SUBJECT:Award of a Construction Contract for the Crescent Bay Park Pergola
Seismic Retrofit and Restoration
Introduction
This report recommends that the City Council award a contract for the seismic retrofit and
restoration of the Crescent Bay Park Pergola to Dynamic General Contractors, Inc., the
best bidder, in the amount of $224,700 and approve a contingency amount of $22,470.
Background
The Crescent Bay Park Pergola is a wood trellis and concrete column structure
constructed between 1911 and 1914 as part of the City Beautiful movement. The 1994
Northridge Earthquake damaged the structure by displacing and cracking the concrete
columns, capitals and pedestals. This structure is eligible for listing in the National
Register of Historic Places and is significant as a very good example of recreation/park
architecture.
The Federal Emergency Management Agency allocated funds for the repair and retrofit of
the Pergola and the project has been identified as part of the Grant Acceleration Program.

Discussion
A Notice Inviting Bids for the construction contract was published on June 1 and June 3,
2001 in the Los Angeles Times, Westside Weekly, and the F.W. Dodge newsletter. The
bid package was sent to eleven public plan rooms including five women/minority business
enterprise associations. The City Clerk’s office received five sealed bids, which were
publicly opened and read aloud on July 6, 2001 by the Deputy City Clerk. The bid results
were as follows:

Dynamic General Contactors, Inc. $224,700
Universal Construction & Maintenance $266,000
L.A. Builders, Inc. $302,500
Americon Constructors, Inc. $429,134
City Engineer’s Estimate $245,000
The bid of the lowest monetary bidder, Dr. Vic Construction was non-responsive and
incomplete.
In the Bidder’s Qualification Statement, Dr. Vic Construction failed to provide the following
information:
Evidence of the sufficiency of the bidder’s financial resources.

Evidence of experience on projects of similar size, scope and cost.

A Bid Guarantee or Bidder’s Bond as required accompanying the bid.

Section 2.24.072 of the Santa Monica Municipal Code, as amended by Ordinance Number
1998 (CCS), sets forth the criteria under which staff may determine the best bidder as:
1. Price;
2. The quality of the material or services offered;
3. The ability, capacity or skill of the bidder to perform the contract or provide
the materials or services;
4. The capacity of the bidder to perform the contract or provide the service
promptly, within the time specified, and without delay or interference;
5. The sufficiency of the bidder’s financial resources;
6. The character, integrity, reputation, judgment, training, experience and
efficiency of the bidder;
7. The ability of the bidder to provide such future maintenance or service as
may be needed; and
8. Any other factor which will further the intent set forth in Section 608 of the
City Charter.
The best bidder, Dynamic General Contractors, Inc., which submitted a responsive and
complete bid, supplied the City with a list of recent projects similar in scope. Five of the six
references were successfully contacted; all gave good reports of the work performed by

this contractor. The projects included school modernizations/remodels with the Los
Angeles Unified School District, Duarte Unified School District, and Glendale Unified
School District. The contractor has remodeled the Nickerson Gardens Community Center
and North Hollywood recreation center pool and deck for the Los Angeles Department of
Recreation and Parks.

required. With this transfer, funds will be available in the following accounts:

Recommendation
Staff recommends that the City Council:
1. Award a construction contract for the seismic retrofit and restoration of the Crescent
Bay Park Pergola to Dynamic General Contractors, Inc., in the amount of $224,700
and approve contingency funds in the amount of $22,470; and

2. Authorize the City Engineer to issue any necessary change orders to complete
additional work in conformance with the Administrative Instructions on change
orders.
