SR-303-019 (2) EPWM:CC:AA:FJS F:\DATA\SPFILES\SP1612 Pergola\contract modification.doc City Council Meeting: February 12, 2002 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Modification of Construction Contract Number 8011(CCS) with Dynamic General Contractors for the Crescent Bay Park Pergola Seismic Retrofit and Restoration Introduction This report recommends that the City Council authorize the City Manager to negotiate and execute a modification of Contract 8011(CCS) with Dynamic General Contractors for the seismic retrofit and restoration of the Crescent Bay Park Pergola in an amount not to exceed $100,000. Background The Crescent Bay Park Pergola is a wood trellis and concrete column structure constructed between 1911 and 1914 as part of the City Beautiful movement. The 1994 Northridge Earthquake damaged the structure by displacing and cracking the concrete columns, capitals and pedestals. This structure is eligible for listing in the National Register of Historic Places and is significant as a very good example of recreation/park architecture. The Federal Emergency Management Agency allocated funds for the repair and retrofit of the Pergola and the project has been identified as part of the Grant Acceleration Program. 1 On October 23, 2001, the City entered into Contract Number 8011(CCS) with Dynamic General Contractors for seismic retrofit and restoration work in the amount of $224,700. The contractor began work on November 15, 2001. Discussion During restoration, it has been found that the amount of cracking in the concrete columns is substantially greater than found by the architect in earlier inspections. It will be necessary to repair these additional cracks through epoxy injection at an additional cost. Further, the contractor is expecting to be compensated for a work delay of approximately one month as a result of this and related problems dealing with these extremely old and fragile columns. The costs of the additional work will exceed 25% of the original contract amount, making it necessary that a modification to contract be authorized. Budget/Financial Impact FUNDS REQUIRED. Estimated additional cost of column repair and delays $ 90,000 Contingency $ 10,000 Total Funds Required $100,000 FUNDS AVAILABLE: A transfer of $100,000 will be required from account C11065802.589000 to account C11075502.589000. Since the Pergola seismic retrofit and restoration project is part of the FEMA GAP program, it may be possible to transfer underruns on other GAP projects 2 to cover the cost overrun on this project. This won’t be known until other projects are completed and staff is able to verify whether or not a GAP underrun amount exists. Recommendation Staff recommends that the City Council: 1. Authorize a transfer of funds between accounts as indicated above. 2. Authorize the City Manager to negotiate and execute a modification of contract number 8011 (CCS) with Dynamic General Contractors in an amount not to exceed $100,000.
