At J..ts meetlng on December 13, 1983, the Cl ty Council
adopted Ord~nanee Number 1290 (CCS) addlng Section 3390 to Santa
MonJ..ca Mun~cipal Code relat1ng to unauthorlzed persons
part~clpat1ng ln, obstruct1ng, and be1ng present on the approved
course of runnlng and other sportlng events sanctJ..oned by the
CJ..ty.
A error by the Clty Attorney resulted J..n a sect~on number
belng assJ..gned that was already In use.
Accordlngly, the
accornpanYJ..ng ordlnance changes Sectlon 3390 to Sectlon 3620. No
substant1ve changes have been made.
RECOMMENDATION
It 15 respectfully recommended that the accompauYlng
ordJ..nance be J..ntroduced for flrst readlng.

AN ORDINA~CE OF THE CITY COUNCIL
OF THE CITY OF SA~~A MONICA
ADDING SECTION 3620 TO THE
SANTA MONICA MUNICIPAL CODE
RELATING TO R~~NI~G A~D
OTHER SPORTING EVENTS ON PUBLIC
PROPERTY
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Section 3620 is added to the Santa Monlca
MunlClpal Code to read as follows:
SECTION 3620.
Running and Other
Sportlng Events.
In connect ion W~ th any
running or other sporting event for which a
permlt or other approval has been issued by
the Cl ty of Santa r-10nlca, no person who is
not a reglstered or authorizeo partlclpant in
the event snaIl partlclpate in, obstruct, or
be on the approved event course durlng the
conduct of the event after havlng been
requested by a peace officer or other event
offlC1al to discontlnue participation,
obstructlon, or presence on the approved
event course.

SECTION 2.
Ordinance Number 1290 (CCS) 2S repealed.
SECTION 3.
Any provlsion of the Santa Monica Munlcipal
Code or appendJ..ces thereto lnconslstent with the provlsions of
thlS ordinance, to the extent of such inconslstencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provls1ons of this ordinance.
SECTION 4.
If any sectlon, subsection, sentence, clause,
or phrase of thlS ord~nance is for any reason held to be lnvalld
or unconstitutional by a declsion of any court of any competent
]urisdictlon, such decision shall not affect tne valldity of the
remaln~ng partlons of the ord~nance.
The City Counell hereby
declares that it would have passed t1ns ordinance and each and
every section, subsect~on, sentence, clause or phrase not
declared lnvalid or unconstltutlonal witltout regard to whether
any portion of the ordlnance woulo be subsequently Qeclared
lnvalid or unconstltutlonal.
SECTION 5.
The Mayor shall slgn and the City Clerk shall
a ttest to the pas sage of thlS ordinance.
The Clty Clerk shall
cause the saP1e to be published once in the officlal newspaper
WJ..thln 15 days after ~ts adopt~on.
The ordl.nance shall become
effective after 30 days from its adoption.
