 1988, the Event Team met with the applicant to discuss the use of alternate routes, a shortened route or an alternate date. The applicant indicated during this discussion that Saturday, September 17, 1988, was the only day possible for the parade, that Main street was the only route the Parade Committee would consider using, and that a shorter route less desirable. DISCUSSION Based upon the request and given the traffic and bus route impacts which would result from the use of the Parade Committeefs desired route, the Event Management Team recommends that the city Council approve use of the alternate Main Street route but - 2 - . . restrict the route to south of Ocean Park Boulevard based upon the following: 1. OVer 20,000 vehicles per day use Pico Boulevard near Main street: over 15,000 vehicles per day use Ocean Park Boulevard near Main Street. During the period when the parade is in operation, the closure of pica Boulevard would impact approximately 700 vehicles: the closure of Ocean Park Boulevard would also impact approximately 700 vehicles. It is anticipated that traffic would divert and detour into the residential areas east of Main street and thus create an adverse impact. 2. The civic Auditorium is having its Twenty-Third Annual Cat Show on Saturday and Sunday, September 17 and 18 from 9:00 a.m. to 9:00 p.m. The average traffic generated by the shows is about 1,400 cars for the weekend. Each day there are approximately 1,000 people in attendance. Given the large attendance which is anticipated, staff does not believe it is advisable to block off the Main street entrance to the civic Auditorium for up to thirty minutes while the parade passes from its staging area at the Rand Corporation. 3. Approximately 135 bus passengers on four bus lines would need to be relocated to Neilson Way for their bus stops should the city shut down Main street from Rand to Rose Avenue. By limiting the Main street closure to south of Ocean Park Boulevard, far fewer bus riders would be impacted and the Main Street route south of Ocean Park Boulevard can be more easily rerouted to Neilson way or Fourth street as long as Ocean Park Boulevard remains open. - 3 - . . 4. At the meeting, the parade coordinator indicated there would be 8-10 units in the parade. staff believes that staging for the parade can be easily accommodated in Parking Authority Lot *9. BUDGET/FINANCIAL IMPACT There is no financial impact as the Main street Constitution Day Parade committee will assume and pay for all costs associated with this event. RECOMMENDATION staff recommends that the city council approve the following: 1. The parade date of saturday, September 17, 1988; 2. That the Main street Constitution Day Parade be conducted south of Ocean Park Boulevard to the southernmost City limits; 3. CRS:BFM:DTA:DM:tb Council Meeting July 12, 1988 RESOLUTION NO. 7653(CCS) (City council Series) Santa Monica, California A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE HOLDING OF A PARADE ON SEPTEMBER 17, 1988, ON A ROUTE OTHER THAN THE OFFICIAL CITY PARADE ROUTE WHEREAS, pursuant to section 4241 of the Santa Monica Municipal Code, the City Council may authorize a parade route as set forth therein, NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That on September 17, 1988, between the hours of 9:30 a.m. and 12:00 noon, participants in the Main Street Constitution Day Parade are authorized to conduct a parade along the following route: The parade will start in Santa Monica on Main street on the south side of the Ocean Park Boulevard intersection and proceed south on Main Street to the Santa Monica City limits. SECTION 2. permission to conduct the parade is granted upon the following conditions: - 1 - . . a. Parade units will be brought to the staging area, the parking lot at Neilson Way and Ocean Park Boulevard, prior to 9:30 a.m., Saturday, September 17, 1988; b. The Main Street Constitution Day Parade Committee shall: 1. pay a clean up deposit of Five Hundred Dollars ($500) prior to obtaining a permit for street and parking lot cleaning~ 2. Provide insurance coverage in the amount of One Million Dollars ($l,OOO,OOO) per individual occurrence naming the city of Santa Monica as additional insured using the following language: " The city of Santa Monica , its City Council, boards and commissions, officers, agents, and employees shall be named as additional insured"~ 3. Pay for the necessary number of police officers, as recommended by the Santa Monica Police Department for crowd and traffic control along the parade route, at a cost estimated to be approximately Nine Hundred and Eighty Dollars ($980); 4. Pay first class postage for flyers mailed to all residents and businesses on the parade route as well as two blocks east and west of the parade route, informing them of the event date and time, street closures and alternate traffic routes. Flyers will be approved by City staff prior to mailing; 5. Pay for and post "TOW AWAY-TEMPORARY NO PARKING" signs at a cost of One Dollar ($l.OO) per sign (one per meter) ; - 2 - .. . . 