SR-303-012 (4) EPWM: H:\Staff Reports In Process\8_09\Airport Park Soil.doc Council: August 9, 2005 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Soil Remediation Contract for the Santa Monica Airport Park Project Introduction This report recommends that the City Council award a contract to Waste Management, Inc., in the amount of $220,536 plus contingency in the amount of $22,054 (10%) for contaminated soils remediation for the Santa Monica Airport Park project. Background The Airport Park project encompasses approximately eight acres of non-aviation designated land at the southeast corner the Santa Monica Municipal Airport. On May 10, 2005, the City Council awarded a construction contract to Los Angeles Engineering, Inc., for construction and a professional service contract to Black & Veatch for construction management services of Airport Park and the associated improvements along Airport Avenue. During the period of April 2000 through June 17, 2002 Komex Environment and Water Resources completed a site investigation, including soil analysis, and preparation of a site assessment report. Komex determined that prior uses on the site necessitated soils remediation prior to construction of the park. Impacted soils are to be excavated, removed 1 form the site, and disposed of at an appropriate disposal facility. Discussion A Notice Inviting Bids for the soils remediation of the site was published in the Los Angeles Times on May 3 and 7, 2005. The bid package was sent to eleven public plan rooms. Fourteen contractors requested bid packages and the City Clerk’s office received four sealed bids, which were publicly opened and read aloud on June 14, 2005, by the Deputy City Clerk. The bid result was as follows: CONTRACTOR AMOUNT Waste Management, Inc. $220,536 Miller Environmental Inc. $246,000 Accord Engineering, Inc. $326,630 Los Angeles Engineering, Inc. $413,480 The City’s estimate for the project was $280,000. The best bidder, Waste Management, Inc., supplied the City with information on similar projects they completed. These projects included environmental remediation services for the City of Anaheim, Port of Los Angeles, U.S. Army Corp of Engineers, Tutor-Saliba contractor for the Alameda Corridor Transportation Authority, TRC Solutions environmental consultant for Voit Development, Southern California Edison, UMETCO a subsidiary of Union Carbide, and Boeing Corporation. City staff contacted the agencies and companies representing these projects and all respondents reported that the contractor's work quality 2 was satisfactory and that work was completed in a timely and cost-efficient manner. Staff also contacted the Center for Contract Compliance and found Waste Management, Inc., in good standing and capable of handling labor compliance issues. The California Contractors State License Board verified that the contractor's license is active and in good standing. Staff from the City’s Civil Engineering & Architecture and Environmental Programs Divisions met with Waste Management’s project manager and found his understanding and approach to the project to be consistent with the City’s expectations. Miller Environmental, Inc., the second low bidder, submitted a bid protest letter dated June 20, 2005, in which they requested that the City deem the bid from Waste Management, Inc., the lowest monetary bidder, to be non-responsive based on the insertion of a handwritten note on the bid form and the use of a bid bond form other than the bid bond form provided in the bid package. The City Attorney’s Office reviewed Miller Environmental’s letter along with Waste Management’s bid and found Waste Management’s bid to be valid and acceptable. Budget/Financial Impact Funding Required: Remediation of Contaminated Soil $220,536 Contingency (10%) $22,054 Total Required $242,590 Funds in the amount of $242,590 are available in account C010666.589000, “Airport Park.” 3 Recommendation Staff recommends that City Council: 1. Award a soil remediation contract with Waste Management, Inc., in the amount of $220,536 plus a contingency of $22,054 (10%) for remediation of contaminated soils for the Airport Park project; and 2. Authorize the City Engineer to issue any necessary change orders to complete additional work within budget authority.