6. Pay for "NO PARlCING" meter bags on meters (where required) at a cost of Four Dollars ($4 . 00) per meter bag and Fifty Dollars ($50.00) service charge for bagging; and 7. Pay One Hundred Dollars ($100) deposit for barricade usage. An additional Twenty Four Dollars ($24) fee will be required if City staff is required to deliver and piCk-up barricades. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. Santa Monica, California RESPONSE TO STAFF REPORT TO: Mayor and C~ty Council FROB.: Main Street Consitution Day Parade, Board of Directors SUBJECT: RECOM1-1ENDATION TO APPROVE ALTERNATE PARADE ROUTE INTRODUCTION The Main Street Constitution Day Parade Board of Directors requests that the City Council of Santa Monica carefully rev~ews the appropriateness of the or~ginal parade route and time proposed by the Parade Committee. That route calls for staging at the Rand Corporation Parking Lot and a beginning ceremony at City Hall with city officials and other d1gnitaries. The Parade would then proceed south along Main Street to the southern most city limits and then into the City of Los Angeles for dispersal around Rose Ave. BACKGROUND During the 1987 Bi-Centennial of the U.S. Constitution in September, over forty Main Steet Businesses participated in either window displays, supplying of prizes, a commemorative add, or support1ng the public reception at the Heritage Museum. In late August, a request was made to the C1ty of Santa Monica Special Events Team for a parade permit. The Special Events Team response was that there was insufficient time for the needed vote of approval by the City Council for an alternate to the regulare parade route. In October, a meeting was held at Grand American Fare with several persons from the Main Street Business District and Don Arnett from the City of Santa Monica. At the time Mr. Arnett requested a petition of support for the parade from at least fort Ma1n Street Merchants if plans for the parade were to be approved. In April of 1988, a meeting was held at the Chinois Restaurant with members of the business community. The proposed parade route was identified. That week a parade application was filed with the City of Santa Monica. Dodie Mosby of the City of Santa Monica Special Events team attended the next two meetings of the Parade Committee. At the second meet~ng it was unanimously approved to c1rculate a petition amongst the Main Street businesses. Over 70 signatures- were eventually turned into the Special Events Team from the representatives of businesses in the Main Street Special Assessment District. All but two of the signators expressed individual preference for Saturday, September 17, from 10-11 a.m. . . DISCUSSION Several discussions have been held with the staff of the Special Events Team to identify problems and to provide solutions. THE SPECIAL EVENTS TE~ APPROVED THE ENTIRE ROl~E FROM CITY HALL ALONG MAIN STREET TO THE SOUTHERN MOST CITY Llr1ITS FOR SUNDAY AFTERNOON, SEPTEMBER 18. EXCEPT FOR THREE INDIVIDUAL ADDITIONAL BUSES, EVERY PROBLEM THE STAFF RAISES REGARDING SATURDAY MORNING EXISTS TO A GREATER EXTENT SUNDAY AFTERNOON. The staff has acknowledged the inadvisability of a Sunday morning parade because of conflicts with most church services especially on the very day that religious education classes f0r the Fall are commonly being organized. It is the problem of disrupting traffic and business in the afternoon which has caused the businesses to overwhelmingly approve Saturday morning and not afternoon. The staff has been mislead by the city traff~c counts which are taken mid-week and not on the weekend and reveal morning rush hour traffic not weekend configurations. That Sunday afternoon traffic on pico Blvd. at Main Street is 3-4 times greater than Saturday 10-10:30 a.m. when it will be ~mpacted by the Parade. THE PARADE PROPOSAL DOES NOT CALL FOR CLOSING EITHER PICO BLVD. OR OCEAN PARK BLVD. THE PARADE BOARD RECO~YrnNDS APPROVAL OF THE PARADE FORMATION WHEREBY REGULAR BREAKS ARE RUN IN THE PARADE TO ALLOW ROSS TRAFFIC THROUGH AT PICO BLVD. AND OCEAN PARK BLVD. AND PERHAPS HILL ST. IT IS ASSUMED THAT TF~ STAFF APPROVED THIS FORMATION FOR THE SUNDAY PARADE. THE PARADE PROPOSAL DOES NOT CALL FOR BLOCKING THE MAIN STREET ENTRANCE TO THE CONVENTION CENTER. WITH PROPER SIGNAGE THERE IS NO PROBLEM IN ALLOWING WEST BOUND TRAFFIC ON PICO TO TURN RIGHT ON MAIN STREET TO THE CONVENTION CENTER. Main Street in that section is sufficiently wide to allow the parade and such a convention center access. The problem and the solution would also equally apply to Sunday, which again was approved by staff. The proposed access would provide for the same number of vehicles to pass by the ticket booths as with unrestricted access. The problem at the convention center is also predictably greater for a Sunday afternoon. ALLOWING CROSS TRAFFIC AT PICO BLVD., OCEAN PARK BLVD, AND HILL WOULD RESULT IN ONLY ONE ADDITIONAL #1 BUS AND TWO ADDITIONAL #8 BUSES BEING AFFECTED ON A SATURDAY RATHER THAN A SUNDAY. . . RECOMMENDATION The Ma1n Street Constitution Day Parade Board of D1rectors recommends that the City Council approve the following: 1. The parade date of Saturday, September 17, 1988. 2. That the Main Street Constitution Day Parade be conducted from the Santa Monica City Hall south along Main Street to the southernmost City limitsi 3. Robert I s Rules Order Newly Rev1sed shall be the parllamentary authorIty of the Board of DIrectors and its committees, except the ConstItution of thIS orgaruzatlon shall prevail where there is a contradIction with those rules of order. A quorum shall cons~st of a slIDple maJorIty of the Board. . . ~ I . Section 5. The Board of Dlrectors shall be the Judge of the qualiflcatlons of its own members and keep a Journal of its mlnutes approved by the body and slgned by the Chairman. The nunutes of all meetings except for execut1ve sessions shall be made avallable to the public. Section 6. Except for the Vice-President, no member of the Board of Dlrectors shall concurrently hold an executive office ln the Parade Organizat1.on but on the day of the parade ltself. No member of the Judlcial Panel shall concurrently hold an executlve position or be a member of the Board of Directors. Section 7. The resolutJ.ons of the Board of Dlrectors shall govern the Parade Organlzatlon upon the s1gnature of the President unless within five days he shall veto it and return lt with an explanat10n for d01ng so to an offlcer of the Board. The Board may override that veto wlth a two-thirds vote at the first or second regular meeting folloW1.ng the veto. If the Presldent does not Slgn the resolution nor veto it wlthin f1ve days of receiving it, l.t shall be the same as 1f he had slgned it. Section 8. The Board of Directors shall have the power to establ1sh the dues and fees for the Parade Organazation; To determlTIe the budget; To establish the policles determilllng the order of march of the Parade; To elect the Presldent by a majority vote; To advise and consent to the appolntment of the Jud1c1al Panel and inferior tribunals; To award titles of honor; To make all acts necessary and proper for carrylng into executlon the powers vested 1n the Main Street Constltutlon Day Parade; To adopt logos, theme songs, mascots, and program covers. Section 9. The ~.ain Street Constitut1on Day Parade shall not endorse any political candidate or ballot measure nor shall it involve ltself in any other cause besides that approprlate to organlZlng an annual ~min Street Constitution Day Parade. Section 10. The Board of Directors shall elect from 1 ts membershlp by a maJorlty vote a Chairman and a Secretary. The Cha:lDnan shall have as his principal duty to provide for the proper operatlon of the Board in accordance with Robert's Rules of Order Newly Revised. The Chairman shall also be the Vice-President of the organization. - . . . . The Secretary shall keep the m1nutes and aSS.1st 1n the preparatlon of agendas. _ All expenditures shall be approved in advance by the Board. Checks shall be slgned by two of the folloWlng three parade ofIiclals: Presldent, Treasurer, Secretary. ARTICLE II Section 1. The executlve power shall be vested ln the Parade President. There shall be electlons for two regular terms durlng the year for all parade elected offIces. The flrst term shall begln with an electlon on the flrst Wednesday 1n July at a regular meetlng of the Board of D1rectors. The flrst term shall end wlth the electlon for the second term to be held on the flrst Wednesday 1n October a t a regular meetlng of the Board of Dlrectors, and so forth. These meetlng dates may be changed by a two-thlrds vote at a regular meet.rng of the Board, Section 2. Candldates for President shall be quallfied by subm1ttlng a petltion slgned by fifteen representatives of businesses ~thln the Main Street Speclal Assessment District to the Secretary of the Board for lnclus10n in the minutes. The Vice-Presldent shall assume the offlce of the Pres.1dent durlng that perlod of time ~lch the Board by a 2/3 vote shall determane the Presldent 1S not able to perform the duties of his office. No person shall hold an executlve offlce for more than two consecutive parades, Section 3. The President shall be Commander ln Chlef of the parade. The President shall have power, by and ldth the Advlce and Consent of the Board, to make contracts, provlded two thirds of the Board present concur; and he shall nominate, and by and w1th the consent of the Board, shall appoint parade representatlves, members of the Judicial Panel, the Treasurer, and other executive off1cers, but the Board may, by resolution, vest the appointment of such inferlor officers, as they thlnk proper, ~n the Presldent alone, or ln the Jumclal Panel. The tenn of all executive offlcers shall automat1cally expire wlth the tenns of elected offlclals of the organlzatlon. However, any appolnted execut~ve offlcer may be rel1eved of his office by hlS ow~ reslgnatlon or by the same procedures by whlCh he was placed in that offlce. The President shall have the power to flll all vacanCles in executlve off1c.es that may Oc.cur between the regular meetlngs of the Board by grantlng COmnuSS10ns which shall expire at the end of the next regular meetlng of the Board. . . . The PresJ.dent shall from tlll1e to tl.Ille glve to the Board informatJ.on of the state of the organlzatlon and recommend for thelr cons1derat1on such measures as he shall Judge necessary and expechent; he shall be the chlef representat1ve of the organ1zatlon; and he shall take care that the laws be faithfully followed and the resolutions of the Board fa1thfully executed. Section 5. The President and other elected officers may be removed from office by the Board in accordance wlth the d1sclpllllary procedures of Robert's Rules of Order Newly Rev1sed. ARTICLE III Section 1. The judicial power of the Parade Organlzation shall be vested in a three member Judlclal Panel and in such 1nferlor tr1bunals as the Board may from time to t1ffie establish. Section 2. The JudJ.cial Panel shall have the authorlty to adJudlcate cases arislng under this constitution and shall make the flnal judgment upon appeal by a parade applicant or two members of the Board on the qualJ.fication of the appllcant to participate in the parade, Board members must give notice of their appeal to a member of the Judicial Panel within seven (7) days of the Board beJ.ng notJ.fied at a regular meetlng by the President that the Executlve Branch has approved or dlsapproved an applicatlon. In other cases, any person who is participatlng l.n or who is effected by this organJ.zation or ltS actJ.vJ.tJ.es may brlng hJ.s or her case, arisJ.ng under this constltutlon or the resolutlOns of the Board, before the Judic1.al Panel provJ.dlng one member of the Board of Dlrectors so approves. Section 3. The Jumclal Panel and lnferior tribunals shall follow the prlnclples of due process. Section 4. The Jud1cial Panel shall hear and determine cases wlthln ten working days of thelr being filed wlth a member of the panel. Section 5. If a member of the Judicial Panel 1S unable to partJ.cJ.pate In the hearing of and passlng Judgment of a case, an alternate may be appointed by the Chairman of the Board for the duratlon of that case, .. . . ARTICLE IV Section 1. Membership on the Board of Directors WlIl automatlcally be termlnated If a member lS absent for three consecutlve meetlngs of the Board or for a total of flve meetlogs durlng the course of anyone term as des1gnated in Article II, Section 1, or upon the Board of Dlrectors' acceptance of a notlce of reslgnation s1gned by the member. The replacement of a termlnated member of the Board of Directors durlng a term shall be by approval of a sImple majority vote of the Board. Section 2. No person shall have their rlghts or pnvlleges preJudlced ln thlS organrrzation or 10 the parade by thelr race, creed, color, or lawful participation in any other organizatlon, but parade partlClpants shall subscrlbe to and ablde with the Constitutlon of thlS organazatlon, specifically lncludlng the organizatlon purposes deslgnated ln the Preamble. ARTICLE V Section 1. TIus const1tutlon shall be amended by the proposed amendment belng presented at a regular meeting of the Board of Directors; a petltlon then belng clrculated to and recelvlng the endorsement of at least a simple majority of the full membership of the Board; and that petition belng presented Wlthin thlrty (30) days to a regular meet1ng of the Board, or at the next regular meeting thereafter. Section 2. This constltutlon shall be adopted by receiv1ng a 3/4 vote at a regularly scheduled meetlng of the Ma1n Street Constitutlon Day Parade Organrrzlng Committee and subsequently the articles of lncorporatlon being slgned by at least nine delegates as ldentlfied in Artlcle I, Sectlon 2. ARTIr.r.R VI The non-proflt corporation, the Maln Street Constltutlon Day Parade, shall be dissolved within three months of its failure to put on an annual parade in celebrat10n of the Unlted States Constitution 1n the month of September. It shall be the duty of the Cbalrman of the Board or the next ranking active offlcer of the Board to notify the Secretary of State of the dlsSolutlon of the corporation. ~ ~ . .
